לפניי עתירה לדיון נוסף בפסק דינו של בית המשפט העליון מיום 3.9.2013 (ע"פ 3106/11), בו נדחה ערעורו של העותר ברוב דעות של השופטים ע ' ארבל ו- צ '
זילברטל , בניגוד לדעתו החולקת של השופט י '
דנציגר (להלן – פסק הדין ).

העותר הורשע בבית המשפט המחוזי מרכז-לוד בעבירה של אינוס, וזוכה מניסיון לאינוס של אישה נוספת. על העותר נגזרו שבע שנות מאסר וחצי לריצוי בפועל (בניכוי ימי מעצרו), 12 חודשי מאסר על תנאי וכן פיצוי לטובת המתלוננת שבאינוסה הוא הורשע. נסיבות הפרשה מתוארות בפירוט בפסק הדין, ולא זה המקום לשוב עליהן. בפסק הדין נחלקו הדעות בין חברי המותב באשר להותרת הרשעת העותר באינוס על כנה. בעוד שהשופט י ' דנציגר סבר, כי יש לקבל את הערעור ולזכות את המערער מהעבירה שבה הורשע, סברו שופטי הרוב (השופטים ע '
ארבל ו- צ ' זילברטל ) שדין הערעור, הן על הכרעת הדין הן על גזר הדין, להידחות. מכאן העתירה לדיון נוסף בפסק הדין.

דין העתירה לדיון נוסף להידחות. עיון בפסק הדין מלמד כי המחלוקות שנפלו בין חברי המותב היו בעלות אופי עובדתי בעיקרן, וכי בפסק הדין לא נקבעה הלכה המצדיקה עריכת דיון נוסף, כאמור בסעיף 30(ב) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984.

העותר מעלה בעתירתו מספר טעמים המצדיקים, לשיטתו, דיון נוסף בפסק הדין. כך, העותר מבקש כי ייערך דיון נוסף שיעסוק במידת ההתערבות של ערכאת הערעור בממצאים עובדתיים שנקבעו בערכאה הדיונית. העותר מפנה בעתירתו לגישות שונות שהובעו בפסיקה בעניין זה, בייחוד בהתייחס להרשעה בעבירות מין (ראו, למשל, ע"פ 7653/11 ידען נ ' מדינת ישראל , פיסקאות 22-20 לחוות דעתו של השופט צ ' זילברטל
(26.7.2012); ע"פ 5921/12 סבג נ ' מדינת ישראל , פיסקה 31 (7.5.2013), והאסמכתאות שם), ומוסיף כי בין שופטי המותב נפלה מחלוקת בסוגיה זו. אולם, עיון בפסק הדין מלמד שאין זה כך. בחוות הדעת של שופט המיעוט צוין, כי אין צורך להידרש לגישות אלו לשם ההכרעה בערעור (פיסקה 24 סיפה לחוות דעתו של השופט י ' דנציגר ). מנגד, השופטת ע ' ארבל סברה שאין מקום להתערב בממצאים שנקבעו בבית המשפט המחוזי, וזאת הגם שהיא הסכימה עם דעת המיעוט כי "יש לבחון את עדותה של המתלוננת בקפידה ובזהירות רבה" (פיסקה 8 לחוות דעתה). נמצא, כי לא נקבעה בעניין זה הלכה המצדיקה קיומו של דיון נוסף בפסק-הדין (השוו, דנ"פ 1671/12 פרעוני נ '
מדינת ישראל (18.6.2012)).

טעם נוסף לעריכת דיון נוסף, לשיטתו של העותר, הוא לשם דיון בהיקף תחולתו של "המבחן המשולש", שנקבע להערכת מהימנותו של עד הסובל מהפרעה נפשית (ראו, ע"פ 2864/01 מסילתי נ ' מדינת ישראל , פ"ד נו(1) 315, 329 (2001), והאסמכתאות בפיסקה 25 לחוות דעתו של השופט י ' דנציגר בפסק-הדין נושא העתירה דנא). לטענת העותר, פסק הדין מעורר את השאלה האם להלכה זו תחולה גם באשר לעד שהינו לוקה בנפשו, אך אינו סובל מפיגור או מחלת נפש של ממש. אולם, גם עניין זה אינו מצדיק דיון נוסף בפסק-הדין. הסוגיה אליה מתייחס העותר נדונה בחוות דעתו של השופט צ ' זילברטל , שסבר, כי לא היה צורך להעמיד את גרסתה של המתלוננת בתנאי ה"מבחן המשולש", שכן חוות הדעת שנערכה בהתייחס למתלוננת לא לימדה על קיומו של ליקוי נפשי, בדרגה של מחלת נפש (פיסקה 3 לחוות דעתו). מאידך, הן בחוות דעתו של השופט י '
דנציגר (פיסקה 25 לחוות דעתו) והן בחוות דעתה של השופטת ע ' ארבל (פיסקה 13 לחוות דעתה) נדון "המבחן המשולש" הנזכר לעיל, ועיון בפסק הדין מלמד שהמחלוקת בין שופטים אלו הייתה בקשר ליישומה של ההלכה בנסיבותיו של המקרה. גם עניין זה אינו מצדיק, אפוא, דיון נוסף בפסק-הדין.

יתר טענות העותר, על אף הנופך המשפטי שהוא מנסה לייחס להן, עוסקות בעניינים שבעובדה, ובאופן שבו נקבעו הממצאים העובדתיים בבית המשפט המחוזי ובבית המשפט העליון. טענות אלו אינו מקימות הצדקה לעריכת דיון נוסף. כפי שנקבע בדנ"פ 3489/93 בן אליהו אור נ ' מדינת ישראל , פ"ד מח(2) 661, 663 (1993): "הלכה למעשה, אין בטעמי העתירה לדיון נוסף אלא ביטוי לרצון להעביר את המימצאים והמסקנות בשבט הביקורת של הערכאה השלישית, ולכך לא נועד הדיון הנוסף". לבסוף יצוין, כי טענת העותר לפיה חלק מחברי המותב לא עיין בכתבי טענותיו, נטענה בלא כל ביסוס, ועל כן מוטב היה שלא להעלותה.
