בקשה להארכת מועד להגשת ערעור
החלטה
הובאה לעיוני בקשה להארכת מועד להגשת ערעור בעניין פסלות. החלטת בית המשפט המחוזי בבקשת הפסלות ניתנה ביום 15.11.2011, ומכיוון שמדובר בהליך פלילי, המועד להגשת ערעור הפסלות הינו תוך חמישה ימים (סעיף 147(ב) לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב-1982). בבקשה שלפניי הועלתה טענה אחת והיא כי המבקש קיבל את החלטת בית המשפט רק ביום 4.1.2012. ואולם, על ההחלטה שצורפה לערעור עצמו מוטבעת חותמת מתאריך 4.12.2011 – וזה גם תאריך ההמצאה שנטען בערעור הפסלות המקורי שהוגש לבית משפט זה. טענתו של המערער כי מדובר בתאריך שגוי היא בבחינת טענה בעלמא, שאין בצדה הסבר מבורר, לא כל שכן תצהיר. מעבר לכך אציין כי לאחר עיון בערעור גופו ובהחלטת בית המשפט בבקשת הפסלות, התרשמותי היא כי על פני הדברים סיכויי ההליך קלושים, ואף מטעם זה לא ראיתי ליתן ארכה.
הבקשה נדחית, אפוא.
