החלטה
העורר עומד לדין בפני בית משט השלום בירושלים, באשמת ביצוען של עבירות אחדות על פי פקודת הסמים המסוכנים. נטען, כי בשבעה מקרים בחודשים מרץ עד מאי 2010, מכר העורר סם מסוכן מסוג חשיש, במשקל כולל של כ- 420 גרם נטו, לסוכן משטרתי.
עם הגשתו של כתב האישום עתרה המשיבה למעצרו של העורר עד תום ההליכים, ובמהלך הדיון באותה בקשה לא חלק הסנגור על קיומן של ראיות לכאורה. עם זאת, הוא ביקש להורות על שחרור שולחו לקהילה טיפולית במטרה לגמול אותו מהתמכרותו לסמים. בית משפט השלום דחה את הבקשה והורה על מעצרו של העורר, וגם ערעור שהוגש לבית המשפט המחוזי, נדחה.
בערר שבפני חזר בא-כוח העורר על השקפתו, כי נוכח המלצתו של שרות המבחן, ומאחר והקהילה הטיפולית עשויה לשמש חלופת מעצר ראויה, נכון יהיה לאפשר לשולחו להשתלב באותה קהילה מאחר וכוונתו להיגמל הנה כנה.
אין בידי לקבל את הערר. העורר עסק, לכאורה, בסחר שיטתי בסם מסוכן, ונדמה שעל סכנתו של "עיסוק" זה אין צורך להכביר מלים. ככל שהיה ממש ברצונו של העורר להיגמל, מצאתי את עצמו תוהה מדוע הוא לא נקט בצעדים המתבקשים קודם לביצוען של העבירות, ופנה לכך רק לאחר מעשה. עם זאת, אינני מוכן לבטל את האפשרות שמעצרו של העורר גרם לו לרצות לשנות את אורחותיו, ברם, ככל שיתמיד בכך הוא יוכל לעשות זאת רק בתום ההליכים בעניינו, הואיל ונכון לעת הזו כרוך שחרורו, גם אם מדובר בקהילה טיפולית סגורה, בסכנה לצבור.
הערר נדחה.
