החלטה
בפני ערר על החלטת בית המשפט המחוזי מרכז (השופטת מ' ברנט), בעמ"ת – 23316-10-10, מיום 17.10.10, אשר דחה ערר שהגיש העורר על החלטת בית משפט השלום בכפר סבא (השופטת מ' בן-ארי) בתיק מ"ת 4106-07-10, מיום 14.9.10.

כנגד העורר הוגש ביום 14.7.10 כתב אישום המייחס לו עבירות של החזקת סמים שלא לשימוש עצמי והפרת הוראה חוקית. על פי עובדות כתב האישום, ביום 21.1.10, במסגרת תיק פלילי 22750-01-09 (בימ"ש השלום פ"ת), שעניינו עבירות אלימות – תקיפה ותקיפה הגורמת חבלה של ממש, שונו התנאים המגבילים בהם היה נתון העורר, על ידי השופטת רון, והותר לו לצאת בשעות מסוימות לעבודה, כשעם סיום העבודה ישוב אל מעצר הבית בליווי. ביום 3.7.10 יצא העורר מביתו לטירת הכרמל לצורך רכישת סמים, וביום 4.7.10 בהוד השרון, החזיק העורר סם מסוכן מסוג חשיש במשקל כולל של כ- 290 גרם . במעשים אלו, הפר העורר הוראה חוקית וביצע עבירה נוספת של החזקת סמים מסוכנים שלא לצריכה עצמית.

בד בבד עם הגשת כתב האישום, הוגשה בקשה למעצרו של העורר עד תום ההליכים המשפטיים כנגדו. ביום 14.9.10 התקבל תסקיר מעצר בעניינו של העורר, אשר המליץ כי העורר יצא לראיון קבלה בקהילה הטיפולית "רטורנו" (להלן גם:" הקהילה ") . שירות המבחן התלבט בטרם ניתנה המלצה לאשר לעורר לצאת לראיון קבלה, מכיוון שהתרשמותו היתה כי העורר מסר מידע מגמתי ומוקצן וכי מהיכרותו עם העורר בעבר, ומעורבותו בפלילים, לא בלט פרופיל התמכרותי וניהול אורח חיים האופייני למשתמשים פעילים. עוד נכתב בתסקיר, כי שירות המבחן מתקשה להעריך את רמת התמכרותו וספקני באשר להתאמתו לטיפול. בנוסף, עמד שירות המבחן על הפרת תנאי שחרורו ומורכבות מצבו המשפטי, ממנו למד כי ייתכן שהעורר מונע היום מצורך להיטיב את תנאי מעצרו ולהפחית מחומרת המיוחס לו. עם זאת, שירות המבחן סבר, כי יש מקום לקבל את התרשמותם של הגורמים הטיפוליים במסגרת, מתוך מחשבה, כי ייתכן וניתן יהא לנצל את הליך המעצר הנוכחי כמנוף לטיפול בסוגיית דפוסי התנהגותו של העורר במצבי תסכול וקונפליקט.

בית משפט השלום קבע בהחלטתו, כי מתוך התסקיר עולה כי שירות המבחן לא מצא לנכון לתת המלצה חד משמעית להפניה לקהילה טיפולית וכי השאלה אינה ההליך השיקומי של העורר אלא איון מסוכנותו. מאחר והעורר לא החל בהליך גמילה טרם מעצרו, פוטנציאל ההצלחה של הליך הגמילה, על פי התרשמות שירות המבחן, אינו גבוה, ולאור האישום בהפרת הוראה חוקית על רקע עבר פלילי לא קל, בנוסף לגזר דין שניתן אך בחודש אפריל האחרון, לא מצא בימ"ש קמא כי יש מקום לבחון את החלופה של קהילה טיפולית והורה על מעצרו של העורר עד תום ההליכים המשפטיים כנגדו.

לטענת ב"כ העורר בערעורו לבית המשפט המחוזי, שגה בית משפט השלום משלא אפשר יציאתו של העורר לראיון קבלה בקהילת "רטורנו", לפי שמדובר ברצון כן ואמיתי של העורר להירתם להליך גמילה כתנאי ליציאה ממעגל החיים העברייני, האינטרס של העורר והאינטרס הציבורי הינם כי העורר יעבור הליך גמילה ולא יוחזק מאחורי סורג ובריח. טענת ב"כ המשיבה היה, כי הליכי גמילה, מקומם, ככלל, במסגרת גזר הדין, אלא במקרים חריגים, אשר אינם מתקיימים בעניינו של העורר. העורר הורשע אך בחודש מאי האחרון בעבירות של תקיפה ותקיפה הגורמת חבלה של ממש, ולחובתו מאסר על תנאי בן 8 חודשים, אשר, לטענת המשיבה, חב הפעלה, ולטענת ב"כ העורר ניתן להארכה וכן מעצר על תנאי נוסף, בן 4 חודשים, בגין עבירות על פקודת הסמים המסוכנים, אשר הינו בר הפעלה. משלא נרתע העורר מלהפר הוראה חוקית, כששני מאסרים על תנאי מרחפים מעל ראשו, ומשהורשע בעבירות לא קלות אך בחודש מאי האחרון, לא סברה המשיבה, כי יש להורות על שליחתו של העורר לראיון הקבלה.

בית המשפט המחוזי קבע, בערר שהוגש על החלטת בית משפט השלום, כי צדק בית משפט השלום בקובעו כי זהו אינו השלב לבחינת חלופה של גמילה, ולפיכך אין מקום להורות על שליחתו של העורר לראיון קבלה בקהילת "רטורנו". עוד הדגיש בית המשפט המחוזי, כי לחובתו של העורר עבר פלילי בעבירות אלימות, איומים, מרמה ועבירות סמים. נוכח האמור, דחה בית המשפט המחוזי את הערר.
הטענות בערר

העורר טוען כי ההחלטה שבבסיס הערר עומדת בניגוד למתחייב על פי הוראת חוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו-1996, המחייב מיצוי אפשרויות שחרור בערובה, בטרם מורה בית המשפט על מעצרו של אדם. עוד טוען העורר, כי נפל משגה בהחלטה נשוא הערר, וזאת עת ניתנה על בסיס תסקיר מעצר חסר וחלקי, לשיטתו, תוך דחיית המלצת שירות המבחן לאפשר השלמת התסקיר לאחר קיום ראיון במסגרת הקהילה הטיפולית הסגורה "רטורנו". לפיכך מבקש העורר בערר זה, לאפשר יציאתו לראיות קבלה במסגרת הקהילה, וכן להורות על הכנתו של תסקיר מעצר משלים, אשר יבחן את תוצאות הראיון ואת אפשרות השתלבותו של העורר בקהילה, כחלופת מעצר.

לטענת העורר, שגה בית המשפט עת נתן משקל מהותי לעברו, או להפרת ההוראה החוקית שיוחסה לו, וזאת עת מדובר בהפרה בודדת, אשר גם היא ארעה על רקע כשלון בסם, לשיטת העורר, ולאחר תקופה בת תשעה חודשים בה שהה העורר בתנאים מגבילים.

לטענת העורר, שגה בית משפט השלום, עת הורה על מעצרו עד לתום ההליכים המשפטיים נגדו, בלא שהונח בפניו תסקיר מלא של שירות המבחן. עוד טוען העורר, כי שגה בית משפט השלום עת הורה על מעצרו של העורר, אגב דחיית המלצת שירות המבחן, ומבלי שאפשר לעורר לערוך ראיון במסגרת טיפולית ייעודית.

עוד לשיטת העורר, שגה בית המשפט ביישמו את הלכות בית המשפט העליון, וזאת כאשר קבע כי הליך גמילה הנמצא בעיצומו, מהווה תנאי הכרחי לצורך השתלבותו של העורר בהליך גמילה בשלב המעצר. בנוסף, שגה בית המשפט, לטענת העורר, כאשר קבע כי לא ניתן לתת בעורר אמון.

לטענת העורר, הוא מביע כיום רצון להיחלץ ממעגל הסמים, והוא נכון רגשית ונפשית לעבור הליך טיפולי מעמיק וארוך. לטענתו, מדובר ברצון כנה ואמיתי שגמל בו ואינו נובע מרצונו לחמוק ממעצר.
לאור האמור לעיל, ביקש העורר לקבל את הערר ולאפשר לו לצאת לראיון הקבלה בקהילה, ולהורות לשירות המבחן להכין תסקיר מעצר משלים, אשר יבחן תוצאות הראיון, וייתן המלצה סופית בעניינו של העורר.
דיון והכרעה

הוגשה לי בדיון הזמנה ל"רטורנו" ליום 28.11.2010 ובאת כוח העורר הגישה אסמכתאות שונות וטענה, כי עתה, כשחרב המעצר מרחפת מעל העורר – יש סיכוי טוב לטיפול.

אין מקום לקבלת ערר זה ולהתערבות בהחלטות שתי הערכאות שקדמו לי. העורר לא פנה לטיפול טרם מעצרו הנוכחי. אין הוא בגדר מקרה חריג לכלל לפיו אין להתחיל בהליך טיפולי לראשונה במסגרת הליכי המעצר. מעבר לכל אלה: העורר מעל באמון שניתן בו, בכך שהפר לכאורה צו שיפוטי, וממילא אין מקום לתת בו אמון.

לא ראיתי מקום להיעתר לבקשה "רק" לאפשר לעותר להגיע עם ליווי ל"רטורנו". היעתרות לבקשה זו יש בה כדי לטעת אשליות בלב העורר בדבר הצפוי לאחר אותו ראיון.
14.
לא ראיתי מקום להיעתר לערר זה והוא נדחה.
