המשנה לנשיאה א' ריבלין:
אלה עובדות המקרה בתמצית: בשנת 1998, בחודש אוגוסט, גיבשה ועדת היגוי של משרד הדתות תוכנית לפיתוח בתי עלמין בתל-רגב. שר הדתות דאז חתם בתאריך 2.9.1998 על תקנות בעניין זה – תקנות שירותי הדת היהודיים (מועצת בתי העלמין היהודיים בתל-רגב), התשנ"ח-1998 (להלן: התקנות ). התקנות פורסמו בקובץ התקנות בתאריך 20.9.1998, ומכוחן כוננה מועצת בתי העלמין תל-רגב. בתאריך 7.9.1998 חתם שר הדתות על כתב מינוי שלפיו מונה המשיב כחבר המועצה וכיושב הראש שלה (להלן: כתב המינוי הראשון ). יושם אל לב כי מינוי זה נעשה קודם לפרסום התקנות וקודם לבחירת חברי המועצה. כעבור שמונה חודשים לערך, בתאריך 24.5.1999, חתם השר לענייני דתות דאז על "כתב מינוי למועצת בתי העלמין היהודיים בתל-רגב" (להלן: כתב המינוי השני ). בכתב מינוי זה הודע למשיב על מינויו ליושב ראש במועצת בתי העלמין בתל-רגב, כאשר "דירוג השכר יהיה כיו"ר מועצה דתית". ביום 31.5.1999 חתם שר הדתות על הודעה בדבר הרכב המועצה והנהלתה, והודעה זו פורסמה בילקוט הפרסומים בתאריך 30.6.1999 (כפי שנדרש בהתאם לתקנה 9 לתקנות). בתאריך 30.9.2003 – חמש שנים לאחר החתימה על כתב המינוי הראשון – הוארך מינויו של המשיב בחמש שנים נוספות (בהתאם לסעיף 4(ב) לתקנות).
על-פי חוזר מנכ"ל משרד הדתות טבלאות השכר של ראש מועצה דתית שמונה עד ליום 30.11.1998 שונות מטבלאות השכר של ראש מועצה שמונה לאחר תאריך זה. מכאן השאלה: האם לצורך חישוב השכר יש לראות במשיב כמי שמונה לתפקידו בתאריך 7.9.1998 (כפי שטוען המשיב) או שמא כמי שמונה בתאריך 24.5.1999 (כפי שטוענת המערערת).
בית המשפט המחוזי קיבל את עמדתו של המשיב ועל כך משיגה המערערת לפנינו. חרף הקושי המעשי המתעורר במקרה זה לא ראינו מנוס מקבלת הערעור. השאלה המרכזית נוגעת לנפקותו ולתוקפו של כתב המינוי הראשון, מתאריך 7.9.1998. עמדתנו היא שכתב מינוי זה לא היה בו כדי לכונן את מינויו של המשיב כיושב-ראש המועצה.
כאמור, מועצת בתי העלמין היהודיים בתל רגב הוקמה מכוח תקנות שנחתמו
ביום 2.9.1998 ופורסמו ביום 20.9.1998. סעיף 1 לתקנות מקים את המועצה, סעיף 3 קובע שהשר ימנה את חברי המועצה, וסעיף 4 מורה שהשר ימנה יושב ראש למועצה מבין חבריה. תקנה 9 מוסיפה ומורה כי הודעה על הרכב המועצה וההנהלה תפורסם ברשומות.
כתב המינוי שהוצא ביום 7.9.1998 מבוסס על הסמכות המוקנית לשר לענייני דתות בתקנות (שהוא עצמו חתם עליהן מספר ימים קודם לכן). ככתוב בכתב המינוי: "בתוקף סמכותי שעל פי תקנות 3 ו- 4 לתקנות שירותי הדת היהודיים (מועצת בתי העלמין היהודיים בתל רגב), התשנ"ח-1998, הנני למנות את מר שלום לוי ת.ז. 043295211 כחבר מועצת בתי העלמין בתל רגב ויושב ראש המועצה". דא עקא, שבאותו מועד טרם פורסמו התקנות ברשומות ועל כן טרם הוקנתה לשר הדתות סמכות למנות את המשיב לתפקיד יושב ראש המועצה. לא יכולה להיות מחלוקת כי מ דובר בתקנות בנות פועל תחיקתי, שהרי גלומה בהן קביעת נורמה משפטית (באשר להקמת מועצת בתי העלמין בתל-רגב, באשר לתפקידיה של המועצה ובאשר למינוי חבריה), והן מופנות לציבור בלתי-מסוים (ראו ע"פ 213/56 היועץ המשפטי לממשלה נ' אלכסנדרוביץ , פ"ד יא(1) 695). תקנות בנות-פועל תחיקתי חייבות פרסום ברשומות (סעיף 17 לפקודת הפרשנות [נוסח חדש]; להלן: פקודת הפרשנות ). במקרה הרגיל הפרסום הוא תנאי חיוני לכניסתה של התקנה לתוקף (ראו בג"ץ 4950/90 פרנס נ' שר הביטחון , פ"ד מז(3) 36, 42). ודוק: המשיב גורס כי כתב המינוי בעניינו אינו בגדר תקנה בת-פועל תחיקתי, ובכך הוא בוודאי צודק, אולם ענייננו כאן בתקנות המקימות את המועצה שהן בנות תוקף תחיקתי, ושמועד פרסומן ברשומות הוא מועד כניסתן לתוקף. מכאן, שכאשר נחתם כתב המינוי הראשון טרם נתכוננה המסגרת הנורמטיבית למינוי וטרם נוצרה סמכותו של השר לבצע את המינוי.
המשיב מפנה לסעיף 19 לפקודת הפרשנות, שלפיו "חיקוק שאין תחילת תקפו עם נתינתו, והוא מעניק סמכות להתקין תקנות או לעשות מינוי או כל דבר למען מטרת החיקוק, אפשר להשתמש באותה סמכות – אם אין כוונה אחרת משתמעת – בכל שעה לאחר נתינתו של החיקוק, במידה שהדבר נראה דרוש או ראוי כדי להפעיל את החיקוק ביום תחילת תקפו". אלא שבמקרה זה לא הועלתה טענה משכנעת, לבד מאמירה בעלמא, מדוע היה זה דרוש או ראוי להקדים את המינוי לתחילת תוקפן של התקנות. אדרבא, וכפי שאפרט מיד, מן החומר שלפנינו עולה שהדבר לא היה דרוש כלל, שהמשיב היה מצוי באותה עת בעבודה אחרת, ושכעבור חודשים נחתם כתב מינוי שני.
אכן, במקרים מסוימים אפשר שתימצאנה הדרכים המשפטיות "להתגבר" על קושי מהסוג הנדון אולם מקרה זה אינו נכלל בהם. המסקנה שלפיה כתב המינוי מיום 7.9.1998 הקדים את זמנו נתמכת במספר נתונים נוספים: כתב מינוי זה ניתן בטרם התמנו חברי המועצה – שמביניהם, לפי דבר התקנות, ימונה היושב-ראש – ולאחריו לא נעשה פרסום כלשהו ברשומות בדבר הרכב המועצה וההנהלה, כדרישת תקנה 9. אף מבלי לבחון את נפקותו הקונסטיטוטיבית או הדקלרטיבית של הפרסום לפי תקנה 9, היעדר הפרסום ברשומות לגבי הרכב המועצה וההנהלה מחזק את הרושם כי כתב המינוי הראשון בא בטרם עת-משפטית. נסיבה נוספת רלבנטית היא שבמועד האמור – ועד ליום 15.7.1999 – היה המשיב מועסק במשרד לענייני דתות, במשרה מלאה, כיועץ השר לענייני בתי כנסת ומקוואות, וזאת על-פי חוזה מיוחד.
על רקע זה בא כתב המינוי השני מתאריך 24.5.1999 שבו הודיע השר לענייני דתות, לפי סמכותו הקבועה בסעיף 3 לתקנות, על מינויו של המשיב ליושב ראש במועצת בתי העלמין היהודיים בתל רגב; "דירוג השכר" – כך נכתב – "יהיה כיו"ר מועצה דתית". אכן, במועד שבו נחתם כתב המינוי השני עדיין לא נחתמה הודעה בדבר הרכב המועצה – הדבר נעשה כשבוע לאחר-מכן. עם זאת, כתב המינוי השני נעשה לאחר כניסתן של התקנות לתוקף ובסמוך לקביעת הרכב המועצה כולו. המדינה גורסת כי אם היה מקום להחיל את דוקטרינת הבטלות היחסית במקרה זה – כשהמשמעות היא להותיר בתוקף את המינוי חרף פגמים שנפלו בהליך – הרי זה ביחס לכתב המינוי השני אך לא ביחס לכתב המינוי הראשון. איני רואה צורך להכריע בעניין זה אולם די באמור כדי להוביל למסקנה כי כתב המינוי הראשון היה בגדר "קדימון" ללא תוקף משפטי. יודגש כי רק ביום 23.6.1999, לראשונה, נקבע שכרו של המשיב.
לא אכחד כי התנהלות המדינה במקרה זה תמוהה משהו, ונוצרה אי-נוחות לנוכח העמידה המאוחרת מצדה על עניינים שהיה בידי רשויותיה להסדיר זמן רב קודם לכן. אכן, המחדלים הם בעיקרם מחדלי המדינה. גם המינוי השני לוקה בפגמים. אולם, ככל שמ דובר בשאלה האם מינויו של המשיב היה בר תוקף קודם לתאריך 30.11.98 – הרי שאין מנוס מלהשיב בשלילה על שאלה זו.
לכן, הערעור מתקבל. פסק-הדין של בית-המשפט המחוזי מתבטל. בנסיבות העניין ובשל התנהלות המדינה אין לזכותה בהוצאות משפט.
