לפני בקשה להורות על קיומו של משפט חוזר לפי סעיף 31 (א) לחוק בתי המשפט [נוסח משולב], התשמ"ד - 1984 (להלן: חוק בתי המשפט).
רקע והשתלשלות ההליכים

המבקש החנה את רכבו בתאריכים 18.11.2007 ו–14.1.2008 ברחוב איסרליש בעיר תל-אביב-יפו ליד בית מספר 8, בניגוד לתמרור המוצב במקום ואוסר על עצירה פרט לפריקה וטעינה. המבקש הורשע בבית המשפט לעניינים מקומיים בתל-אביב-יפו (השופטת ש' גלר-אהרוני ) בשתי עבירות של חניית רכב במקום אסור בניגוד לסעיף
6 (א) (2) לחוק העזר לתל אביב יפו (העמדת הרכב וחנייתו), התשמ"ד 1983.
על המבקש הושת קנס בגובה 700 ש"ח. המבקש ערער על הרשעתו לבית המשפט המחוזי בתל-אביב-יפו. בית המשפט המחוזי (השופטת ע' צ'רניאק ) דחה את הערעור. בית המשפט המחוזי קבע כי הערעור נסב בעיקרו על ממצאים עובדתיים שקבעה הערכאה הדיונית, ולא מצא כי קיימת עילה להתערב בהם. המבקש הגיש בקשה למתן רשות ערעור על פסק הדין לבית המשפט העליון (רע"פ 1296/10). בית המשפט (השופט ס' ג'ובראן ) דחה את הבקשה, בקובעו כי היא אינה מעוררת סוגיה בעלת חשיבות משפטית או ציבורית החורגת מעניינם של הצדדים ואף לגופו של עניין אין עילה להתערבות בממצאים המתייחסים למהימנות העדים. המבקש הגיש בקשה קודמת למשפט חוזר (מ"ח 2394/10). בית המשפט (השופטת ע' ארבל ) דחה את הבקשה. המבקש הגיש בקשה נוספת למשפט חוזר היא הבקשה שלפני.

בבקשה, טוען המבקש, כי ברשותו ראיות חדשות, שלא הוצגו בבקשה הקודמת למשפט חוזר, המוכיחות את חפותו כאמור בסעיף 31 (א) (2) לחוק בתי המשפט. המבקש צירף לבקשתו תעודת עובד ציבור, חתומה על ידי מנהל מדור סימון כבישים באגף התנועה בעיריית תל-אביב-יפו. בתעודה נכתב, כי אורך חזית הבית באיסרליש 8, שלידו החנה את רכבו, הנו כ- 23 מטר , חלק מן המדרכה מסומן בצבעי כחול – לבן וחלק אחר מסומן בצבעי אדום – לבן. עם זאת, לא ניתן לקבוע מה היה סימון אבני השפה הנותרות עד רדיוס הצומת נכון לתאריכים 18.11.2007, 14.1.2008. עוד צירף המבקש, מסמכים המעידים, כי התמרור שהוצב בתאריך 28.3.2007 ברחוב איסרליש אוסר על עצירת רכב, למעט פריקה וטעינה לאורך 12 מטר וכן צירף לבקשתו תמונות. לגרסת המבקש, מראיות אלו ניתן ללמוד, כי החנה את רכבו מחוץ לטווח תחולתו של התמרור, במקום בו החניה מותרת וכי אבן השפה לא הייתה מסומנת. נוסף על כך טוען המבקש, כי לבית המשפט לעניינים מקומיים בתל אביב יפו הוגשו ראיות מסוימות שיסודן "בשקר או זיוף" לפי סעיף 31 (א) (1) לחוק בתי המשפט. לשיטתו, הפקחיות שמסרו עדותן בנוגע לנסיבות מתן הדו"חות, שיקרו בעדותן. לבסוף טוען המבקש, כי כל מהלך חקירתו הנגדית היה פסול והוא לא זכה למשפט הוגן ולכן גם מתעורר חשש ממשי ל"עוות דין" כאמור בסעיף 31 (א) (4) לחוק בתי המשפט.

המשיבה בתשובתה מבקשת לדחות את הבקשה למשפט חוזר. לטענתה, כל הטענות שמעלה המבקש נדונו לפני שלוש ערכאות, בשלושה הליכים שונים ונדחו בכולם. המבקש שב ומעלה טענות אשר במהותן מכוונות נגד קביעות שבעובדה ונגד קביעות המתייחסות למהימנות העדים אשר נקבעו בתום שמיעת הראיות. כמו כן, סבורה המשיבה, כי אין חשש של ממש, כי בהרשעתו נגרם עיוות דין.
הכרעה

דין הבקשה להידחות. סעיף 31 (א) (2) לחוק בתי המשפט מאפשר את קיומו של משפט חוזר מקום בו "הוצגו עובדות או ראיות, העשויות, לבדן או ביחד עם החומר שהיה בפני בית המשפט בראשונה, לשנות את תוצאת המשפט לטובת הנידון". מהוראת הסעיף עולה, כי לא די בהצגתן של עובדות או ראיות נוספות שלא הונחו בפני הערכאה הדיונית, אלא נדרש שאותן ראיות או עובדות נוספות יהיו בעלות אותו משקל סגולי אשר יש בו כדי להביא לשינוי תוצאת המשפט (מ"ח 6148/95 עזריה נ' מדינת ישראל , פ"ד נא(1) 353 (1997); מ"ח 6731/96 ברנס נ' מדינת ישראל , פ"ד נא(4) 241, 248 (1997)). לא שוכנעתי במקרה דנן, כי הראיות שהגיש המבקש הנן ראיות חדשות אשר יש בהן אותו משקל סגולי שיש בו כדי להביא לשינוי תוצאות המשפט לטובתו. המבקש שב וחולק על ממצאי עובדה שקבעה הערכאה הדיונית. שאלת סימון אבן השפה אינה רלוונטית, שכן אין חולק שברחוב איסרליש מול בית מספר 8 הוצב תמרור האוסר על עצירת רכב, למעט פריקה וטעינה. אין בראיות החדשות לשנות את מסקנת שלושת הערכאות שנדרשו לעניינו של המבקש לפיה המבקש לא ציית לתמרור וחנה בטווח האסור לעצירה. יש לזכור, כי משפט חוזר הוא החריג, ולא הכלל. הוא איננו ערעור נוסף (מ"ח 6778/01
אסבן נ' מדינת ישראל (19.11.2001)) (להלן: עניין אסבן ). יש לדחות את טענות המבקש לעניין עדויות הפקחיות וניהול ההליך המשפטי בעניינו אשר נדונו ונדחו בבקשה הראשונה שהגיש המבקש למשפט חוזר (ראו: מ"ח 9341/11 פלוני נ' מדינת ישראל
(19.2.2012); תקנה 8 לתקנות בתי המשפט (סדרי דין במשפט חוזר), התשי"ז -1957).

לא שוכנעתי גם כי קיים חשש של ממש שנגרם עוות דין בהרשעתו של המבקש ויש להורות על משפט חוזר לפי סעיף 31 (א) (4) לחוק בתי המשפט. עילה זו מאפשרת קיום משפט חוזק בנסיבות חריגות, על מנת "שלא יהיו ידיו של בית המשפט כבולות להיעתר לבקשה, במקרים חריגים ויוצאי דופן בהם נתעורר בליבו חשש של ממש כי נגרם עיוות דין, והם אינם נכללים בגדר העילות האחרות למשפט חוזר" (מ"ח 6223/04 גולדין נ' מדינת ישראל (13.10.2004)). איני סבורה שכך הוא המקרה דנן. עילה זו אין מטרתה "לבדוק פעם נוספת את העובדות ששימשו יסוד להרשעת המבקש, על יסוד נושאים שכבר נידונו בעבר" (עניין אסבן , בפסקה 9).

לאור כל האמור לעיל, הבקשה נדחית.
