החלטה
בפני ערר על החלטת בית המשפט המחוזי מרכז מיום 13.5.2010 (השופט אחיקם סטולר) אשר ניתנה ב-מ"ת 32254-04-10, לפיה נקבע כי קיימות ראיות לכאורה ברמה נמוכה, ולכן יש מקום לשחרר את העורר בתנאים מגבילים. הערר הינו על ההחלטה כי קיימות ראיות לכאורה, וכן על תנאי השחרור. העורר שוחרר בהפקדה בה אין הוא יכול, לטענתו, לעמוד והוא מבקש לשחררו בלא ערבות או למצער לבטל את ההפקדה.
כתב האישום

בכתב האישום כמה אישומים מהם רק אחד – האישום השלישי – נוגע לעורר, גבי לוסקי שהוא נאשם מס' 4. על פי עובדות כתב האישום, בתאריך 11.4.2010 בשעות הצהריים, שוחחו העורר ונאשם 1 בכתב האישום, מאיר פינטו, טלפונית, וקבעו ביניהם כי נאשם 1 יספק לעורר סמים, ובתמורה יעביר העורר לנאשם 1 כסף (להלן: עסקת הסמים ). בהמשך היום, עדכן העורר את נאשם 1 כי הנאשם 5 אייל ביטון, גיסו, יגיע אליו לצורך ביצוע העסקה וקבלת הסמים. בסמוך לשעה 19:00 באותו היום, נפגש נאשם 1 עם נאשם 5 ומסר לו סם מסוכן בכמות של 50 גרם
לערך. בסמוך לאחר ביצוע העסקה הודיע העורר לנאשם 1 כי קיבל את הסמים מנאשם 5.

במעשיהם המתוארים לעיל, כך על פי כתב האישום, החזיקו העורר ונאשם 5 סמים שלא לצריכה עצמית בצוותא חדא, ללא היתר כדין. על מעשיו אלו הואשם העורר בהחזקת סם מסוכן שלא לצריכה עצמית – עבירה לפי סעיפים 7(א) ו-7(ג) רישא לפקודת הסמים המסוכנים [נוסח משולב], התשל"ג-1973, יחד עם סעיף 29(ב) לחוק העונשין, התשל"ז-1977. סוג הסם לא נזכר בכתב האישום.
השתלשלות ההליכים

יחד עם כתב האישום, הוגשה כנגד העורר ביום 26.4.2010 בקשה למעצר עד תום ההליכים.

ביום 13.5.2010 דן בית המשפט קמא בשאלת קיומן של ראיות לכאורה בעניינם של העורר ושל הנאשם 5. בית המשפט קבע כי הראיות היחידות שיש למשיבה הינן שיחות בדבר עסקה כלשהי שנרקמה בין העורר לנאשם 1 אשר קבעו בניהם נקודת מפגש, בדבר הנאשם 5 אשר נשלח לנקודת המפגש, ובעניין הנאשם 5 שנתן כסף לנאשם 1 וקיבל ממנו דבר-מה. בית המשפט ציין כי אין אמנם צורך לתפוס סם מסוכן בעין וכי ניתן להוכיח את היותו של הסם סם מסוכן בראיות חיצוניות כשרות אחרות. ואולם, בית המשפט לא מצא בראיות התביעה ראייה כלשהי המצביעה, ולו לכאורה, כי מדובר בסם. אם אכן מדובר בסם, כך ציין בית המשפט – אין ראיה מאיזה סוג, ומהם כמותו וריכוזו – עובדות שעשויות להיות רלוונטיות משמדובר בסוג סם שלגביו אף נדרש להוכיח ריכוז כיסוד סובסטנטיבי. לפיכך, ובהעדר ראיות לכאורה נגדו, הורה בית המשפט על שחרור הנאשם 5.

ואולם בעניינו של העורר, הכרוך ושלוב בזה של הנאשם 5, קבע בית משפט קמא (השופט א' סטולר):
"באשר [לעורר] – [העורר] הוא החוליה המקשרת בין המשיב 1 למשיב 5 כך גם נשמע [העורר] כאומר לחוקר דברים מהם ניתן להבין שהוא סבור שללא חומר שנתפס לא ניתן להוכיח כי ביצע עבירת סם. אשר על כן, ניתן לומר שבעניינו של [העורר] יש ראיות לכאורה אך כוחן הראיתי הלכאורי של אלה הוא עמום ובעל עוצמה נמוכה ויש להביא עניין זה בחשבון כשבאים לבחון חלופת מעצר לגביו."

בהחלטה נוספת מיום 16.5.2010 קבע בית המשפט כי לאור עברו הפלילי העשיר של העורר, ונוכח העובדה כי טרם התקבל תסקיר מעצר בעניינו, רואה הוא לנכון לשחרר את העורר בערובה בתנאים כדלקמן: מעצר בית מלא בביתו, ערבות עצמית בסך של 20,000 ש"ח, ערבות צד ג' של כל אחד מהמפקחים שנקבעו לעורר, בסך 10,000 ש"ח, הפקדת מזומן בסך של 25,000 ש"ח, עיכוב יציאה מן הארץ, הפקדת דרכון ואיזוק אלקטרוני. כמו כן קבע בית המשפט, כי יוכן בעניינו של העורר תסקיר מעצר אשר יבדוק את התנאים שנקבעו, וכן האם ניתן, במידת מה, להקל בתנאים הנ"ל, באופן שלא יפגע באיון מסוכנותו של העורר. באותו מעמד הודיע בא כוח העורר כי לעורר אין האמצעים להשיג את סכום ההפקדה הנדרש, ואף לא קרוב לסכום זה. דיון בתסקיר נקבע ליום 7.6.2010.
טענות הצדדים

העורר העלה בעררו טענה שעל פניה נשמעה משכנעת. וזה הילוכה של הטענה: לשיטת העורר טעה בית משפט המחוזי בקובעו שיש לערוך הבחנה בין העורר לנאשם 5. לשיטת העורר, אין חולק כי מי שנראה מוסר את הכסף, ומקבל דבר מה, הנו נאשם 5. משקבע בית המשפט שאין ראיה לסם, הרי שקביעה זו רלוונטית לכלל התיק ולא רק לנאשם 5. לשיטת העורר, אין חולק כי נעשו שיחות בינו לבין נאשם 1, וכי העורר הוא ששלח את נאשם 5, אולם משקבע בית המשפט כי אין ראיות לכאורה לכך שמדובר בעסקת סם, הרי ששיחות אלו אינן יכולות לחזק את עוצמת הראיות כנגדו.

עוד טוען העורר, כי שגה בית משפט קמא בקובעו כי שאלה שהפנה העורר לחוקרים באם נתפס "מוצג", קרי סם, מחזקת את עוצמת הראיות כנגד העורר, והנה הבסיס להבחנה בינו לבין הנאשם 5 ששוחרר. בשים לב לקביעת בית המשפט כי אין כל אפשרות להרשיע בתיק זה בביצוע עסקת סם, הרי שהשאלה האמורה, הנה חסרת כל משקל ומשמעות, ולבטח אין בה כדי להצדיק הבחנה כה משמעותית בין העורר לבין נאשם 5.

כן טוען העורר, כי טעה בית משפט קמא בקובעו תנאי שחרור כה חמורים בעניינו של העורר, כאשר נאשם 5 שוחרר על אתר ללא כל תנאי.

כאמור, טענת בא כוח העורר בערר נשמעה לכאורה משכנעת. על כן, מיד בפתח הדיון בקשתי את התייחסותו של בא כוח המשיבה, עו"ד גורדון, לשאלת הראיות לכאורה. ואכן – עו"ד גורדון הציג בפני מסכת ראיות רחבה יותר מזו העולה מהחלטת בית המשפט. בא כוח המשיבה מבקש להקיש נסיבתית, מעסקאות אחרות בהם מואשם נאשם 1, פינטו, עם אחרים, באותו כתב אישום. מעסקאות אחרות אלה הוא מבקש ללמוד, נסיבתית, מה טיבה של העסקה נשוא האישום השלישי. במיוחד הצביע בא כוח המשיבה על הראיות הנוגעות לאישום השני שעניינו עסקה שנעשתה בין נאשם 1 לנאשם 2 שעה אחרי העסקה לגביה מואשם העורר. בעקבות שיחה זו, שלח נאשם 2 את בנו נאשם 3, והפעם נתפס סם מסוכן מסוג קוקאין במשקל כולל של 307 גרם . עניין זה ושיחות רבות נוספות שניהל פינטו עם אחרים ב"קודים" דומים לאלה בהם השתמש בשיחתו עם העורר מצביעות, נסיבתית, על כך שפינטו מכר סמים. זאת אף זאת: עו"ד גורדון הציג גם שיחות קודמות בין העורר לבין נאשם 1, בהן מתנהל דו שיח לגבי מכירת דבר-מה, כלשון קודים. הוא מדגיש כי הן פינטו והן העורר שמרו בחקירתם על זכות השתיקה, וממילא אין השניים מציגים הסבר לשיחות שבקודים.
הכרעה

הראיות לכאורה הוצגו לי על ידי עו"ד גורדון בצורה מסודרת, עם דברי הסבר, חלוקת החומר בעזרת "חוצצים", כשלכל "חוצץ" מובא הסבר. בא כוח העורר לא צרף את הפרוטוקול הנוגע לניתוח הראיות עובר להחלטתו של בית המשפט המחוזי ואיני יודעת אם הראיות הוצגו לבית המשפט המחוזי באותה הצורה הסדורה שהוצגו בפני. מסקנתי מעיון במכלול הראיות היא כי אף שלא הוכח סוג הסם, עוצמת הראיות לגבי העורר שנעשתה עסקת סמים, כמתואר באישום השלישי, היא בלתי מבוטלת. זאת אף זאת – עוצמת הראיות לגבי העורר הרבה יותר חזקה מאשר לגבי הנאשם 5. בכך יש כדי להצדיק את החלטת בית המשפט לגבי תנאי השחרור של העורר שבפני. אין פירוש הדברים שבית המשפט חייב להשאיר את העורר במעצר אם לא יעמוד בהפקדה של 25,000 ש"ח. העורר יובא בפני בית המשפט ב-7.6.2010 כפי שנקבע מראש, אם לא ישוחרר קודם לכן, ובית המשפט יורה כחוכמתו. ואולם, נוכח עוצמתן של הראיות שהיא חזקה יותר מהמתואר בהחלטה נשוא הערר, אין מקום להתערב בהחלטה.

הערר נדחה.
