החלטה
בא-כוח המשיבים הגיש לאישורנו בקשה לאישור פסיקתה. ה"פסיקתה" שהוגשה במצורף לבקשה הינה מסמך בו שילב בא-כוח המשיב חלקים שונים מפסק דיננו בערעור.
אין יסוד לבקשה זו. פסיקתה, כמשמעותה בתקנה 198 לתקנות סדר הדין האזרחי, התשמ"ד -1984, הינה "תמצית של ההחלטה שניתנה המפרשת את ההכרעה ללא נימוקים" (יואל זוסמן, סדרי הדין האזרחי (מהדורה חמישית, בעריכת שלמה לוין , 1988) עמ' 481-480;
ע"א 26/88 שמאי נ' טפחות בנק משכנאות לישראל בע"מ פ"ד מב (2) 837, 839 (1988)). הדברים נלמדים גם מטופס 16 אליו מפנה תקנה 198 לתקנות סדר הדין האזרחי. בענייננו, ההכרעה האופרטיבית ברורה. התביעה בבית המשפט המחוזי נדחתה, הערעור עליה נדחה על ידנו והמערערת חויבה בתשלום שכ"ט עו"ד בסך 20,000 ש"ח. משנמצא שהמסמך שהוגש לאישורנו אינו פסיקתה, הבקשה לאשרו נדחית בזה.
