נגד המשיב (ונגד שני נאשמים נוספים) הוגש כתב אישום המייחס לו עבירות יבוא סם מסוכן, עבירה לפי סעיף 13 וסעיף 19א לפקודת הסמים המסוכנים (נוסח חדש), תשל"ג-1973; החזקת סם שלא לצריכה עצמית בלבד, עבירה לפי סעיף 7(א) וס"ק (ג) רישא לפקודה; הסתייעות ברכב לשם ביצוע פשע, עבירה לפי סעיף 43 לפקודת התעבורה (נוסח חדש), תשכ"א-1961; קשירת קשר לביצוע פשע, עבירה לפי סעיף 499(א)(1) לחוק העונשין, תשל"ז-1977; שיבוש מהלכי משפט, עבירה לפי סעיף 244 לחוק; הפרעה לשוטר במילוי תפקיד, עבירה לפי סעיף 275 לחוק; החזקת סכין, עבירה לפי סעיף 186(א) לחוק.

להלן בקצרה עובדות המקרה כנטען בכתב האישום. בתאריך 19.11.09 בסמוך לשעה 17:00 הגיע נאשם נוסף בתיק (העצור עד תום ההליכים ומעצרו הוארך בהסכמה) לגדר הגבול בין ישראל ללבנון. מעברה הלבנוני של הגדר הושלכו לעברו 29 חבילות המכילות סם מסוכן מסוג הרואין במשקל כולל של כ- 14.5 ק"ג . בה בעת המתינו המשיב ואדם אחר (נאשם שלישי, ששוחרר בערובה) ברכב סמוך למטולה על מנת לאספו, תוך שהם מתאמים ביניהם את הפעולה בטלפון הנייד שברשותם. משקרב הנאשם הנוסף למטולה החל חופר בור מתחת לגדר המקיפה את הישוב - עד שנעצר על ידי כוחות המשטרה שהגיעו למקום. במקביל למעצר זה, הוקם מחסום משטרתי על מנת ללכוד את המשיב ואת מי שהיה עימו. משהגיע המשיב למחסום נעצר. המשיב התנגד למעצרו ואף השליך את הטלפון הנייד שברשותו; בחיפוש על גופו נמצא סכין.

ביום 9.12.09 החליט בית המשפט המחוזי בנצרת (סגן הנשיא כתילי) בהסכמת המשיב על מעצרו עד תום ההליכים נגדו, תוך שנשמרה זכותו לבקש עיון חוזר בהחלטה.
ה.
במשפטו של המשיב נערכו עד כה שלוש ישיבות הוכחות, שבמהלכן נשמעו שלושה-עשר עדים. ההליך קבוע להמשך שמיעת ההוכחות בשלוש ישיבות במהלך החודשים ספטמבר ואוקטובר השנה.
הבקשה והדיון

המדינה עותרת, כאמור, להארכת מעצר המשיב. בבקשה נטען, כי המעשים המיוחסים למשיב מגלמים מסוכנות רבה, המתחדדת נוכח הרשעה קודמת – בעבירת איומים. עוד נטען, כי ישנו חשש להימלטותו של העורר מאימת הדין. לבסוף נטען, כי המשפט מתנהל בקצב סביר, וכי העיכובים עד הנה נבעו כתוצאה מבקשות ההגנה ומאילוצים בלתי צפויים.

בדיון טענה עו"ד חינאווי למדינה בנוסף, כי שלוש הישיבות הקבועות יספיקו לסיום פרשת התביעה. עוד נאמר, כי יש שוני בין המשיב לנאשם ששוחרר לחלופה בקשר למצב הראייתי.
ח.
עו"ד לירון טענה למשיב, כי השיהוי הבסיסי נבע מהכנת תעודות החיסיון; המשיב דומה במעשיו לנאשם ששוחרר, וגילו צעיר; הוא עומד על חפותו, וחלוף הזמן מורה לכיוון תסקיר ושחרור, כפי שנעשה גם במקרים של סמים קשים בכמות גדולה בעבר.
הכרעה

לאחר העיון סבורני כי יש להיעתר לבקשה. המדובר בכמות גדולה ביותר של הרואין, שהחזקה הסטטוטורית שבדין מתעצמת לגביה, שכן טמונה בה
על פניה השחתת רבים מאוד. התנהגות המשיב בעת מעצרו (וגם עברו, אם כי עניין זה לא פורט) מוסיפים למסוכנות. כשהמדובר בכמות כזו ובקשר לייבא מלבנון את הסם, אין להוציא מכלל אפשרות ניסיון הימלטות.

אשר לניהול המשפט, שכבר התקדם בפרשת התביעה, הדעת נותנת כי בית המשפט המחוזי יתן דעתו לתוספת מועדים עוד בהארכה הנוכחית, כדי לנסות להביא את המשפט לידי סיום; והצדדים מתבקשים להפנות תשומת לבו לכך, נוכח מצוות המחוקק. בנתון לזאת מוארך המעצר כמבוקש ב-90 יום מ-29.8.10 או עד למתן פסק דין בתיק, לפי המוקדם.
