המשנה לנשיאה א' ריבלין:

בשנת 1975 ניתן פסק-דין במסגרת הליכי הסדר מקרקעין שבו הוחלט כי חלקות מסוימות בכפר מעיליא יירשמו על-שם מדינת ישראל (המשיבה); זאת, משלא הוכיח גורם כלשהו חזקה ועיבוד בהן. בית-המשפט ציין כי שלושת הנתבעים בהליך – אדיב, נג'יב וג'בור – הוזמנו לדיון אך לא הופיעו.
בשנת 1985 ביקשו אדיב ונג'יב לבטל את פסק-הדין מן הטעם שזה ניתן במעמד צד אחד בלבד ובהיעדרם. בקשה זו נדחתה. בית-המשפט הטעים, בין השאר, כי אדיב זומן לישיבה עובר לפסק-הדין משנת 1975; כן התייחס בית-המשפט לסעיף ספציפי בדיני ההסדר, שלפיו התייצבות של אחד הבעלים המשותפים בחלקה כמוה כהתייצבות כולם. בית-המשפט בא איפוא לכלל מסקנה כי פסק-הדין ניתן כהלכה.
בשנת 1999 ביקשו עזבונו של ג'בור ויורשיו לבטל את פסק-הדין משנת 1975 בשל שניתן בהיעדרו של המנוח ג'בור (יצויין כי הלה נפטר עוד בשנת 1974). בית-המשפט המחוזי קיבל את הבקשה וקבע שיש לבטל את פסק-הדין משנת 1975, ככל שהוא נוגע לזכויותיו של המנוח ג'בור. נפסק, כי ההזמנה לדין הומצאה לכלתו של ג'בור (אשת בנו אליאס שנפטר גם הוא בינתיים), שלא גרה יחד עימו, וכי לא נעשה ניסיון למסור את ההזמנה לאשת המנוח שגרה עימו. לפיכך, נקבע כי המנוח לא הוזמן כדין. בית-המשפט המחוזי דחה את טענת המערער שנסמכה על תקנות ההסדר, כי די בהתייצבות של אחד מבעלי הזכויות בקרקע בשם היתר. נקבע, כי אין לפרש הוראה זו באופן מרחיב המאפשר למעשה להזמין בעל-דין אחד ולראות בו מניה וביה – ובלי שהדבר מצויין מפורשות – משום נציג של האחרים. עוד הוטעם כי במקרה זה שוגרה הזמנה לכל אחד מבעלי-הדין (אך לא נעשתה המצאה כדין), וגם משום כך לא ניתן לראות באחד מהבעלים המשותפים נציג של היתר. סופו של דבר, בית-המשפט סבר כי שיקולי צדק מחייבים לבטל את פסק-הדין משנת 1975, ככל שמ דובר במנוח ג'בור.
בעקבות החלטה זו של בית-המשפט המחוזי, ניתן פסק-הדין (מפי כבוד השופטת ב' בר-זיו), שלפיו בנסיבות העניין – ומשלא יהיה מנוס מליתן את הדעת במסגרת הליכי ההסדר המחודשים גם למעמדם של הטוענים האחרים לזכויות בחלקות – יוחזר התיק לפקיד ההסדר כדי שינקוט מלכתחילה בכל הליכי ההסדר, לרבות הזמנת הציבור להגיש תביעות חדשות בקשר לחלקות.

על פסק-הדין וההחלטה שקדמה לו משיג המערער. לטענתו, נעשתה במקרה זה המצאה כדין, וזאת משנמסרה ההזמנה לאדיב – "הרוח החיה" בתביעה במסגרת הליכי ההסדר – וכן משהומצאה הזמנה למוכתאר הכפר ולכלתו של המנוח. כמו-כן נסמך המערער על דחיית הבקשה הקודמת לביטול פסק-הדין (שהוגשה על-ידי אדיב ונג'יב בשנת 1985), ועל ההוראה בדבר נפקותה של התייצבות של אחד הבעלים המשותפים מבחינת היתר. המערער עומד גם על חשיבות הסופיות בהליכי ההסדר. המשיבים מצידם סבורים כי דין הערעור להידחות על הסף וכן לגוף הדברים.

דין הערעור להתקבל. אין ספק באשר לזכותו של אדם להיות מוזמן כדין לדיון בעניינו, זכות המממשת את העקרון בדבר "היה לו יומו" ואת היכולת של אדם לגשת לערכאות ולהשפיע על התוצאה הניתנת בעניין הנוגע לו. עם זאת, אין גם ספק כי בחלוף עשרות שנים ממועד ההכרעה בתיק, מתקהה עוקצה של הזכות ומתגבר משקלם של שיקולים נוגדים ובהם עיקרון סופיות הדיון והאינטרסים הקשורים בו כגון אינטרס ההסתמכות של בעל-הדין שכנגד ושל צדדים שלישיים. שיקולים נוגדים אלה בולטים אף יותר כשמ דובר בהליכי הסדר מהסוג שנדון כאן. האיזון בין אינטרסים אלה בא לידי ביטוי בחובתו של בעל-דין הטוען לבטלות פסק-דין בחלוף 30 שנה להצביע על חוסר צדק של ממש בהליכים, ובפרט עליו להראות כי לא היה באפשרותו להגיש את הבקשה לביטול במועד מוקדם יותר. אמנם נכון כי ככלל לא יתחיל מרוץ התקופה של 30 יום להגשת בקשת ביטול עד להמצאתו כדין של פסק-הדין שביטולו מבוקש, וזאת לפי הוראת תקנה 201 לתקנות סדר הדין האזרחי, התשמ"ד-1984. בית המשפט המחוזי לא הכריע בשאלת מועד המצאתו (אם הומצא) של פסק-הדין משנת 1975 למערערים. כרגיל, אין לוותר על דרישת "ההמצאה כדין" אף כאשר בפועל ידע בעל הדין המבקש את ביטולו של פסק-דין על קיומו. אולם ישנם מצבים שבהם לא יוכל כלל זה לסייע לבעל דין שהיה מודע בפועל לקיומו של פסק-הדין וישן על זכויותיו, והמקרה שלפנינו – שבו חלוף הזמן הוא כה משמעותי – הוא אחד מאותם מקרים. בעל דין המודע לקיומו של פסק-דין שניתן בהיעדרו אינו יכול לקפוא על שמריו במשך עשרות שנים טרם שיממש את זכותו לבקש את ביטול פסק-הדין. עיקרון סופיות הדיון, כמו גם אינטרס ההסתמכות של צדדים שלישיים, מחייבים שכאשר השתהותו של בעל דין היא
כה משמעותית, יידרש הוא להוכיח צידוק ממשי לשיהוי. בענייננו, אף שקביעותיו של בית-המשפט המחוזי לגבי הלימות ההמצאה ולגבי פרשנות ההוראה בדבר התייצבות "אחד בשם כולם" הן בעלות כוח שכנוע, אין צורך לטעמי לקבוע בכך מסמרות שכן אני מתקשה למצוא צידוק לשיהוי הרב בהגשת הבקשה לביטול פסק-הדין.

המנוח ג'בור היה מעורב בהליכי ההסדר ומודע להם וטען לזכויות בחלקות. הזמנה לדיון בבית-המשפט הומצאה בשנת 1975 לכלתו, שגרה בקירבתו והיא אשתו של אליאס, שהגיש את הבקשה לביטול פסק-הדין בשנת 1999. בנסיבות המקרה אין לסבור כי במשך 30 שנה לא ידע איש מהגורמים הרלוונטיים כי התקיים הליך הסדר וכי נפל בו דבר. גם הבקשה לביטול משנת 1985, אף אם אינה משליכה ישירות על המנוח ג'בור, מחזקת את הרושם הברור כי ניתן וראוי היה לבקש את ביטול פסק-הדין במועד מוקדם יותר. בנסיבות אלה אנו מתקשים למצוא הצדקה להגשת הבקשה לביטול פסק-הדין במועד כה מאוחר, בקשה שמשמעות קבלתה היא, כפי שנלמד מפסק-הדין של השופטת ב' בר-זיו, ביטול מדעיקרא של הליכי ההסדר ופתיחת פתח לכל אדם לתבוע זכויות במקרקעין.
על-כן אני סבור כי יש לקבל את הערעור ולבטל את החלטתו של בית-המשפט המחוזי לבטל את פסק-הדין משנת 1975. עם זאת, בנסיבות העניין הייתי מורה כי כל צד בערעור זה יישא בהוצאותיו.
