החלטה
מעשה ב-18,623 מ"ר, שני אחים ו-4 אחיות. על פי הדין השרעי הזכר מקבל פי 2 מהנקבה. לכן, על פי צו הירושה כפי שהוצא בבית הדין השרעי, כל אחות נרשמה כבעלים של 2328 מ"ר ברוטו. אולם, המערערים טענו כי עוד לפני פטירתם, ההורים נתנו להם במתנה 8000 מ"ר, ולכן אם נפחית 8000 מ"ר נקבל 10623 מ"ר לחלק ל-8 = כל אחות צריכה לקבל 1328 מ"ר. מתברר שהמערערים אפילו אוחזים בפסקי דין המורים על רישום חלקיהם בהתחשב במתנה כאמור. אלא שלטענתם, בשל טעות, צווי הירושה נרשמו כפי שהם, כך שבמקום שכל אחות תירשם כבעלים של 1328 מ"ר בלבד, נרשמה כל אחת מהאחיות כבעלים של 2328 מ"ר. האחות-המשיבה 1 מכרה את חלקה הרשום למשיבה 5. הבעתי את דעתי הלכאורית, כי המקרה מתאים לסעיף 10 לחוק המקרקעין באשר ענייננו באדם שנרשם שלא כדין, אשר מכר לצד שלישי שהסתמך על הרישום. לכאורה, על פי הלכת הרטפלד
(מ"ט 3, 854), המשיבה 5 מפסידה בתחרות כי העסקה לא הסתיימה ברישום. אולם, לטעמי, צדק בית משפט קמא בכך שאמר שהנזק צריך ליפול לפתחם של המערערים מאחר שגרמו לתאונה המשפטית. בהקשר זה אציין כי המערערים גרמו בכמה הזדמנויות לאותה תאונה: לא רשמו את תצהיר המתנה; לא רשמו את פסקי הדין לזכותם, ומנגד, רשמו את צווי הירושה. לכן, הבעתי דעתי הלכאורית, כי טובים סיכוייה של המשיבה 5 מול המערערים. מובן, שאיני מביע דעתי לגבי היחסים בין האחות-המשיבה 1 לבין המשיבה 5 בתביעה המתנהלת ביניהן, שם נטען לתרמית הטעיה, וכיוצ"ב.
הצעתי אפוא למערערים לסגת מהערעור כנגד המשיבה 5 ואם וככל שהמשיבה 1 מעוניינת להמשיך כנגדה בהליך המשפטי, אין לכך קשר לתיק זה, בכפוף לאמור בהמשך.
לגבי האחיות הנוספות, הן המשיבות 4-2 – כאן ענייננו במצב בו לא חדר לתמונה צד שלישי, ולכך יש השלכות. הצעתי לצרכי פשרה, כי הערעור של המערערים כנגד המשיבות 4-2 יתקבל, ולצרכי פשרה בלבד, וכמובן מבלי שיראו זאת כעסקת מכר, ישלמו המערערים לכל אחת מהאחיות סכום של 160,000 ₪. אם המשיבה 1 תמשיך נגד המשיבה 5 בתביעה, ואם תזכה בתביעתה, אזי יחול לגביה האמור לגבי האחיות האחרות.
משסירב ב"כ המערערים להצעת בית המשפט אני מורה על העברת הערעור לדיון בפני הרכב.
