א.
בקשה לעיכוב ביצוע פסק דינו של בית המשפט המחוזי בתל אביב
(סגן הנשיא זפט) מיום 30.4.08 בה"פ 1168/07.
ב.
העובדות הצריכות לענייננו,כעולה מפסק דינו של בית המשפט המחוזי ונספחי הבקשה,הן כדלקמן: המשיבה 1 ובעלה המנוח היו בעלים משותפים של בית מגורים בהרצליה. עם פטירתו של המנוח התנהל בין המבקש למשיבים משא ומתן למכירת הבית. בין הצדדים נחתם זכרון דברים לרכישתו תמורת 680,000$, ובאותו היום חתם המשיב 2 על יפוי כוח בלתי חוזר שניתן למבקש. באותו מעמד מסר המשיב 2 למבקש עותק מקורי של צו הירושה, לפיו ירשו המשיבים מחצית מהזכויות בבית (זכויות המנוח).
זמן מה לאחר מכן, הודיעו המשיבים כי אינם מסכימים למכירת הבית. על אף האמור, רשם המבקש – עורך דין – בפנקס המקרקעין את זכויות המשיבים על פי צו הירושה, והערת אזהרה לטובתו על זכויותיו של המשיב 2. המשיבים פנו לבית המשפט המחוזי בתביעה לביטול זכרון הדברים, מחיקת הערת האזהרה והצהרה כי נעשה ביפוי הכוח שימוש שלא כדין. השאלה המרכזית שעמדה לדיון בבית המשפט המחוזי היתה האם אמו של המשיב 2 (המשיבה 1) ואחיותיו (המשיבות 4-3) הסמיכו את המשיב
2 להתקשר עם המבקש בהסכם למכירת הבית.
ג.
בית המשפט המחוזי קבע כי לא הוצגה ראיה מספקת לביסוס הטענה לפיה המשיבה 1 והמשיבות 4-3 הסמיכו את המשיב 2 להתחייב בשמן למכירת זכויותיהן בדירה, וממילא ללא חתימתן לא השתכלל זכרון הדברים לכדי הסכם
מחייב. נקבע כי זכרון הדברים בטל וכי תימחק הערת האזהרה בנוגע לנכס והוצהר כי רישום צו הירושה והערת האזהרה נעשו שלא כדין, תוך שימוש שלא כדין

כוח
שנמסר למבקש על ידי המשיב 2. ועוד, גם סכום כסף שצריך היה להיות מופקד על-ידי המבקש לא הופקד. בקשה לעיכוב ביצוע פסק הדין נדחתה על ידי השופט זפט
ביום 18.5.08.
ד.
בבקשה נטען כי סיכויי הערעור גבוהים, שכן פסק הדין לוקה בטעויות עובדתיות, בין היתר הקביעה כי המבקש עשה שימוש שלא כדין בייפוי הכוח.
בנוסף
נטען, כי גם אם המשיב 2 אינו מוסמך לייצג את אמו ואחיותיו, אין בכך להביא לביטול זכרון הדברים ביחס לחלקו של המשיב 2 במקרקעין. כן שגה בית המשפט – כנאמר – משלא הכריע בטענת המבקש כי המשיבות

היו מוצגות על ידי בני זוגן במשא ומתן, ובכך שלא קבע, על יסוד חומר הראיות, כי המשיבה 1 הסמיכה את בנה (המשיב 2) לטפל בעבורה במכירת הנכס. כן נטען כי מאזן הנוחות נוטה לטובתו של המבקש, שכן אם תימחק הערת האזהרה עשוי הנכס להימכר לצד שלישי מחד גיסא, ואילו רישומה של הערת אזהרה אינו מכביד על המשיבים מאידך גיסא, שכן המשיבה 1 הצהירה בבית המשפט כי לעת הזאת אין בדעתה למכור את הנכס.

בתשובתם טוענים המשיבים כי סיכוי הערעור נמוכים ביותר, בין היתר בהסתמך על החלטת בית המשפט המחוזי מיום 18.5.08 בבקשה לעיכוב ביצוע, בה צוין כי סיכויי הערעור "מפוקפקים". יתרה מכך, נטען כי מאזן הנוחות נוטה לטובת המשיבים, שכן ברישומה של הערת אזהרה יהא משום פגיעה בזכויותיהם הקנייניות.
ו.
לאחר העיון בבקשה ובתגובות, אין בידי להיעתר לה. ראשית, מבחינת סיכויי הערעור, מבלי שאקבע מסמרות, המשוכה על פניה חפץ המבקש לחלוף גבוהה, שכן עיקר טענותיו בערעורו, גם לשיטתו, מופנה כנגד ממצאי עובדה ומהימנות, בהם אין בית משפט של ערעור נוטה להתערב, אלא במקרים חריגים (ע"א 1240,558/96 חברת שיכון עובדים נ' רוזנטל
פ"ד נב(4) 563, 569 (השופט גולדברג); (ע"א 4126/05 חג'אזי נ' עמותת ועד עדת הספרדים (לא פורסם)).
שנית, דומני שבהיבט הנוחיות והנזק, לא הצביע המבקש על טעמים מיוחדים המטים את הכף לעברו; עם כל טרונייתו – וכמובן בלא הבעת דעה לגופה - דומני, כי אין המ דובר בנזק בלתי-הפיך, והוא ניתן אם לא לאכיפה, למצער לפיצוי. ושוב – איני מביע דעה לעיצומו של התיק.
ז.
אין בידי, איפוא , להיעתר למבוקש.
