בקשה למחיקת הערעור על הסף
החלטה
לפני בקשה מטעם המערערים למחיקה על הסף של ערעור שכנגד שהוגש על-ידי המשיבים 4-1, 10-7 ו-14 ( להלן: המשיבים ).

בקשת המערערים מתבססת על טענתם לפיה הערעור שכנגד הוגש על-ידי המשיבים באיחור. לטענתם, המועד הקבוע בדין להגשת ערעור שכנגד נמנה מיום המצאת הודעת הערעור לבעל הדין שכנגד. על פי הנטען, הערעור שכנגד הוגש 44 יום לאחר שהודעת הערעור הומצאה לאחרון המשיבים ופרק זמן ארוך אף יותר לגבי כל אחד מהמשיבים האחרים. לפיכך, כך הטענה, הוגש הערעור שכנגד לאחר המועד הקבוע בדין ודינו להימחק.

דין הבקשה להידחות. לעניין טעמי דחייתה, אין לי אלא לחזור על האמור בתגובת המשיבים. על פי הדין וההלכה הקיימים, המועד להגשת ערעור שכנגד נמנה מעת המצאת ההודעה על הפקדת ערבון או ערובה או מעת המצאת החלטת הרשם לפטור את יוזם ההליך מהפקדת ערבון (ראו: תקנות 434 ו-420 לתקנות סדר הדין האזרחי, התשמ"ד-1984; כן ראו: י' זוסמן סדרי הדין האזרחי (מהדורה 7, בעריכת ש' לוין, 1995) עמ' 842; בש"א 814/03 דוד וובר נ' בנק דיסקונט לישראל בע"מ , תק-על 2003 (2) 834). תכליתו של הסדר זה, כפי שהובהר לא אחת בפסיקה, הוא לייעל את הדיון על-ידי מניעת הגשת הליכים אשר יתכן ויסתברו בדיעבד כמיותרים. בנסיבות המקרה דנן, לפי הנטען בתגובת המשיבים, ההודעה על המצאת ערבון הומצאה לראשון המשיבים ביום 17.4.06. הערעור שכנגד הוגש ביום 17.5.06. בהתחשב בפגרת הפסח, אין ספק כי הערעור שכנגד הוגש בתוך סד המועדים הקבוע בדין להגשת ערעור שכנגד.

לאחר קבלת תגובת המשיבים, ביקשו המערערים להתיר להם להגיש תשובה לתגובה. בקשתם זו התבססה על שני אדנים. ראשית , לטענתם, בקשתם למחיקת ההליך על הסף התבססה על חלופה אחת להמצאת הערבון, ויש באמתחתם טענות נוספות לגבי "פגמים אמיתיים" שנפלו בהגשת הערעור שכנגד. שנית , המערערים סבורים כי ככל שתגובת המשיבים מתבססת על ההלכה הקיימת, הלכה זו יסודותיה רעועים, והם מבקשים שתינתן להם ההזדמנות לטעון בדבר הצורך בהפיכתה.
אף דינה של בקשה זו להידחות. ככל שהיו למערערים טענות נוספות לגבי פגמים שנפלו כביכול בהגשת הערעור שכנגד, היה עליהם לכלול טענות אלה במסגרת בקשתם המקורית. אין לשעות כעת לבקשתם לערוך בבקשה זו "מקצה שיפורים". אשר לבקשה למתן זכות טיעון לגבי ההלכה הקיימת בעניין המועד לתחילת מניין הימים להגשת ערעור שכנגד, דומה כי הלכה זו מעוגנת היטב בתקנות סדר הדין האזרחי, התשמ"ד-1984, וכי הגיונה שריר וקיים וטרם נס ליחו. מכל מקום, אף אם סבורים המערערים אחרת, אין מקום להרהר אחר הלכה מוש רשת זו במסגרת דיון הנערך לפני הרשם, אשר מחויב לפעול לפי ההלכה הקיימת (ראו: סעיף 20(ב) לחוק יסוד: השפיטה). התוצאה היא, שהבקשה לדחייה על הסף נדחית. המערערים ישאו בהוצאות המשיבים בסכום כולל של 2,500 ₪ אשר ישאו הפרשי ריבית והצמדה מעת המצאת החלטה זו ועד למועד התשלום בפועל.
