החלטה

עיון במערכת "נט המשפט" מלמד, כי הדיון בהליך החל, וכי נערכה הקראה בתיק (פרוטוקול דיון מיום 4.7.2011). משכך, נדרשת הסכמת השופט הדן בהליך לשם העברת הדיון לבית משפט אחר (בהתאם לסעיף 78(א) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984).

בנסיבות אלו, הנני מורה למאשימה לפנות לבית המשפט הדן בהליך ולבקש את עמדתו בקשר להעברת מקום הדיון, בצירוף החלטתי זו. המאשימה תגיש לבית משפט זה את עמדת בית המשפט הדן בהליך, תוך ארבעה ימים מיום המצאתה אליה. למותר לציין כי אין בהחלטה זו כדי לגרוע משיקול הדעת המסור לבית המשפט הדן בהליך אם ליתן את הסכמתו בעניין זה. משתוגש עמדתה של הערכאה הדיונית יימשך הטיפול בבקשה.
