הוגש הליך
החלטה
בחירתם של המערערים להגיש הן בקשת רשות ערעור (רע"א 4766/11) הן ערעור בזכות (ע"א 5149/11) על אותו פסק-הדין של בית המשפט המחוזי (מיום 24.5.2011), נעוצה ככל הנראה בטענה כי פסק-הדין – שבו הוחלט על אישור פסק-בוררות – חתם את הדיון לא רק בבקשות לאישור או לביטול פסק הבוררות, אלא גם בתביעה אזרחית שצוינה בכותרת פסק-הדין (ת"א 2516/05).
אלא שעיון בתיק מגלה, על פני הדברים, כי טענה זו אין בה כדי להצדיק את הדרך הדיונית שבה צעדו המערערים.
פסק הדין של בית המשפט המחוזי עוסק, כל כולו, בבקשות לביטולו או לאישורו של פסק-הבוררות. בית המשפט קבע כי לא מתקיימת עילה לביטול פסק-הבוררות, והורה על אישורו של הפסק; גם כתב הערעור עוסק, כל-כולו, בהליך הבוררות ובהחלטה לאשר את פסק-הבוררות. אמת, בכותרת פסק הדין של בית המשפט המחוזי צוין גם ההליך ת"א 2516/05, ובגוף פסק הדין צוין כי מדובר ב"פסק דין סופי בערכאה זו בכל ההליכים שבכותרת". עם זאת, מכתב הערעור כלל לא ניתן להבין מהו בדיוק ההליך ת"א 2516/05, מי הגיש אותו ומה הקשר בינו לבין הליכי הבוררות. מכל מקום, כאמור, כתב הערעור גופו נסב על ההחלטה לאשר את פסק הבוררות, ובכגון דא קמה תחולה לסעיף 38 לחוק הבוררות, התשכ"ח-1938. יודגש כי אף המערערים, בהודעתם מיום 8.9.2011, מציינים כי הערעור שבכותרת כמעט זהה להליך רע"א 4766/11. הליך אחרון זה כבר החל להתברר, וכבוד השופט רובינשטיין הורה על הגשת תגובה.
בנסיבות אלה לא שוכנתי בקיומה של הצדקה עניינית לכפל הליכים, ומן הדין למחוק את ההליך שבכותרת, שאינו עולה בקנה אחד עם הוראת סעיף 38 הנ"ל. ההליך נמחק אפוא. משלא נתבקשה עמדה מטעם המשיב, אין צו להוצאות.
