ערעור וערעור שכנגד על פסק דינו של בית המשפט המחוזי מרכז-לוד (השופט צ' ויצמן ) מיום 5.2.2018 בת"א (מרכז-לוד) 49338-12-11 מ.ס נ' א.ש , במסגרתו נפסקו למערערת פיצויים בתביעה על פי חוק הפיצויים לנפגעי תאונות דרכים, התשל"ה-1975.

המערערת, ילידת 1990, נפצעה בשנת 1999, בהיותה בת 9.5, בתאונת דרכים, כאשר ניסתה לרדת מאוטובוס ודלת כלי הרכב נסגרה עליה. המערערת הגישה תביעה לפיצוי בגין הנזקים שנגרמו לה, עוד בהיותה קטינה, אך ההליך נמחק על ידיה מספר פעמים ובמספר ערכאות.
במסגרת הדיונים בעניינה של המערערת מונו מומחים במספר תחומים, ונכותה הרפואית המשוקללת הועמדה על 28.72% כלהלן: בתחום הפלסטי והאורטופדי – 20% (המומחה בתחום האורטופדי קבע כי הצלקות ברגלה של המערערת הן בתחום הפלסטי ולא האורטופדי); בתחום כלי דם – 1%; בתחום הנפשי – 10%. אציין כי המערערת נבדקה על ידי המומחים בתחום הפלסטי ובתחום הנפשי פעמיים, בפעם הראשונה מספר שנים לאחר התאונה בהיותה עדיין קטינה, ובפעם השנייה בהיותה בגירה.

בית המשפט העמיד את נכותה התפקודית של המערערת על 15% ובהתאם לכך חישב את נזקיה, והעמיד את סכום הפיצוי הכולל על 811,000 ₪ על פי הפירוט להלן: אובדן השתכרות לעבר ולעתיד - 543,200 ₪; פנסיה - 65,200 ₪; עזרת צד ג' לעבר ולעתיד - 30,000 ₪; נסיעות - 30,000 ₪; דיור - 20,000 ₪; הוצאות שיעורי עזר – 5,000 ₪; הוצאות רפואיות ואביזרים - 15,000 ₪; כאב וסבל -
102,600 ₪.
על פסק הדין נסב הערעור והערעור שכנגד.

המערערת לא הניחה ידה מכל ראש נזק ומכל קביעה של בית משפט קמא, משל יושבת ערכאת הערעור במקומה של הערכאה הדיונית. זאת, בניגוד להלכה לפיה בית משפט שלערעור אינו נוטה להתערב בגובה הפיצויים שנפסקו על ידי הערכאה הדיונית, למעט במקרים חריגים בהם הפיצוי חורג למעלה או למטה מהפיצוי הכולל הראוי בנתוני התיק (לקווים המנחים לגבי התערבות ערכאת ערעור בתיקי נזיקין ראו ע"א

אקדים ואומר, כי פסק דינו של בית המשפט קמא הוא בבחינת דבר דבור על אופניו. בית המשפט התייחס בפירוט לכל טענה וטענה ולכל ראש נזק, ולא מצאתי ממש בטענות המערערת לגבי ראשי הנזק השונים.
כך, לדוגמה, נטען על ידי המערערת (בתגובה שהוגשה לאחר הדיון), כי האורתופד מצא בשנת 2002 כי קיים דלדול שרירים. ברם, האורתופד גם קבע בחוות דעתו כי הנכות היא בתחום הפלסטי בלבד.

על אף שהמערערת הייתה בת 9.5 בעת התאונה, נטען כי היה על בית המשפט קמא לחשב את הפסד ההשתכרות לפי בסיס חישוב גבוה מזה של השכר הממוצע במשק, כי עובר לתאונה רצתה להיות רופאה ולעסוק בתחום זה. טענות מעין אלה אך מעידים על קלישותו של הערעור. מנגד, המבטחת (המערערת שכנגד), עתרה להפחתת הפיצוי שנפסק למערערת בגין הפסדי שכר בעתיד, נוכח השתכרותה של המערערת, שהיא כיום בת 28, העומדת על כ-6,500 ₪ נטו לחודש. לשיטת המבטחת, יש בכך כדי להעיד על נתוניה של המערערת, ועל כך שהיה על בית משפט קמא לערוך את החישוב לפי שכר הנמוך מהממוצע במשק.
טענה זו דינה להידחות. הפסיקה חזרה וקבעה כי ככלל אין "מקום לסטות מההלכה לפיה יש להעמיד את בסיס השכר של קטינים בכלל, וקטינים-ילדים בפרט, על השכר הממוצע במשק" (ע"א 3573/12 כלל חברה לביטוח בע"מ נ' פלוני , בפסקה 8

המערערת הלינה על כך שבית המשפט קמא העמיד את הנכות התפקודית על 15% בלבד, ואילו המבטחת טענה כי יש להפחית משיעור הנכות התפקודית, וכי זו מגולמת לכל היותר בנכות נפשית בשיעור של 10%.
איני סבור כי בית המשפט קמא קיפח את המערערת בהעמידו את הנכות התפקודית על 15%. מחוות הדעת בתחום הנפשי עולה כי הנכות בשיעור 10% שנקבעה על ידי המומחה בתחום הנפשי, נקבעה לשם הזהירות, והמומחה העריך כי כיוון שנגרמה למערערת נכות גופנית בגיל צעיר "סביר להניח שהערכתה העצמית והדימוי העצמי שלה נפגעו", זאת, על אף ש"במציאות החיצונית אין לכך ביטוי בפגיעה בתפקודה המקצועי או החברתי". מכל מקום, הלכה עמנו, כי קביעת הנכות התפקודית היא מהנושאים המובהקים המסורים לשיקול דעתה של הערכאה הדיונית. בשורה התחתונה, איני רואה אפוא להתערב בשיעור הנכות התפקודית, לא כלפי מעלה כטענת המערערת ולא כלפי מטה כטענת המבטחת.

סוף דבר שהערעור והערעור שכנגד אינם מגלים עילה להתערבות ערכאת הערעור והם נדחים בזה. לאור תוצאה זו, לא ייעשה צו להוצאות.
