החלטה
בפניי ערר על החלטת בית המשפט המחוזי בתל-אביב-יפו (כבוד סגן הנשיא ז' המר) בתיק ב"ש 91292/08 מיום 30.7.2008, לפיה הוחלט על מעצרו של העורר עד תום ההליכים המשפטיים המתנהלים נגדו.
כנגד העורר, הוגש לבית המשפט המחוזי בתל-אביב-יפו כתב אישום, המייחס לו עבירה של החזקה ושימוש סם מסוכן שלא לצריכה עצמית, לפי סעיפים 7(א) ו-(ג) רישא לפקודת הסמים המסוכנים (נוסח חדש), התשל"ג-1973 (פ 40148/08).
לפי הנטען בכתב האישום, העורר החזיק ברשותו שלא כדין סמים מסוכנים מסוג הרואין במשקל נטו כולל של 95.3 גרם המחולקים ל-109 מנות.
בד בבד עם הגשת כתב האישום, הוגשה לבית המשפט המחוזי בקשה למעצרו של העורר עד תום ההליכים המשפטיים המתנהלים נגדו (ב"ש 91292/08).
ביום 30.7.2008 קיבל בית המשפט (כבוד סגן הנשיא ז' המר ) את הבקשה והורה על מעצרו של העורר עד תום ההליכים המשפטיים נגדו. בית המשפט ציין בהחלטתו כי בא כוח העורר הסכים לקיומן של ראיות לכאורה ולקיומה של עילה למעצר בעניינו של העורר. בית המשפט קבע כי שחרור לחלופת מעצר בעבירות של סחר בסמים צריך להיעשות במקרים חריגים ביותר, ולא כך הוא עניינו של העורר. עוד ציין בית המשפט כי לא ניתן לתת אמון במפקחים המוצעים לפקח עליו לאור המצג השקרי אותו הציגו לפיו אין לאיש מהם כל מעורבות בפלילים או בסמים.
מכאן הערר שבפניי.
לטענת העורר, טעה בית המשפט המחוזי בכך שלא קיבל את המלצת שירות המבחן לשחררו למעצר בית. לטענתו, יש בחלופה שהוצעה ואשר נתקבלה על ידי שירות המבחן כדי לאיין את מסוכנותו. עוד לטענתו, שגה בית המשפט בכך שייחס חשיבות מרחיקת לכת לכך שבעברו של אחד המפקחים המוצעים הרשעה בעבירת סמים, אשר התבצעה לפני חמש עשרה שנים.
מנגד, טוענת המשיבה כי אין בחלופת המעצר שהוצעה על ידי העורר כדי לאיין את המסוכנות הנשקפת ממנו, לאור החשש המובנה בעבירות סמים שמא ימשיך הנאשם לבצען גם בהיותו במעצר בית.
לאחר ששמעתי את טיעוני הצדדים ולאחר שעיינתי בהודעת הערר ובהחלטתו של בית המשפט המחוזי, הגעתי לכלל מסקנה, כי דין הערר להדחות.
בית המשפט המחוזי בחן את האפשרות לשחרר את העורר לחלופת מעצר אך הגיע למסקנה שאין בחלופה כזו בכדי להפיג את המסוכנות הנשקפת ממנו, וזאת בניגוד להמלצתו של שירות המבחן. יש לזכור כי תסקיר שירות המבחן הינו בגדר המלצה בלבד, אשר מטרתה לסייע לשופט לבחון את החלופה המוצעת (ראו, למשל, רע"פ 843/07 אבו גאנם נ' מדינת ישראל (לא
פורסם 25.2.2007)). בענייננו יש לציין גם כי בפני בית המשפט הוצג מצג שווא לפיו איש מהמפקחים המוצעים לא היה מעורב בעברו בעבירות סמים. מצטרף אני לעמדתו של בית המשפט המחוזי, לפיה הגם שאין בעבירה בה הורשע המפקח בעבר, כשלעצמה, כדי לפגוע באמון שניתן לייחס לו, הרי שלא כך הוא לגבי בחירתו להטעות בעניין זה את בית המשפט.
לנוכח האמור, ולנוכח המסוכנות הסטטוטורית העולה הטבועה בכל המעורב בסחר מסחרי בסמים מסוכנים, שותף אני למסקנתו של בית המשפט המחוזי לפיה לא ניתן לשחרר את העורר לחלופה שהוצעה.
אשר על כן, הערר נדחה.
