החלטה

לפניי בקשה לפטור מהפקדת ערבון בהליך שבכותרת, שנקבע לסך של 25,000 ₪. נטען בה כי המערערים הם חסרי יכולת כלכלית, הם מצויים בשנות השבעים לחייהם, אינם עובדים ומתפרנסים מקצבאות זקנה המספיקות בקושי לקניית תרופות ולהוצאות היומיום. המשיבה, המתנגדת לבקשה, העלתה טענה מקדמית ולפיה אין לבית המשפט סמכות לפטור את המערערים מחמת הפקדת ערבון, מששולמה אגרת הערעור במלואה כך שלא מתקיימים התנאים של תקנה 432 לתקנות סדר הדין האזרחי, התשמ"ד-194. המשיבה הוסיפה וטענה כי המערערים לא הוכיחו כי אין ביכולתם להפקיד את סכום הערבון. היא ציינה כי המערערים קיבלו מידיה, בהתאם לפסק דינו של בית המשפט המחוזי, סך של 332,000 ₪ כנגד פינוי הנכס שבו החזיקו ואשר הופקע על ידי המשיבה. כן ציינה המשיבה כי המערערים שילמו את סכום האגרה, מיוצגים על ידי עורך-דין ומשתכרים יחדיו בסך העולה על 5,000 ₪. המערערים, בתגובה לכך, טענו כי הכספים שקיבלו מהמשיבה שימשו לדיון חלופי בכל הכרוך בהוצאות העברת תכולה, ציוד וסידור והם אף נותרו חייבים סכומי כסף כתוצאה מהפינוי.

אדרש תחילה לטענה המקדמית שבפי המשיבה. כפי שנפסק לא פעם, אין בעצם העובדה כי לא נתבקש פטור מתשלום האגרה בכדי לשלול אפשרות להיזקק לבקשה לפטור מערבון (ראו, ע"א 10223/04 אוחנה חברה לאחזקות תיירות ותעשייה בע"מ נ' בנק דיסקונט לישראל בע"מ (לא פורסם, 6.1.2005)). סמכותו של הרשם לפטור מערער מהפקדת ערבון מעוגנת בתקנה 428 לתקנות, לפיה משהוגש כתב הערעור יקבע הרשם את סכום הערבון שעל המערער להפקיד ואת המועד להפקדתו. ברוח זו, כאשר הרשם דוחה את תשלום האגרה, כולו או מקצתו, חייב הוא מיוזמתו הוא וללא בקשה מיוחדת לכך לדון בשאלה אם יש לפטור את המערער גם מן החובה להפקיד ערבון (תקנה 432(א) לתקנות). אולם אין בהוראה זו כדי לסגור את הדלת בפני מערער ששילם אגרה מלפנות לרשם בבקשה לפטור מהפקדת ערבון או להפחתתו, מה גם שאמות המידה על פיהן נבחן עניין האגרה ועניין הערבון אינן זהות. מתן פטור מאגרה הוא ודאי שיקול רלוונטי, בכל הקשור בערבון אולם אין הכרח כי יינתן פטור מאגרה כדי ליצור סמכות לפטור מהפקדת ערבון (ראו, ע"א 5138/09 אקס פייב רוולושיין בע"מ נ' Bayrische Motores Werke
(לא פורסם, 4.11.2009)).

מכאן לבקשת הפטור גופה. לאחר עיון בעמדות הצדדים ובחומר המצוי בתיק, באתי לכלל מסקנה כי לא ניתן לפטור את המערערים מהפקדת ערבון. אמנם, המערערים זכאים לגמלת זקנה בתוספת השלמת הכנסה. הדבר משמש ראיה לכאורה לחוסר יכולת כלכלית לשלם אגרה (תקנה 14(ה) לתקנות בתי המשפט (אגרות), התשס"ז-2007) (להלן: התקנות). עם זאת, המערערים לא התכחשו לטענת המשיבה כי קיבלו ממנה סכומי כסף ניכרים. כל שנטען בתגובה לכך היה שהכספים שימשו לדיור חלופי. הדבר נטען ללא פירוט וללא תיעוד מינימלי. כך, לא הוסבר אילו שימושים נעשו בכסף, היכן מתגוררים כיום המערערים, ולא הוצגו הסכמים או קבלות בקשר לדיור החלופי. במצב דברים זה, נסתרת הראייה הלכאורית בדבר חוסר יכולת כלכלית ולא ניתן לפטור את המערערים מהפקדת ערבון. עם זאת, נוכח התשתית החלקית שהציגו ומעמדם היחסי של הצדדים, ובשים לב להיקפו הצר יחסית של ההליך, יופחת סכום הערבון לסך של 10,000 ₪. הערבון יופקד תוך 21 ימים ולא – יידחה הערעור ללא צורך בהודעה נוספת.
