כנגד העורר הוגש כתב אישום לבית המשפט המחוזי. לפי האמור בכתב האישום, בעת שהעורר שימש שמרטף לנכדתו בת ה-5 בעת היותה חולה, הוא נישקהּ על ידי שתחב את לשונו אל פיה, הפשיל את מכנסיה ותחתוניה ואת מכנסיו ותחתוניו שלו, כשהוא חושף את איבר מינו ומשפשף אותו בפניה ובאיבר מינה. בגין מעשים אלה הואשם העורר בעבירה של מעשים מגונים בבת משפחה.

ליבו של חומר הראיות כנגד העורר הוא עדותה של הילדה בפני חוקרת ילדים. עדות זו נערכה לאחר שהילדה סיפרה להוריה על הפרשה בחלוף כשלושה חודשים מאז הארוע. השיחה בין הילדה לאביה הוקלטה. חוקרת הילדים התקשתה לקבוע את רמת מהימנותה של הילדה, הואיל והיא מסרה מידע רק לאחר שנשאלה שאלות מדריכות. בהחלטה מיום 12.7.10 מצא בית המשפט המחוזי, כי מכלול הנתונים מקים ראיות לכאורה לאשמתו של העורר. אולם נוכח נקודות חולשה מסוימות בראיות, שוחרר העורר בחלופת מעצר בית ותנאים מגבילים נוספים. בהחלטה נוספת, התיר בית המשפט המחוזי לעורר להעתיק את מקום מעצר הבית מבית אחיו לבית אחותו.

העורר ביקש להעביר את מיקומו של מעצר הבית אל ביתו שלו, בפיקוח אשתו וילדיו. ביום 9.8.10 נערך בעניינו של העורר תסקיר מעצר. שירות המבחן התקשה להעריך את רמת מסוכנותו של העורר, המכחיש מכל וכל את המיוחס לו. לעומת זאת, השירות התרשם לחיוב מיכולתם של המפקחים המוצעים להפחית את רמת הסיכון הנשקף מן העורר במסגרת חלופת המעצר המוצעת. ביום 16.8.10 החליט בית המשפט המחוזי, כי אין מקום להעביר את מעצר הבית אל ביתו של העורר, לנוכח קירבת המקום לביתה של נכדתו. עם זאת, בית המשפט התיר לעורר להעתיק את חלופת המעצר לדירה שכורה, בכפוף להתחייבויות שיפקידו ארבעה מפקחים. העורר שוהה עתה בדירה זו.

בערר שלפני מלין העורר הן על ההחלטה שלפיה קיימות ראיות לכאורה לאשמתו, והן על ההחלטה שלפיה מעצר הבית לא יועבר אל ביתו שלו. לגבי חומר הראיות נטען, כי בית המשפט המחוזי לא נתן משקל מספיק לתקופה של כשלושה חודשים שחלפה ממועד האירועים נשוא כתב האישום ועד הגשת התלונה. עוד נטען, כי המשטרה נמנעה מלבצע פעולות חקירה שונות, כגון עריכת עימות בין העורר לבין נכדתו, וחקירת בני משפחה נוספים. העורר טוען, כי התלונה נגדו הוגשה על רקע סכסוך כספי בינו לבין בנו וכלתו, הורי הילדה, וכי עדותה של הילדה "זוהמה" על ידי דברים שאמרה לה אמה. בסוגיית מיקומה של חלופת המעצר נאמר, כי הורי הילדה אינם מתנגדים לכך שהעורר ישוב להתגורר בביתו; וכי העורר, בן 68, סובל מבעיות בריאותיות שונות, ועברו נקי. כאמור, עתה הוא שוהה בדירה שכורה עם המפקחים שאושרו לצורך חלופת המעצר.

המדינה טוענת, ראשית, כי יש ראיות לכאורה מספיקות לצורך הליך המעצר. לעמדתה, חוקרת הילדים לא קבעה כי הילדה משקרת, אלא קבעה כי היא מתקשה לקבוע ממצאי מהימנות, ויש הבדל לענין זה. הפרשה נחשפה על ידי הילדה, והאב הקליט אותה מתייחסת לכך, וגם תופעות שונות בהתנהגות הילדה מחזקות את ההתרשמות כי עברה ארוע טראומטי, ובהן חזרתה להרטיב במטתה.
אשר למקום חלופת המעצר, טוענת המדינה כי אין מקום להתיר את חזרתו של העורר לביתו בשלב זה. הבית נמצא בקרבה גיאוגרפית גדולה לבית הילדה, ומשפחת הילדה כולה מצויה עתה בטיפול פסיכוטרפיסטי. לחזרת העורר לביתו עלולה להיות השפעה לא חיובית על שלומה הנפשי של הילדה. על פי תסקיר המעצר נשקף סיכון מהעורר לגבי קטינות, וגם המלצת שירות המבחן היא שלא יחזור לביתו אלא ישהה במקום נייטרלי מרוחק מבית משפחת הקטינה.

הילדה ספרה לאימה כשלושה חודשים לאחר הארועים את פרטי המעשים, ובעקבות זאת, האם התלוננה במשטרה. יום לאחר שהילדה חשפה את הארועים, הקליט האב שיחה עימה באמבטיה, בעת שקילח אותה, והיא מסרה גרסה דומה. הילדה מספרת בתמימות על פרטי המקרה, ואף אומרת בכנות שלא כאב לה, ושהוא לא הכניס משהו בפנים, וכי אף אחד, חוץ מסבא שהציק לה, לא עשה לה קודם דבר כזה. הילדה התקשתה לשתף פעולה בחקירה עם חוקרת הנוער, ועברה תהליך נפשי קשה עד שנפתחה והחלה לספר ולתאר את הארועים. חוקרת הילדים התרשמה שהילדה מתקשה מאד להיפתח מבחינה רגשית, והיא נמנעה מקביעה נחרצת בענין מהימנותה, בנימוק כי הילדה מסרה מידע רק בעקבות תשאול מנחה.
בית משפט קמא (כב' השופטת ח' כוחן) ציין כי עדות הילדה היא כמובן העדות הראשית בתיק, והיה מודע לקושי הראייתי עקב חוסר יכולתה של חוקרת הילדים לקבוע מסקנה פסקנית בדבר מהימנות הילדה. עם זאת, בית משפט קמא התרשם מהראיות כי מ דובר במסירת גרסה כנה ותמימה, המלווה בקשיים רגשיים, הנושאת עימה סימני אמת. הסיוע לעדות הילדה בא בדמות השיחה המוקלטת בין הילדה לבין אביה.

אני שותפה למסקנת בית משפט קמא כי קיימות בשלב זה ראיות לכאורה להרשעתו של העורר בעבירות המיוחסות לו. אמנם נכון הוא כי חוקרת הילדים לא קבעה מסמרות בענין אמינותה של הילדה. מצד שני, בראייה אובייקטיבית של הארועים, קשה לשער כי ילדה בת חמש בודה מלבה סיפור התעללות מינית על ידי אדם קרוב כסב, וכוללת בו פרטים שונים שילדה בגיל כזה אינה מודעת להם אלמלא חוותה אותם על בשרה. מנגד, היא אינה כוללת בגרסתה פרטים שהיו עלולים להחמיר פי כמה את טיב המעשים ואשר אילו הונחתה על ידי מאן דהוא, היתה עשויה לאומרם. חשיפת פרטי מעשי המין בידי ילד רך בשנים שאינו מכיר ואינו יודע את הוויות ההתנהגות המינית מביאה עימה, על פני הדברים, מטען ממשי של אמינות. קשה גם להניח כי תתכן אפשרות שהורי הילדה שמו בפיה את סיפור המעשה, והשתמשו בכך בבתם הרכה בשנים כנשק כלפי הסב לצורך התעמרות בו בסכסוך שזכרו לא בא לעולם. קשה גם להניח שההורים ביוזמתם היו משתמשים בילדתם בדרך זו ומעמידים אותה בהליך חקירה של חוקרת ילדים על כל הכרוך בכך. אפשרות כזו היא דמיונית, אינה נטועה באפשרות אמיתית במציאות, ואין כל רמז בנתונים שלפנינו להסתברות קיומה של אפשרות כזו. דוקא השתלשלות חקירתה של הילדה בפני חוקרת הנוער, שהתקשתה לדובב את הילדה, מבוכתה וקשייה הרגשיים של הילדה שאינה נפתחת בנקל לספר את קורותיה בשל בושה ובשל הקשר שיש לה לסבה – כל אלה מוסיפים משקל ומטען לאמינות דבריה, שאלמלא ארעו, לא היתה יודעת לספר אודותם. דבריה של הילדה בקלטת שהקליט האב מחזקים ומאששים את גרסתה. העובדה בדבר חזרתה להרטיב במטתה מחזקת אף היא את גרסתה. מתסקיר שירות המבחן אף עולה כי הילדה נמצאת בטיפול פסיכוטרפיסטי עם יתר בני משפחתה.
בעיני, יש ראיות לכאורה בהליך זה, ויש להניח כי בית המשפט בדונו באישום לגופו יעריך את הראיות על רקע מלוא הנסיבות והנתונים האובייקטיביים כפי שיעלו מלפניו, וחקירתה של חוקרת הילדים בודאי תוסיף אף היא הבהרות והארות למידת האמינות והמשקל של גרסת הילדה.

אשר לחלופת המעצר: המדינה לא עררה על שחרורו של העורר בחלופת מעצר. עם זאת, היא מתנגדת לחזרתו לביתו ולהפיכת ביתו למקום חלופת מעצר.
בצדק קבע בית משפט קמא (כב' השופטת י' אמסטרדם) כי אין מקום לאפשר בשלב זה את קיום חלופת המעצר בבית העורר. עם זאת, בית המשפט אישר את חלופת המעצר בדירה השכורה בפיקוח אחד מארבעה מפקחים שאושרו לצורך כך.
חזרתו של העורר לביתו עלולה לרופף באופן ממשי את הפיקוח האפקטיבי הנדרש ביחס למהלכיו. עלולה אף להיווצר סכנה של שיבוש הליכי משפט, המחריפה לאור סמיכות מקום החלופה לבית משפחת הנפגעת. שירות המבחן בתסקירו אף אינו שולל סיכון להתנהגות מינית פוגעת נוספת בקטינות, וקובע כי דרושה חלופת מעצר שבה יימצא העורר תחת פיקוח ולא ישהה בנוכחות קטינים ללא השגחה של בוגר אחראי. התסקיר מציין כי חזרתו של העורר לבית עלולה גם להעביר לילדה מסר מבלבל ולא ברור לגבי משמעות הפגיעה בה, וקשה להעריך את השלכת הדבר על מצבה הנפשי.
בנסיבות אלה, אינני רואה מקום להתערב בהחלטת בית משפט קמא ביחס למקום החלופה, והיא תיוותר בעינה כפי שנקבע בהחלטה נשוא הערר.
הערר נדחה.
