החלטה
בפני עתירה לגילוי ראיה חסויה על פי סעיף 44 לפקודת הראיות [נוסח חדש], תשל"א-1971 (להלן: פקודת הראיות ).

העותרים עומדים לדין בבית המשפט המחוזי בחיפה (ת"פ 7072/08) בעבירה של החזקת סם מסוכן שלא כדין ושלא לצריכה עצמית. על פי המתואר בכתב האישום, ביום 25.3.2008, סמוך לשעה 06:00, הגיעו העותרים סמוך מאוד אל גדר הגבול עם לבנון ולקחו מן המקום שני תיקי גב ובהם 60 אריזות שהכילו סם מסוכן מסוג הרואין בכמות כוללת של 30 ק"ג ו- 55.03 גרם נטו (להלן: הסמים ). סמוך לשעה 06:40 נעצרו השניים על-ידי שוטרים בסמוך לבסיס בירנית, כשהם נושאים על גבם את התיקים ובהם הסמים.

ביום
17.6.2008 הוצאה בעניינם של העותרים תעודת חיסיון לפי סעיף 44 לפקודת הראיות (אחת מתוך שלוש תעודות שהוצאו). בהתאם לאמור בתעודה הוטל חסיון על מסירת ראיות מטעמים של ביטחון המדינה בנושאים הבאים: שמותיהם של בסיסי צה"ל ושל מוצבי צה"ל, העשויים להצביע על מקום הימצאם; פריסת תצפיות של צה"ל בשטח ומקום הימצאן, שיטות סריקה ודרכי פעולה של תצפיות צה"ל, אמצעי התצפית בהם נעשה שימוש, כולל שמם, כינויים וטווח התצפית שלהם; מספרי יחידות בצה"ל ופעילותן וכל פרט שיש בו כדי לחשפם, וכן כל פרט, מעבר לשם הפרטי ולשם המשפחה, שיש בו כדי לחשוף את זהותם של חיילי צה"ל שמסרו עדויות בהליך זה.

בתחילה פנו העותרים אל בית המשפט המחוזי בחיפה (כב' השופטת ת' שרון-נתנאל) בבקשה לגילוי חומר ראיות בהתאם לסעיף 74 לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב-1982 (להלן: חוק סדר הדין הפלילי ) ביחס לקלטת שנמסרה להם לאחר שנמחקו בה קטעים שונים בהסתמך על תעודת החסיון וטענו כי משלא נכללה הקלטת בחומר החסוי שפורט בתעודת החסיון לא ניתן למחוק ממנה קטעים בעותק הנמסר להגנה. בהחלטתו מיום 25.8.2008 דחה בית המשפט את המחוזי את הבקשה בקובעו כי די שתעודת חסיון תפרט את העניינים החסויים ואין צורך שתתייחס במפורש ובאופן ספציפי לכל מסמך ומסמך המצוי בחומר הראיות. בית המשפט הוסיף וקבע כי נוכח סעיף 78 לחוק סדר הדין הפלילי, המוציא מגדר חומר חקירה שהנאשם רשאי לעיין בו חומר שהוצאה לגביו תעודת חסיון, על נאשם החפץ לעיין בחומר החסוי לעתור בעניין זה לגילוי ראייה לפי סעיף 46 לפקודת הראיות. ערר שהגישו העותרים על החלטת בית המשפט המחוזי נדחה בהחלטת כב' השופט ס' ג'ובראן מיום 14.9.2008 (בש"פ 7468/08) בה נקבע כי אף שקלטת הווידאו עליה נסוב הערר אינה נזכרת בתעודת החסיון באופן מפורש, ברי שקלטת זו צולמה מתצפית של צה"ל בגבול הלבנון והיא נופלת על כן בגדר חסיון "שיטות סריקה ודרכי פעולה של תצפיות צה"ל" המנוי בתעודת החיסיון. האכסניה המתאימה לבקשת העותרים בעניין גילוי הקלטת במלואה, כך הוסיף בית המשפט וקבע, היא על כן בעתירה לגילוי ראיה לפי סעיף 46 לפקודת הראיות ואין מקומה בבקשה לפי סעיף 74(ב) לחוק סדר הדין הפלילי.

בעתירה שהגישו העותרים בעקבות אותה החלטה הם מלינים על כך שהקלטת המצונזרת שנמסרה לידיהם מכילה דקה וחצי של צילומים בלבד מתוך קלטת של למעלה מחמש דקות צילום. העותרים שבים וטוענים כי תעודת החסיון מיום 17.6.2008 אינה מחסה את הקלטת משום שזו אינה נזכרת בה ולטענתם אין לאפשר מצב לפיו שר הביטחון, לו הסמכות הבלעדית לחסות ראיות מטעמי ביטחון, "מאציל" סמכות זו בדרך של הוצאת תעודות חסיון מעורפלות הנותנות בידי התביעה את הכוח לפרשן. העותרים מוסיפים וטוענים לגופם של דברים כי מסירת הקלטת במלואה לידיהם יש לה חשיבות רבה לניהול הגנתם שכן היא מתעדת באופן כרונולוגי את השתלשלות האירועים הרלבנטית לאישום קודם לתפיסת הסמים בידי העותרים וכי האינטרס הציבורי במסירת ראיות לצורך ניהול הגנה גובר על כל אינטרס אחר, לרבות על האינטרס של ביטחון המדינה. בהקשר זה מציינים העותרים כי מסירת הקלטת לידיהם אינה יכולה לפגוע בביטחון המדינה באשר הם עצמם מצולמים בקלטת ואין ספק שראו במו עיניהם בשטח את כל אשר בו. מטעמים אלה מבקשים העותרים להורות על מסירת הקלטת (או הקלטות, ככל שקיימות כאלה) בשלמותה לידיהם.

לא מצאתי מקום להידרש לטענות ששבו העותרים והעלו בפניי באשר לסוג ההליך שעליהם לנקוט לצורך קבלת הקלטת במלואה לעיונם. סוגיה זו הוכרעה במסגרת הערר בבש"פ 7468/08 על-ידי כב' השופט ג'ובראן. אתייחס אך ורק לטענות שהעלו הצדדים לגופם של דברים ולשיקולים שעל בית משפט זה לשקול בדונו בעתירה כגון זו שבפניי לגילוי ראיה על פי סעיף 46 לפקודת הראיות. ביום 13.11.2008 במסגרת הדיון בעתירה הוצגה בפניי במעמד צד אחד הקלטת במלואה וכן נמסרו הסברים והבהרות מפי גורמי הביטחון באשר לקטעים שהושמטו מן הקלטת בהסתמך על תעודת החסיון. במסגרת זו הבעתי את דעתי כי ניתן לצמצם את הקטעים שהושמטו כאמור ולהוסיף אל הקלטת שתימסר לידי העותרים קטעים נוספים. המשיבה הסכימה לכך ובהתאם הוריתי בהחלטתי מאותו יום על הוספת הקטעים האמורים לגרסה הגלויה שתועבר להגנה. כן הוריתי כי הגרסה המתוקנת ביחד עם הגרסה המלאה יועברו לעיוני עד יום 16.11.2008 וכך היה. הקלטת הגלויה במתכונתה המתוקנת אורכה כ- 5:03 דקות והקטעים שנשמטו צומצמו לכדי 0:35 שניות בלבד. חלק הארי של הקלטת הוא, אפוא, עתה גלוי ונמסר לידי ההגנה. מתוך עיון מחודש בקלטת המלאה ובקטעים שעדיין נותרו חסויים נחה דעתי כי חסיונם תואם את האמור בתעודת החסיון שהוצאה וכי
הצורך לגלותם לשם עשיית צדק אינו גובר על שיקולי ביטחון המדינה, המצדיקים שלא לגלותם.
אשר על כן, העתירה נדחית בכפוף להוספת הקטעים בהסכמה אל הקלטת הגלויה כמפורט לעיל.
