החלטה
ערר על החלטת בית המשפט המחוזי בירושלים (כב' השופט נ' סולברג ) מיום 13.7.11 במ"ת 11131-05-11 לפיה לא נעתר לבקשת העורר לאפשר לו לצאת לעבודה במסגרת חלופת מעצר.

כנגד העורר וארבעה אחרים הוגש כתב אישום הכולל מספר אישומים. אחד האישומים מייחס לעורר עבירה של סחר בסם מסוכן לפי סעיף 13 בצירוף סעיף 19א לפקודת הסמים המסוכנים [נוסח חדש], התשל"ג-1973. על פי המתואר בכתב האישום, ביום 3.4.11 נסע העורר ביחד עם קטין יליד 1993 לדימונה במטרה לרכוש שם סמים מסוג חשיש בעקבות תיאום מוקדם שנערך בין נאשם מס' 1 בכתב האישום לבין אדם אחר שזהותו לא ידועה. משהגיעו לדימונה עישנו העורר והקטין את החומר אולם בסופו של יום לא קנו אותו מהמוכר. בה בעת תיאם נאשם מס' 1 לעורר רכישה אחרת של סמים בבאר שבע. העורר נסע עם הקטין לבאר שבע, שם רכש מהמוכר 298.81 גרם חשיש ושילם לו במזומן 5,000 ש"ח.

בד בבד עם הגשת כתב האישום הוגשה בקשה למעצר העורר עד תום ההליכים. במסגרת הדיון שנערך ביום 30.5.11 הסכים בא כוחו של העורר לקיומן של ראיות לכאורה אולם נטען כי לא מתקיימת עילת מעצר של מסוכנות, והא-ראיה כי למחרת מעצרו שוחרר העורר לביתו ללא תנאים.
בתום הדיון הורה בית המשפט כי יינתן תסקיר מעצר בעניינו של העורר. תסקיר המעצר מיום 7.7.11 לא בא בהמלצה לחלופת מעצר. בתסקיר תואר בהרחבה הרקע האישי והמשפחתי של העורר, מעורבותו בעבירות סמים, וכי בשל עברו הפלילי העורר לא גוייס לצה"ל והוא מתקשה לנהל אורח חיים תקין. העורר לא מגלה מודעות למצבו המורכב וגם אמו של העורר וחברתו לחיים אינן מודעות למצבו. שירות המבחן גרס כי קיים סיכון גבוה להישנות התנהגות פוגעת אם העורר ישוחרר ללא תנאים מגבילים.

בהחלטה מושא הערר שבפניי עמד בית המשפט בהרחבה על הנאמר בתסקיר בציינו כי העורר הורשע בעבר, בין היתר, בעבירות של סחר בסמים ואלימות ונדון במצטבר ל-11 חודשי מאסר. בעת ביצוע המעשים המיוחסים לו ריצה העורר עונש של מאסר בעבודות שירות. עוד נאמר, כי אלמלא שוחרר העורר בשעתו מהמעצר משיקולי חקירה אף היתה הצדקה להורות על מעצרו עד תום ההליכים. ואולם, מאחר שמאז שחרורו העורר לא נתפס למעשי עבירה, הורה בית משפט
קמא על שחרורו של העורר למעצר בית באיזוק אלקטרוני אך נדחתה בקשתו לצאת לעבודה במהלך היום.
מכאן לערר שבפניי המתייחס לאיסור היציאה לעבודה.

לטענת העורר, שירות המבחן כלל לא נדרש לסוגיית היציאה לעבודה ולא בחן את מקום עבודתו המוצע ומעסיקו המוצע. העורר הפליג בחשיבות העבודה והמלאכה בחיי הפרט ואף הגיש לעיון בית המשפט מחקר אקדמי בנושא. לטענת העורר, יציאתו
לעבודה תסייע לו ולבת זוגו לנהל אורח חיים תקין ונורמטיבי. לכך יש להוסיף כי העורר היה משוחרר ללא פיקוח במשך כשלושה חודשים בהם לא ביצע כל עבירה, מה שמעיד על כוונתו לחזור למסלול חיים תקין ואף ליתן בו אמון.

דין הערר להידחות. הלכה היא כי בית משפט לא יורה בנקל להחזיר נאשם ששוחרר למעצר (ראו, לדוגמה, החלטתו של השופט פוגלמן בבש"פ 288/11 מדינת
ישראל נ' פלוני פסקה 6 והאסמכתאות שם (לא פורסם, 18.1.2011)). ואכן, בית משפט קמא היה ער לכך שהעורר היה משוחרר מיום 4.4.2011 ועד למתן החלטתו, ועל כן הורה על שחרורו של העורר לחלופת מעצר.
עם זאת, לא בשלה העת בשלב זה ליתן אמון בעורר כדי כך שיתאפשר לו לצאת לעבודה. ראשית, אציין כי תסקיר שירות המבחן בעניינו של העורר הוא שלילי למדי והשירות העריך כי קיים סיכון גבוה להישנות התנהגות פוגעת ולהישנות עבירות נוספות. העורר מוכר היטב לשירות המבחן עוד מימי בחרותו, וכפי שנאמר בתסקיר הוא הופנה לשירות המבחן 6 פעמים בין השנים 2005 – 2010. את העבירה הנוכחית ביצע העורר בעוד תלוי ועומד נגדו מאסר על תנאי ועודנו מבצע עבודות שירות, כאשר ביני לביני הוגשה בקשה להפקעת עבודות השירות. לכך יש להוסיף כי להיטותו של העורר לצאת לעבודה אף היא מוטלת בספק. העורר הציג אישור של מעסיק פוטנציאלי שבו נכתב כי העורר החל לעבוד אצלו מתאריך 1.7.2011. מתעורר הרושם כי אך לקראת הדיון שנקבע ליום 11.7.2011 מצא העורר לנכון להתחיל לעבוד, למרות שכאמור היה משוחרר ללא תנאים מתחילת חודש אפריל.

סופו של דבר שאני דוחה את הערר. אין בכך כדי למנוע מהעורר לחזור ולפנות בחלוף הזמן ועם שינוי הנסיבות בבקשה לעיון חוזר בתנאי מעצרו.
