לפניי בקשה מטעם המערערת בע"א 10224/07 להוציא מתיק בית המשפט ראיות חדשות שהגישו המשיבים. המסמך שהוצאתו מבוקשת הוא מוצג ג' מתיק המוצגים. בד בבד מתבקשת מחיקתו של סעיף 29ד' לכתב הסיכומים מטעם המערערים (מיום 4.5.2009) המתייחס למוצג האמור. כן מתבקשת מחיקתם של סעיפים 23א', 32, 40 ו-44 לכתב הסיכומים, בנימוק כי מועלים בהם טיעונים עובדתיים חדשים. המשיבים מתנגדים לבקשה. אשר למוצג ג', נטען כי מדובר בהחלטה של בית המשפט המחוזי בתיק נשוא הערעור. ההחלטה אמנם ניתנה לאחר שהוגש הערעור אולם היא מתייחסת ישירות לפסק הדין. לגבי הסעיפים האחרים שמתבקשת מחיקתם מכתב הערעור, נטען כי הנושאים עלו בדיונים בבית המשפט קמא.

לאחר עיון בטענות הצדדים ובחומר שבתיק, נחה דעתי כי יש לדחות את הבקשה. מוצג ג' הוא החלטה של בית המשפט המחוזי בתל-אביב-יפו שניתנה במסגרת ההליך נשוא הערעור (ת.א. 2474/01) בבקשה שהגישה המערערת לאכיפת פסק דינו של בית המשפט לפי פקודת בזיון בית המשפט. בהחלטה, שניתנה ביום 15.3.2009, נדחתה הבקשה על כל ראשיה. תקנה 437(א) לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן: התקנות ) מאפשרת לכלול בכרך מוצגים "מסמכים שהוצגו לפני בית המשפט בערכאות הקודמות". אמנם, החלטת בית המשפט המחוזי בבקשה לפי פקודת בזיון בית המשפט לא הוצגה לפני בית המשפט המחוזי. היא מאוחרת לפסק הדין והיא עצמה חלק מההליך השיפוטי של התיק. אין חולק כי היא לא היוותה חלק בסיס ההכרעה שעמד בפני בית המשפט קמא בעת מתן פסק דינו נשוא ערעור זה. אולם ההחלטה ממילא מצויה בתיק בית המשפט המחוזי, העומד לרשות שופטי ערכאת הערעור הדנים בתיק. במצב דברים זה איני רואה טעם להורות על הוצאת ההחלטה מתיק המוצגים של המשיבים, ואיני רואה טעם לשלול מן המשיבים אפשרות להסתמך על האמור בהחלטה.

אשר לטענות האחרות שבפי המערערת בעניין תוכן כתבי הסיכומים, לא ראיתי מקום להידרש להן בשלב זה. המדיניות הנהוגה היא שככלל, אין להתערב, בכפוף למקרים חריגים וקיצוניים, התערבות מקדמית בתוכנם של כתבי טענות המוגשים לבית המשפט (ראו, עע"מ 8193/02 ראובן נ' פז חברת נפט בע"מ (לא פורסם, 27.5.03)). הקביעה האם מדובר בטיעון עובדתי חדש, כמו גם ההחלטה האם להתיר את העלאתו, מסורה לשיקול דעתו של ההרכב שידון בתיק. לא מצאתי כי מקרה זה הנו מן המקרים החריגים בהם יש הצדקה להתערבות בעריכת הסיכומים ולמניעה של הטיעון בשלב מקדמי זה. אין בכך כדי למנוע מן המערערת לטעון לעניין הנדון במסגרת השלמת הטיעון על-פה לפני ההרכב.
הבקשה נדחית. אין צו להוצאות.
