בקשה לפטור מעירבון
החלטה

לפני בקשה לפטור מהפקדת עירבון בסך 25,000 ₪ שנקבע בהליך שבכותרת. עניינו של ההליך בהשגת המבקשת על החלטת בית המשפט המחוזי לחייבה בתשלום שכר-טרחתו של המומחה שמונה על-ידי בית המשפט (מנהל המשיבה 1), זאת בטרם בא ההליך אל קיצו ובניגוד - כך נטען - להסכמים ולהחלטות קודמות.
בבקשה שלפניי טוענת המבקשת כי ביום 26.1.2010 ניתן כנגדה צו פירוק וכי אין ביכולתה להפקיד את העירבון שנקבע. לטענתה, עקב התנהלותן של המשיבות 3-2, ומשלא קיבלה תשלומים המגיעים לה עבור עבודתה בפרויקט נשוא ההליך, היא נקלעה למצב של חדלות פירעון ובעת הזו אין לה פעילות או נכסים כלשהם. המבקשת גורסת כי סיכויי ההליך גבוהים מטעמים שונים, ובהם היות החלטתו של בית המשפט קמא מנוגדת להסכם שכר-טרחה שקיבל תוקף של פסק-דין ולהחלטות שיפוטיות קודמות. ראוי לציין כבר עתה כי לבקשת הפטור לא צורף תצהיר-תומך וזאת "לאור עזיבתו של מנהל המבקשת מר רונן קבלרו לחו"ל". המבקשת סבורה כי די בנתונים העולים מן האסמכתאות שצורפו לבקשה, ובהפניית בית המשפט לתצהיר שניתן בהליך אחר; דא עקא, שגם תצהיר אחרון זה לא צורף למעשה לבקשה.

המשיבה 1 סבורה כי דין בקשת הפטור להידחות על-הסף משום שאיננה נתמכת בתצהיר. זאת ועוד, המשיבה מטעימה כי לא הובא בבקשה כל פירוט בדבר ניסיונות המבקשת לגייס מימון "מקרוביה" ובכלל זה מבנק איגוד שהוא הנושה העיקרי. המשיבה מוסיפה וטוענת כי המבקשת לא הציגה תמונה מלאה ומפורטת בדבר מצבה הכלכלי וכן לא פרטה אודות מצבו הכלכלי של מר רונן קבלרו, הוא המערער 2. אליבא דהמשיבה, סיכויי ההליך הערעורי קלושים. המשיבה סבורה כי העובדה שהמבקשת טרם שילמה את שכר טרחתו של המומחה היא-עצמה מטילה נטל מוגבר בכל הנוגע להוכחת קיומה של הצדקה לפטור מהפקדת עירבון בבית משפט זה. יצוין כי המשיבות 2 ו- 3 לא הגיבו לגוף הבקשה, וכי המשיבה 4 הותירה את הנושא לשיקול הדעת של בית המשפט.
לאחר שעיינתי בטענות הצדדים באתי לכלל מסקנה כי דין הבקשה לפטור מעירבון להידחות; עם זאת מצאתי הצדקה להפחתה מסוימת בגובה העירבון.

על בעל-דין המבקש פטור מהפקדת עירבון, תוך חשיפת בעל-הדין שכנגד לסיכון כי הוא לא יוכל לגבות הוצאות שייפסקו לו (אם אמנם ייפסקו), לעמוד בשני תנאים מצטברים: הוכחת חוסר יכולת כלכלית להפקיד את העירבון, וקיום סיכויים טובים להליך. כדי לעמוד בתנאי הראשון על מבקש הפטור לפרושֹ לפני בית המשפט תשתית עובדתית מלאה ועדכנית בדבר מצבו הכלכלי.
בענייננו, הבקשה לפטור מעירבון הוגשה על-ידי המערערת 1, ואין כל מידע באשר למצבו הכלכלי של המערער 2. מעבר לכך, המבקשת לא הניחה תשתית ראייתית מספקת לביסוס טענותיה בדבר מצבה הכלכלי. טענות המבקשת הן בעלות אופי כללי ביותר ולא הובא פירוט הולם בצידן. לא נטען ולא הובאה כל אסמכתא לכך כי קופת הפירוק ריקה. הבקשה אינה נתמכת בתצהיר מטעם מנהל המבקשת, או מטעם כל גורם אחר הקשור בה. תצהיר כזה, לוּ ניתן, עשוי היה לשפוך אור על מצבה הכלכלי של המבקשת. גם באסמכתאות שצורפו לבקשה אין משום תשתית עובדתית ראויה לצורך הבקשה שלפניי – מדובר על החלטה של בית המשפט המחוזי משנת 2003 שבה צוין דבר הפסקת פעילותה של המבקשת, ובמסמך המלמד כי ניתן צו פירוק כנגד המבקשת ביום 26.1.2010. נתונים אלה כשלעצמם אינם משרטטים תמונה מלאה באשר ליכולתה של המבקשת לעמוד בהפקדת העירבון כנדרש.

יתר על כן, על חברה בפירוק לפנות ל"סביבתה הקרובה", כגון בעלי מניותיה ומנהליה, בניסיון לגייס את כספי-העירבון (ראו רע"א 4108/08
חברת הזריחה עבודות אינסטלציה בע"מ נ' מנרב הנדסה ובנין (1983) בע"מ (לא פורסם, 14.9.2008)). "כבר נקבע כי כשם שמוטל על בעל דין בשר ודם להראות כי עשה מאמצים לגייס כספים מסביבתו הקרובה, כך – מתוך גזירה שווה – תיבחן יכולתה של חברה גם לפי העזרה או האשראי שהיא יכולה לקבל מאלה הקשורים והקרובים אליה" ( רע"א 371/05 מ. מזוז (1990) בע"מ נ' מדינת ישראל – משרד הבטחון (לא פורסם, 21.2.2005). בעניינו, מן הבקשה שלפניי לא ניתן ללמוד מי נמנה על "מעגל קרובי המבקשת", וממילא אין לדעת מה מצבם הכלכלי, האם נעשו אליהם פניות ומה הייתה התוצאה של פניות ככל שנעשו. גם האפשרות לפנות לנושים של המבקשת לא נזכרת בבקשה, ולעניין זה ראוי לציין כי בהחלטת בית משפט קמא נכתב כי בנק איגוד – הנושה העיקרי של המבקשת כנטען – הוא שצפוי לשאת בתשלום שכר טרחת המומחה.
לאור האמור, איני מוצא מקום למתן פטור מהפקדת עירבון וזאת אף מבלי להידרש לשאלת סיכויי הערעור. עם זאת, לאור השאלות המועלות בהליך והיקפו, ובמכלול הנסיבות, ניתן להסתפק בעירבון בסך 15,000 ₪. סכום זה יופקד תוך 21 ימים מעת המצאת החלטתי זו (ימי הפגרה יבואו במניין), שאם לא כן יידחה ההליך ללא צורך במתן התראה נוספת.
