החלטה
ערר על החלטת בית המשפט המחוזי בבאר שבע ( כב' השופטת ר' ברקאי ) אשר נעתר לערר שהגישה המדינה על החלטת בית משפט השלום באשקלון לשחרר את העורר לחלופת מעצר, והורה על מעצרו של העורר עד תום ההליכים נגדו.

נגד העורר ואדם נוסף (להלן: הנאשם הנוסף ) הוגש כתב אישום המייחס לשניים ביצוע עבירות של התפרצות לבנין מגורים לצורך ביצוע עבירה, לפי סעיף 406(ב) ל חוק העונשין, התשל"ז-1977 (להלן: החוק ), בצירוף עם סעיפים 25 ו-29 לחוק; עבירות של גניבה בצוותא חדא, לפי סעיפים 383, 384 ו-29 לחוק; וכן עבירה של ניסיון התפרצות כאמור; וזאת במספר הזדמנויות במהלך החודשים אפריל-מאי 2009. לנאשם הנוסף יוחסו גם עבירה של הונאה בכרטיס חיוב, לפי סעיף 17(1) ל חוק כרטיסי חיוב, התשמ"ו-1986, ועבירה של החזקת כלי פריצה, לפי סעיף 409 לחוק.

עם הגשת כתב האישום, עתרה המדינה למעצרם של העורר והנאשם הנוסף עד לתום ההליכים נגדם. בית משפט השלום באשקלון ( כב' השופטת ס' כהן ) הורה בתחילה על שחרור העורר לחלופת מעצר בפיקוח לסירוגין של אשתו ושל אמו, ואולם ערר שהגישה המדינה על החלטה זו התקבל, ובית המשפט המחוזי ( כב' השופטת ר' יפה-כץ ) הורה על מעצרו של העורר עד לאחר שיוגש לבית משפט השלום תסקיר מעצר בעניינו מטעם שירות המבחן.

מתסקיר מעצר מיום 11.6.09 עולה כי העורר היה מעורב עוד בהיותו נער בחברה שולית, והסתבך בפלילים, ומגלה קושי בקבלת גבולות ומרות. העורר היה בפיקוח שירות המבחן עוד בשנת 2008 עקב ביצוע עבירות קודמות, אולם קשר זה התאפיין בחוסר שיתוף פעולה מצדו. בצד מעורבותו בפלילים, הוא צורך אלכוהול וסמים, ולא נמצא בשל להליך טיפולי. שירות המבחן בתסקירו שלל התאמת חלופת מעצר לעורר בפיקוח אשתו ואמו. הוא המליץ שלא לשחררו מהמעצר, ומנה את הטעמים לכך – כשלון בניסיון טיפולי קודם, מעורבותו באישומים הנוכחיים בעת שהיה נתון במעצר בית לילי בגין הליך קודם, חומרת עבירות הרכוש המיוחסות לו עתה, וביצוען כשעונש מאסר על-תנאי תלוי נגדו מלפני תקופה קצרה. כן צויינו העדר האפקט ההרתעתי להליכים המשפטיים המתנהלים נגדו, והתמכרותו לסמים ולאלכוהול. שירות המבחן ציין עוד, כי לעורר דפוסי חשיבה והתנהגות עברייניים, ובשלב זה הוא חסר בשלות נדרשת לצורך השתלבות בהליך גמילה, וכי קיים סיכוי גבוה להישנות התנהגות עבריינית מצדו שחלופת מעצר לא תמנע.

לאחר הגשת התסקיר, קיים בית משפט השלום דיון נוסף בבקשת המעצר, ובסיומו הורה בשנית על שחרורו של העורר למעצר בית מלא בפיקוח אשתו ואמו, ובתוספת איזוק אלקטרוני. בית המשפט ציין, בשונה משירות המבחן, כי התרשם שהערבות תוכלנה לפקח על העורר ולהציב לו גבולות, וכי המסוכנות המשתקפת מהתנהגותו של העורר, כפי שהיא עולה מהתסקיר, תוכל למצוא את פתרונה בדרך של הוספת תנאי של איזוק אלקטרוני. לפיכך, הורה בית המשפט על שחרורו של העורר לחלופת מעצר בבית הוריו באשדוד, בפיקוח מתמיד של אחת הערבות וכן איזוק אלקטרוני, ובכפוף לתנאים כספיים נוספים.

המדינה עררה לבית המשפט המחוזי על החלטה זו, וערר זה נתקבל והביא למעצרו של העורר עד תום ההליכים נגדו. בית המשפט המחוזי ציין בהחלטתו כי מתסקיר שירות המבחן עולה כי מ דובר
באדם המכור לסמים מסוכנים וצורך אלכוהול באופן קבוע, וכי התמכרויות אלו דרדרו אותו לעבירות הרכוש שבהן נמצא מעורב בשנים האחרונות. שירות המבחן נמנע מלהמליץ על שחרורו של העורר – הן למרכז גמילה, בשל קשייו להשתלב בתהליך גמילה, והן לביתו, נוכח מסוכנותו שאינה נענית גם בהתקיים חלופה. לדברי בית המשפט, קשה לקבל את מסקנת בית משפט השלום לפיה, הגם שהוא מסכים עם מסקנת שירות המבחן באשר ליחס שמבטאים הערבים כלפי העורר, המתאפיין בגישה "קרבנית" כלפיו, החליט בכל זאת כי יהיה בידם להציב בפניו גבולות אם ישוחרר לביתם. בעניין זה, קבע בית המשפט כי עיון בתסקיר המעצר ובעברו הפלילי (בין השאר בעבירות של סמים, רכוש, הפרת הוראה חוקית והפרות צווים חוקיים), מעלה כי התמכרותו של העורר לסמים ולאלכוהול חזקה מיכולותיו, וקיים חשש כי יפעל לספק את התמכרותו בדרכים עברייניות. דבר זה מעלה ספק באשר ליכולתן של הערבות, על אף רצונן האמיתי להשגיח ולפקח על העורר, לעמוד במשימתן. לאור האמור, ונוכח תסקיר שירות המבחן, קבע בית המשפט המחוזי כי שגה בית משפט השלום עת הורה על שחרורו של העורר, וקבע כי יש לעוצרו עד תום ההליכים. לצד זאת, ציין בית המשפט, כי יש לחזור ולבחון את האפשרות לשלב את העורר במסגרת גמילה מסמים, וקבע כי שירות המבחן יבחן עבור העורר חלופת מעצר בדמות שילובו במרכז סגור לגמילה כאמור.
על החלטה זו הוגש הערר שלפני.

לטענת העורר, שגה בית המשפט המחוזי בהחליטו להעדיף את עמדת שירות המבחן על פני עמדת בית משפט השלום. לדבריו, בית משפט השלום התרשם באופן בלתי אמצעי מן הערבים שהוצעו, ולא היתה הצדקה לחרוג מן הכלל לפיו התערבות בשיקול-דעת הערכאה הקודמת בנוגע להתאמת חלופת מעצר קונקרטית תיעשה רק במקרים חריגים. כן נטען, כי בית המשפט שגה בכך שלא נתן דעתו להחלטת בית משפט השלום להוסיף איזוק אלקטרוני ליתר התנאים שנקבעו, ובכך שלא ייחס חשיבות לעובדה כי הנאשם הנוסף, שהיווה גורם מרכזי בפרשה, ומואשם אף בעבירות נוספות, שוחרר למוסד גמילה פרטי בתנאי מעצר בית. לסיכום נטען, כי יש בכוחה של חלופת המעצר, שנקבעה על-ידי בית משפט השלום, בצירוף האיזוק האלקטרוני ויתר התנאים שנקבעו, כדי לאיין את מסוכנותו הלכאורית של העורר, ולכן, יש להורות על שחרורו בתנאים שנקבעו על-ידי בית משפט השלום.

המדינה מתנגדת לקבלת הערר ועומדת על אימוץ החלטת בית המשפט המחוזי ודחייתו של הערר. היא מדגישה את תסקיר המבחן השלילי גם בהיבט חלופת המעצר, וגם בהיבט תיאור מאפייני האישיות של העורר, שנלווית להם התמכרות לחומרים ממכרים. הסיכון בשחרור אינו מתיר החלת חלופה במקרה זה, ולפיכך יש לדחות את הערר, כך לטענת המדינה.

דין הערר להידחות.
האישומים כנגד העורר, נשוא הליך מעצר זה, הם חמורים כל אחד כשלעצמו, ובודאי בהצטברותם. העורר מואשם בארבעה אירועי פריצה לבתי מגורים וגניבה מתוכם, ובמקרה חמישי בניסיון פריצה שלא בשל לעבירה מושלמת. חומרת עבירות אלה מתחזקת לאור עברו הפלילי של העורר, בין היתר, בעבירות סמים ורכוש, ולרבות הפרת הוראות חוקיות. כן יש לציין כי העבירות נשוא ההליך הנוכחי בוצעו כאשר מאסר על-תנאי תלוי על צווארו של העורר.
מעבר לכל אלה, מתסקיר שירות המבחן עולה כי העורר מכור לסמים ולאלכוהול, וכי היה נתון בעבר לניסיונות טיפוליים שכשלו. ריבוי העבירות המיוחסות לו, כאשר מאסר על-תנאי תלוי על צווארו, מצביע על כך שלהליכים המשפטיים אין אפקט הרתעתי ממשי עליו; יתר על כן, שירות המבחן מסר תסקיר שלילי ביותר ביחס לעורר, באומרו, בין היתר, כי קיים סיכוי גבוה להישנות התנהגות עבריינית מצדו, שגם חלופת מעצר לא תמנע, וכי לעורר דפוסי התנהגות וחשיבה עברייניים מצדו, והוא אינו מגלה נכונות ויכולת להשתלב בהליך גמילה נכון לעת זו.
מכלול נסיבות אלה מצביעות, בבחינת "כתובת על הקיר", כי אין זה מקרה לשחרור ממעצר עד תום ההליכים. הצטברות הנתונים ומשקלם מצביעים על אי התאמת חלופה כלשהי במקרה קשה זה. אודה, כי התקשיתי להבין את החלטותיו של בית משפט השלום, אשר החליט באופן עקבי על שחרור העורר בחלופה, גם לאחר שקיבל תסקיר מעצר מעמיק, השולל מכל וכל אפשרות שחרור מהצטברות טעמים כבדי משקל.
יש לדחות, אפוא, את הערר, ולקיים את החלטת בית המשפט המחוזי, אשר קבע כי יש להחזיק את העורר במעצר עד תום ההליכים נגדו.
