בקשות להפחתת סכום עירבון ולאיחוד דיון
החלטה
המערערים בהליכים שבכותרת עותרים להפחתת סכום העירבון, אותו העמידה המזכירה הראשית על סך של 40,000 ש"ח בכל אחד מההליכים. על פי הנטען יש להעמיד את העירבונות בשני ההליכים יחדיו על הסכום שנקבע שכן הם מופנים כלפי אותו פסק דין ובנוסף למעשה לשני ההליכים משיבה אחת בלבד (המשיבה 1, עירית הוד השרון). המערער בע"א 219/15 אף טוען כי המשיבה 2 מתעתדת להגיש ערעור מטעמה, וכי לאחר שזה יוגש ראוי כי הסכום האמור (40,000 ש"ח) יתחלק בין שלושת ההליכים.
עיינתי בטענות הצדדים ולא מצאתי להיעתר לבקשה במלואה.
אף אם מתבקש סעד מן המשיבה 1 בלבד (והגם שלעיתים לא זהו המבחן הבלעדי בשאלת החיוב בהוצאות), הרי שמשהוגשו ערעורים נפרדים תדרש המשיבה 1 להשיב לכל אחד מהם, ולא ניתן לקבוע בשלב מקדמי זה כי התוצאה של כל אחד מן הערעורים תהיה זהה. על כן ראוי לקבוע בכל אחד מן ההליכים עירבון נפרד אשר יש בו לשקף את מהות ההליך והיקפו, תוך מתן משקל מסוים להליך הנוסף המופנה כלפי אותו פסק דין.
לאחר שהבאתי בחשבון את כל השיקולים השונים הצריכים לעניין, ובהם גם מהות ההליך ופערי הכוחות בין הצדדים וכן העובדה שלא נפסקו הוצאות במסגרת ההליך קמא, החלטתי להעמיד את העירבון בכל אחד מן הליכים על סך של 30,000 ש"ח. עירבונות כאמור יופקדו בתוך 14 ימים מיום המצאת החלטתי זו, ולא - יירשם ההליך בו לא יופקד עירבון לדחייה.
עם השלמת הפקדת העירבונות כאמור מתבקש היומן לקבוע את ההליכים שבכותרת לשמיעה באותו מועד ובפני אותו הרכב .
