החלטה
א.
לאחר העיון בעתירה ובתגובות סבורני כי יש מקום ליתן דיון נוסף בשאלות שעורר העותר, קרי השאלה אם חלוקתו של עותק הבטאון הצרפתי "שרלי אבדו" היא מתנה אסורה לפי סעיף 8 לחוק הבחירות (דרכי תעמולה), תשי"ט-1959; ושאלת מנעד סמכותו של יו"ר ועדת הבחירות המרכזית למתן צוי מניעה, והאם מוגבלת היא לאמור בסעיף 17ב(א) לחוק הבחירות (דרכי תעמולה) בלבד, או שמא רחבה יותר.
מורה אני איפוא על קיום דיון נוסף בפסק דינו של בית משפט זה מיום ו' באדר התשע"ה (25.2.15) בבג"צ 979/15 בשאלות הללו, מכוח הסמכות שניתנה לי לפי סעיף 30 (ב) לחוק בתי המשפט (נוסח משולב), תשמ"ד-1984.

הדיון הנוסף ייערך בפני מותב של שבעה שופטים או יותר, הכל לפי קביעת הנשיאה, שאליה מועבר התיק לעניין זה ולקביעת דרכי הדיון.

אשר לעיכוב הביצוע (בשג"ץ 1508/15), סבורני כי אין לו מקום בנסיבות. ראשית, בשלב זה לפנינו פסק דין שהוא "ציפור ביד" לעומת הדיון הנוסף שתוצאתו היא "ציפור על העץ". עיכוב ביצוע יתן לעותר את כל מבוקשו, בעוד שלעת הזאת במובן המשפטי האופרטיבי ידו על התחתונה. שנית, אל נכחד: כפי שציינה הנשיאה ברישת חוות דעתה בפסק הדין נשוא העתירה, ההתרשמות היא כי לאמיתם של דברים עומדת בראש מעייניו של העותר הפסקת ההפצה בשל עמוד השער של הגיליון, ואשר על כן לא הסכים להצעת בית המשפט לעניין הפצת הדף הראשון והדף האחרון; דבר זה היה מוציא את העוקץ מטענת המתנה, שלאמיתה היא כנראה נושא משני מבחינת העותר. על כן גם איני נדרש עתה להצעה החלופית של משיבים 2-1 החוזרת על הצעת בית המשפט דאז. איני רואה יסוד משפטי לעת הזאת לעיכוב הביצוע. כעולה מהחלטתי מיום 1.3.15, הדיון הנוסף יהא בפועל צופה פני עתיד. על כן איני נעתר לבקשה בעניין עיכוב הביצוע,
והצו הארעי – בטל.
