הוגש הליך
החלטה
אגב הטיפול בהליך שבכותרת, התעוררה שאלה בדבר הדרך הדיונית הראויה להשיג על ההחלטות נשוא ערעור זה.
על פני הדברים נראה, כי שתי ההחלטות עליהן משיגה המערערת אינן מהוות "צו בפשיטת רגל" (סעיף 182(א) לפקודת פשיטת הרגל [נוסח חדש], התש"ם-1980). זאת, שכן אין מדובר בהחלטות אשר ניתנו על ידי בית המשפט במסגרת הפעלת סמכותו המיוחדת כבית משפט של פשיטת רגל (אלא בהחלטות בעלות אופי דיוני הנשענות על עקרונות משפט כלליים). משכך, יש לבחון את אופן ההשגה עליהן על פי ההבחנות הרגילות הנוהגות בהליכים אזרחיים (למשל, רע"א 4746/11 גרוזמן נ' כונס הנכסים הרשמי (26.10.2011)). דומה, כי ההחלטה הראשונה עליה משיגה המערערת מהווה "פסיקתא משקפת" ביחס להחלטה מיום 9.3.2014. כפי שנפסק, אופן ההשגה על פסיקתא מעין זו הינו על דרך של הגשת בקשת רשות ערעור (ראו, ע"א 3832/10 מיטרני נ' מחלוף (10.8.2010)). לגבי ההחלטה השנייה עליה משיגה המערערת: בין שניתן לראותה כהחלטה נוספת בעניין הפסיקתא, ובין כהחלטה לעיון חוזר, נראה שההשגה עליה טעונה אף היא רשות ערעור (ע"א 7671/04 נאמן לנכסי החייב זיסמן נ' עמינח תעשיות ורהיטים בע"מ (לא פורסם, 6.2.2005); ע"א 9736/10 ששון נ' כונס הנכסים הרשמי ירושלים
(15.2.2011)).
