החלטה
ערר על החלטת בית המשפט המחוזי באשר שבע (כב' השופטת ר. רז לוי) מיום 27.12.09, בגדרה נדחה ערר על החלטת בית משפט
השלום (כב' השופט י. אקסלרד) מיום 25.8.09 ועל החלטת בית משפט השלום (כב' השופטת א. חדד) מיום 25.11.09.

אומר בקצרה כי איני רואה ממש בערר שלפני, המבוסס על הקונסטרוקציה הבאה:
החלטת בית המשפט לענייני משפחה מיום 30.11.08 אינה תקפה.
לכן העורר לא הפר צו בתוקף.
לכן כתב האישום שהוגש כנגד העורר בגין הפרה זו דינו להתבטל.
לכן לא היה מקום מלכתחילה להטיל על העורר מגבלות כאמור בהחלטתו של כבוד השופט אקסלרד מיום 25.8.09.
לכן הפרת החלטתו של כב' השופט אקסלרד אינה בגדר הפרת הוראה חוקית.

כל הקונסטרוקציה דלעיל מבוססת על ההנחה המוטעית כי פקע תוקפו של הצו שניתן על ידי בית המשפט
לענייני משפחה. ולא היא.
ההחלטה שניתנה ב בית המשפט לענייני משפחה בהסכמתו של המשיב, אסרה על הצדדים הדדית להימנע מליצור כל קשר האחד עם השני, במישרין או בעקיפין. ההחלטה לא ניתנה במסגרת החוק למניעת אלימות במשפחה, התשנ"א-1991 וגם לא במסגרת החוק למניעת הטרדה מאיימת, התשס"ב-2001, כך שתוקפה לא הוגבל בזמן.
למעלה מן הצורך אציין כי אם היה לעורר ספק לגבי תוקפו של הצו הרי שלא רשאי היה לעשות דין לעצמו ולהפר את החלטת בית המשפט לעניייני משפחה, ולאחר מכן להפר את הצווים שניתנו כנגדו בעקבות הגשת כתב האישום בגין הפרת אותה החלטה.
אשר על כן, אני דוחה את הערר.
