החלטה

זוהי בקשה לקיום דיון נוסף בפסק-הדין של בית המשפט העליון בבג"ץ 3581/07 (כבוד השופטים ע' ארבל , י' דנציגר
ו ע' פוגלמן ), שבו נדחתה עתירתם של המבקשים לשינוי גבולות תוכנית "תת"ל 15 – מסילת השרון ודרך מס' 531" (להלן: התוכנית ) באזורים מסוימים ברעננה ובכפר-סבא. התוכנית כוללת סלילת מערכת כבישים והקמת מסילת ברזל באזור שבין יישובי השרון לבין תל-אביב.

עיקר טענותיהם של המבקשים בעתירה נדחו מן הטעם שלא הגישו לרשויות התכנון השגה על גבולות התוכנית ("הקו הכחול") במועד שנקבע לכך – ולפיכך לא מיצו את ההליכים שעמדו לפניהם טרם הגשת עתירה לבג"ץ. בית המשפט העליון הדגיש, לעניין זה, כי עקב הימנעות המבקשים מהגשת השגות פרטניות, לא הועמדה לפניו תשתית עובדתית קונקרטית ביחס לטיב הפגיעה הנטענת בכל אחד מן המבקשים לאור נתוניו האינדיבידואליים. במסגרת העתירה ביקשו המבקשים להשיג גם על הנספח האקוסטי לתוכנית אחרת שנוגעת לתכנון כביש מס' 531 (מח/54ג). טענותיהם בעניין זה נדחו מחמת שיהוי של למעלה מעשור וכן מחמת קיומו של סעד חלופי בבית המשפט לעניינים מנהליים. לבסוף, דן בית המשפט העליון בטענה כי התוכנית חורגת מהוראות תוכנית מתאר ארצית לדרכים 3 (להלן: תמ"א 3 ), ובעיקר מהוראת סעיף 6(ב)(1) לתמ"א 3, שלפיה:
ב.רוחב הרצועה לתכנון יהא:
(1) בכל הדרכים שברשת הדרכים הארצית – 300 מטר .
בית המשפט העליון קבע כי במקרה זה אין תחולה למגבלת הרוחב של
300 מטרים , וזאת לאור החריג הקבוע בסעיף 6(ד)(1) לתמ"א 3, שלפיו:
ד.(1) כל עוד לא נקבעה רצועת הדרך, בתכנית מתאר מקומית או בתכנית מפורטת, לא תאושר ברצועה לתכנון כל תכנית מפורטת לבנייה או לסלילה, למבני שירות ולמערכות תשתית. משתאושר תוכנית מפורטת בה נקבעה רצועת הדרך וקווי הבניין שלה, יתבטלו ההגבלות על הבנייה או הסלילה לפי סעיף זה [ההדגשה הוספה – א' ר'].
התוכנית, כך נקבע, כוללת הוראות של תוכנית מפורטת ועל-כן עם אישורה התבטלה מגבלת הרוחב של 300 מטרים . בית המשפט העליון קבע כי מסקנה זו מתיישבת גם עם הגיונה של המגבלה – שימור עתודות קרקע בתוך רצועת התכנון בהיקף שיאפשר גמישות בתכנון. לאחר אישור תוכנית מפורטת, כך הובהר, אין עוד צורך בגמישות זו.

המבקשים סבורים כי יש מקום לקיים דיון נוסף בפסק-הדין. טענותיהם מתמקדות בשתי סוגיות: הראשונה , היא סוגיית פרשנות סעיף 6(ד)(1) לתמ"א 3. לטענת המבקשים, סעיף זה לא יוצר חריג למגבלת רוחב הרצועה הקבועה בסעיף 6(ב)(1) לתמ"א 3, ותכליתו היא אך לקבוע את סדר התכנון – ראשית יש לקבוע רצועת דרך בתוכנית מפורטת, ורק לאחר מכן ניתן לאשר "תכנית מפורטת לבנייה או לסלילה, למבני שירות ולמערכות תשתית". הסוגיה השנייה שמעלים המבקשים היא דחיית עתירתם לבג"ץ עקב אי-מיצוי הליכים. לעמדתם, היה מקום להכיר בהם כ"עותר ציבורי" ולפטור אותם בשל כך מן הצורך להגיש השגות קונקרטיות על התוכנית טרם הגשת העתירה. דחיית עתירתם, כך טוענים המבקשים, מובילה לצמצום "זכות העמידה" באופן הנוגד את ההלכות המשפטיות הקיימות. כן טוענים המבקשים כי המשיבים, ובראשם הוועדה הארצית לתשתיות לאומיות, קיבלו החלטה עקרונית לדחות את כל ההשגות שהוגשו ביחס למיקום "הקו הכחול", ועל-כן לא הייתה תועלת ממשית בהגשת השגות פרטניות מטעם המבקשים. כן מוסיפים המבקשים טענה, שלא נדונה במסגרת פסק-הדין, שלפיה חלקם הגישו התנגדות, אשר יש לפרשה כמתייחסת למיקום "הקו הכחול".

המשיבים מצידם סבורים כי בית המשפט העליון פירש את הוראות סעיף 6 לתמ"א 3 לפי ההלכות הקיימות בעניין פרשנות הוראות דין, וכי קביעתו אינה בגדר "הלכה חדשה" אשר יש בה כדי להצדיק קיום דיון נוסף. לעניין אי-מיצוי ההליכים לפני רשויות התכנון, טוענים המשיבים כי בית המשפט העליון דחה את טענות המבקשים לגופן, מבלי שנקבעה בעניין זה כל הלכה חדשה. כן מדגישים המשיבים כי בית המשפט העליון קבע, בהתבסס על פסיקה קודמת, כי דחיית השגות שהגישו אחרים אינה מייתרת את הצורך בכך שהמבקשים עצמם יפנו בהשגות מטעמם. המשיבים טוענים עוד, כי לא הוכח שההשגות שהוגשו מטעם אחרים, ונדחו, דומות במהותן ובנתונים ששימשו יסוד לדחייתן, להשגות שהיו צריכים המבקשים להגיש, וכי בית המשפט העליון הסתמך גם על נימוק זה בדחותו את טענות המבקשים. לבסוף, טוענים המשיבים כי טענותיהם של המבקשים הן טענות תכנוניות ולא עקרוניות, וכי בדין קבע בית המשפט העליון כי אין לראות בהם "עותר ציבורי".

דין הבקשה להידחות. כידוע, הליך הדיון הנוסף שמור למקרים יוצאי דופן ונדירים, שבהם פסק בית המשפט העליון הלכה חשובה, קשה, חדשה או כזו העומדת בסתירה להלכה קודמת של בית-המשפט העליון (סעיף 30(ב) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984). המקרה שלפנינו אינו בא בגדר אלה. בית המשפט העליון לא קבע כל הלכה באשר למעמדו של "עותר ציבורי" ואף לא סטה מן ההלכות השונות, הנוגעות להיקף "זכות העמידה". דחיית העתירה לא התבססה על היעדר זכות עמידה של המבקשים, כי אם על כך שלא מיצו את ההליכים החלופיים שעמדו לפניהם לשם השגה על גבולות התוכנית. בכך נהג בית המשפט העליון בהתאם להלכות הקיימות – ולא בניגוד אליהן. אי הגשת השגה מטעם המבקשים אף יצרה קושי מעשי להכריע בעתירתם, שכן לא עמדה לפני בית המשפט תשתית עובדתית מלאה באשר לנתוניו של כל אחד מ-132 העותרים בעתירה. משכך, לא ניתן לאתר כל הלכה חדשה בקביעות אלה.
גם הפרשנות שהעניק בית המשפט העליון לסעיף 6 לתמ"א 3 לא מקימה עילה לדיון נוסף. פרשנותו של סעיף מסוים זה נעשתה מעבר לצורך, לאחר דחיית העתירה מן הטעם של אי-מיצוי הליכים חלופיים. נוסף על כך, פרשנות זו לא נושאת אופי כללי או עקרוני מן הסוג שמצדיק קיום הליך של דיון נוסף לפני הרכב מורחב של שופטים. פרשנותו של סעיף חוק מסוים, שאינה בעלת תחולה רחבה או חשיבות יוצאת-דופן, תיעשה ברגיל על-ידי הרכב של שלושה משופטי בית המשפט העליון, והליך הדיון הנוסף אינו בגדר ערעור נוסף על פסק-הדין. לפיכך, בהכרעה בבקשה לקיום נוסף לא ניתן להפעיל אמות מידה של ביקורת ערעורית, המאפשרת לבחון מחדש את נכונותו של פסק-הדין. תחת זאת, יש לבחון אם נקבעה בפסק-הדין הלכה עקרונית, יוצאת דופן בחשיבותה, בעלת תחולה רחבה במיוחד, או כיוצא באלה. לפי אמות מידה אלה, אין מקום לקיים דיון נוסף בפסק-הדין, חרף הקשיים שעליהם מצביעים המבקשים בפרשנות סעיף 6(ד)(1) לתמ"א 3.
המסקנה היא שהבקשה נדחית. אין צו להוצאות.
