החלטה
בקשה שניה להארכת מעצרו של המשיב לפי סעיף 62 לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו-1996.

ביום 11.7.2013 הוגש נגד המשיב כתב אישום לבית המשפט המחוזי בבאר שבע, בו יוחסו לו שני אישומים הכוללים עבירות של החזקת סם שלא לשימוש עצמי לפי סעיף 7(א)+(ג) לפקודת הסמים המסוכנים [נוסח חדש], תשל"ג-1973 (להלן: הפקודה ); עבירה של החזקת כלים לצריכת סם לפי סעיף 10 לפקודה; ועבירה של העלבת עובד ציבור לפי סעיף 288 לחוק העונשין, התשל"ז-1977.
על פי המתואר בכתב האישום, ביום 5.7.2012 שכר המשיב דירה באילת ועבר להתגורר בה בו ביום. למחרת ערכו שוטרי משטרת אילת חיפוש בדירה, במהלכו נמצא סם מסוכן מסוג קוקאין במשקל של 51.36 גרם , וסם מסוכן מסוג Lidocaine
במשקל של 10.11 גרם . כן נמצאו שקיות ניילון קטנות גזורות ומשקל אלקטרוני. על פי האישום השני, בהמשך אותו היום, עת היה המשיב עצור בבית משפט השלום באילת, הורה לו אחד השוטרים לא לשוחח עם עצורה נוספת, ובתגובה קילל המשיב את השוטר ואמר לו: "יא מניאק, איתך צריך להתנהג כמו מניאק, אני אגיד שהרבצת לי. מה שאני אעשה לך אתה לא יכול לעשות לי".

ביום 31.7.2012 הורה בית משפט קמא על מעצרו של המשיב עד תום ההליכים. עררו של המשיב לבית משפט זה נמחק בהמלצת בית המשפט (בש"פ 6267/12 מיום 6.9.2012, כב' השופט מלצר), בכפוף לשמירת זכותו של המשיב להגיש ערר בעתיד. בקשתו של המשיב לעיון חוזר נדחתה בהחלטתו של בית משפט קמא ביום 3.1.2013.
בחלוף כשלושה חודשים, ביום 2.4.2013, משתקופת תשעת החודשים מיום הגשת כתב האישום עמדה לחלוף, הגישה המדינה בקשה ראשונה להאריך את מעצרו של המשיב בתשעים יום. המשיב נתן הסכמתו לבקשה זו, וביום 2.4.2013 הוריתי על הארכת מעצרו של המשיב בתשעים יום החל מיום 12.4.2013 או עד למתן פסק דין בעניינו, לפי המוקדם (בש"פ 2184/13 מיום 2.4.2013).
תקופת תשעים הימים מתקרבת לקִצה וההליך בעניינו של המשיב טרם הסתיים, ומכאן הבקשה שלפניי.

בבקשתה מתארת המבקשת את השתלשלות העניינים במשפטו של המשיב, אשר לדבריה הובילה להימשכות ההליך. מענה לכתב האישום ניתן ביום 19.9.2012 והדיון נדחה ליום 31.10.2012, או אז נקבעו מועדי הוכחות לימים 8.1.2013 ו-9.1.2013; ביום 3.1.2013 ביקשה באת כוחו של המשיב לשחררה מן הייצוג, בקשה אשר התקבלה בסופו של דבר, תוך שבית המשפט מורה לסנגוריה הציבורית למנות סניגור חלופי; בחלוף מספר ימים ביקש הסניגור החלופי להשתחרר גם הוא מן הייצוג לאחר שהמשיב הטיח בו דברים קשים, ובית המשפט נענה לבקשתו, תוך שהוא קובע כי המשיב יוכל לחקור נגדית את עדי התביעה בעצמו; בהמשך המשיב התפרע באולם בית המשפט, קילל בצורה בוטה את השופט ואיים עליו בנוסח "הגיעו אל רבין אגיע גם אליך. אני יודע איפה אתה מתפלל" (עמ' 33 לפרוטוקול הדיון מיום 9.1.2013), תקף את סוהרי הליווי, סירב לחקור נגדית את עדי התביעה ואף הודה בעובדות כתב האישום, אולם נוכח סערת הרגשות בה נאמרו הדברים בית המשפט סירב לקבל את ההודאה.
ביום 4.2.2013 מונתה למשיב סנגורית שלישית, והמשך ההוכחות נקבע ליום 9.4.2013. במהלך דיון זה ביקשה באת כוחו של המשיב להעיד בשנית את עדי התביעה, והבקשה התקבלה בהסכמת המבקשת. הדיונים הבאים התקיימו בימים 2.5.2013 ו-9.5.2013, כאשר בדיון האחרון נעתר בית המשפט לבקשת הצדדים למצות את הליך הגישור, וקבע תזכורת ליום 10.6.2013. ביום 23.6.2013 התקיים דיון בו ביקש המשיב להעיד מחדש עדי תביעה נוספים, המבקשת הסכימה לכך ובית המשפט קבע דיון הוכחות ליום 8.9.2013.

בא כוחו הנוכחי של המשיב טען באריכות כי בעקבות הוספה של שלושה עדי תביעה, המשפט התארך שלא בעטיו של המשיב, כי לשמיעתם של עדים אלה חשיבות מרובה, וכי הגיעה העת לשחרר את המשיב לחלופת מעצר.

הארכתי בתיאור השתלשלות הדברים בתיק העיקרי, על מנת שאוכל לקצר בהנמקה. העיכובים בניהול התיק נובעים בעיקר מסירובו של המשיב לשתף פעולה עם באי כוחו שהתחלפו חדשות לבקרים ומהתנהלותו הפרועה באולם בית המשפט. התיק קבוע להשלמת ראיות התביעה לתחילת חודש ספטמבר, כך שיש להניח כי המשפט יסתיים עוד בתקופת הארכה הנוכחית.
מסוכנותו של המשיב באה לידי ביטוי הן בנסיבות העבירה העיקרית המיוחסת לו, המלמדת על עיסוק בסחר בסמים, והן נוכח התנהגותו המלמדת כי אינו מסוגל לרסן את עצמו ואין עליו מורא המשטרה ואף לא מורא בית המשפט. לכל אלה יש להוסיף כי למשיב עבר פלילי הכולל עבירות של איומים, היזק לרכוש, החזקת סכין, הפרעה לשוטר, העלבת עובד ציבור, וניסיון סחר בסם, ואם לא די בכך, את העבירות המיוחסות לו ביצע בעוד תלויים ועומדים נגדו שני מאסרים על תנאי ברי הפעלה.

על רקע כל אלה, איני סבור כי יש בחלוף הזמן כדי לשנות את נקודת האיזון, ואני נעתר לבקשה ומורה על הארכת מעצרו של המשיב בתשעים ימים, החל מיום 10.7.2013 או עד למתן פסק דין בת"פ 25007-07-12 בבית המשפט המחוזי בבאר שבע, לפי המוקדם.
בשולי הדברים, אביע את תמיהתי על כך שלא נעשה דבר בנושא הקללות והאיומים שהטיח המשיב בבית משפט קמא, כמפורט בסעיף 3 לעיל.
