השופט י' עמית :

שני ערעורים מאוחדים על פסק דינו של בית המשפט המחוזי בתל אביב (כב' השופט נ' ישעיה ) מיום 21.2.2008, בגדרו נפסקו למערערת בע"א 2269/08 (להלן: אורנה ), ילידת 1955, ולבתה, ילידת 1988 (היא המשיבה 1 בע"א 3597/08; להלן: הקטינה ) פיצויים מכוח חוק פיצויים לנפגעי תאונות דרכים, תשל"ה-1975, בגין שתי תאונות דרכים שאירעו בהפרש של כארבע שנים זו מזו.
ביום 13.7.1995 ארעה תאונת דרכים, שכתוצאה ממנה נפגעה הקטינה ונהרג אחיה התאום (להלן: התאונה הראשונה ). ביום 4.11.1999 ארעה תאונת דרכים נוספת, שכתוצאה ממנה נפגעו האם והבת הקטינה (להלן: התאונה השניה ).

קמא מינה מספר מומחים לבחינת עניינן של השתיים. המומחית מטעם בית המשפט בתחום הנפשי, העמידה את נכותה של הקטינה בתחום הנפשי על 15% בשל התאונה הראשונה הן בשל הפגיעה הנפשית שלה עצמה בעקבות התאונה והן בשל תגובת האבל הפתולוגי כתוצאה ממות אחיה, ועל 5% נוספים בשל התאונה השניה. את נכותה של האם אורנה העמיד המומחה מטעם בית המשפט על 20% בשל תגובת אבל פתלוגית. בנוסף, נקבע על ידי מומחה בתחום האורטופדי כי לאורנה נותרה נכות בתחום האורטופדי בשיעור של 5% בגין התאונה השניה.

לעניינה של הקטינה: באשר לתאונה הראשונה בית משפט קמא חישב את נזקיה של הקטינה, שביני לביני סיימה את לימודיה בתיכון עם בגרות מלאה והתגייסה לצבא, לפי הפסד השתכרות של 15% מהשכר הממוצע במשק. זאת נוכח עמדת המומחה מטעם בית המשפט ובעקבות רע"א 444/87 אלסוחה נ' עזבון המנוח דוד דהאן ז"ל , פ"ד מד(3) 397 (1990) (להלן : אלסוחה ), שהיא ההלכה המנחה בסוגיה זו. בנוסף, נפסק פיצוי בגין כאב וסבל וכן הסך של 50,000 ₪ כסכום גלובלי בגין טיפולים נפשיים.
באשר לתאונה השניה, בגינה נקבעה לקטינה נכות נפשית בשיעור של 5%, נפסק פיצוי גלובאלי בסך 50,000 ₪ עבור הפגיעה הפוטנציאלית בכושר השתכרותה בעתיד.

לעניינה של אורנה: באשר לתאונה הראשונה פסק בית משפט קמא סכום גלובלי של 150,000 ₪ בגין הפסד שכר בעתיד. זאת, בהתחשב בכך שעובר לתאונה עבדה כמורה מחליפה בהיקף קטן מאוד של משרה, ולמעשה כמעט שלא עבדה מזה שנים לפני התאונה והקדישה את זמנה לטיפול בילדיה (למערערת שני ילדים נוספים שאחד מהם נולד זמן קצר לפני התאונה והשני לאחר התאונה). בנוסף, נפסק סכום של 30,000 ₪ בגין הוצאות רפואיות וכן כאב וסבל על פי השיעור הקבוע בחוק. אשר לתאונה השניה, נקבע כי לא הוכחה פגיעה גופנית או מגבלה שנגרמה לה כתוצאה מהתאונה, ולכן לא נפסק לה פיצוי בגין התאונה השניה.

בערעור ובערעור שכנגד הלינו הצדדים על שיעורי הפיצוי שנפסקו.
המערערות בע"א 3597/08 הלינו על כך שנפסק בכלל פיצוי לקטינה. לטענתן, טעה בית משפט
קמא משקבע שמצבה הנפשי של הקטינה נכנס לגדרי הלכת אלסוחה , לאחר שהוכח כי היא מתפקדת כרגיל והשתלבה היטב בתיכון ובצבא. בגין התאונה הראשונה נקבע כי לקטינה נותרה נכות של 15% בתחום הנפשי, כאשר חלק מנכות זו יש לייחס לפגיעה הישירה שלה בעקבות התאונה וחלק לפגיעה עקיפה בעקבות מות אחיה, ולכן התנאי הרביעי בהלכה שנקבע בהלכת אלסוחה לא מתקיים בענייננו. מנגד, אורנה הלינה על מיעוט סכום הפיצוי שנפסק לזכותה בגין הפסדי השתכרות בעתיד, ועל כך שלא נפסק לזכותה פיצוי בגין עזרת צד ג'. בא כוחה של אורנה אף הזמין את בית המשפט להתערב בגבולות הלכת אלסוחה .

לאחר ששמענו את טיעוני הצדדים וקראנו את החומר שהונח בפנינו, מצאנו כי אין מקום להתערב בפסק הדין. אין בנסיבות העניין שבפנינו להצדיק עיון מחדש בהלכת אלסוחה, אשר הועמדה שוב על מכונה בע"א 9466/05 שווקי נ' מדינת ישראל (לא פורסם, 16.3.2008). הסכומים שנפסקו אינם חורגים מהמקובל בנסיבות העניין. לאור עברה התעסוקתי של אורנה, הסכום שנפסק בגין הפסדי השתכרות בעתיד הוא סביר גם על פי חישוב אריתמטי כזה או אחר שניתן לעשות, ומכל מקום, אין דרכה של ערכאת ערעור להגדיל או להפחית באופן לא משמעותי את סכום הפיצוי (לדרכה ולשיקוליה של ערכאת הערעור בתיקי נזיקין ראו ע"א 741/10 כהן נ' צים חברת השיט הישראלית בע"מ (לא פורסם, 12.10.2010)).

אשר על כן, אנו דוחים את שני הערעורים, למעט תיקון אחד בפסק הדין שהיה מוסכם על המבטחת בתאונה השניה (היא המשיבה 3 בע"א 2269/08), ולפיו ישולם לאורנה הסך של 15,000 ₪ בגין כאב וסבל עבור התאונה השניה, באשר דומה כי נשמטה מעיני בית המשפט
העובדה כי נקבעה לה נכות בשיעור של 5%.
בכפוף לכך, נדחים שני הערעורים ללא צו להוצאות.
