המשנה לנשיאה א' ריבלין:

המערער 1 (להלן: המערער ) נהג ברכבו הפרטי בכביש בן עירוני. על-פי האמור בכתב התביעה שהגיש "כפי הנראה חש ברע והצליח לעצור בצד הדרך ואז איבד הכרתו". הוא חולץ מרכבו לאחר מספר שעות כשהוא סובל, בין השאר, ממכת חום והתייבשות. המערער תבע את נזקיו ממבטחת הרכב בו נהג ובין הצדדים נתעוררה מחלוקת בשאלה אם יש לראות בנזקי הגוף מהם סבל, אירוע של תאונת דרכים – כהגדרתה בחוק פיצויים לנפגעי תאונות דרכים, התשל"ה-1975 (להלן: החוק ), אם לאו.
התשובה לשאלה זו נדונה, בין השאר, על רקע המחלוקת העובדתית בשאלה האם נמצא המערער, על-ידי כוחות ההצלה, בתוך הרכב כשדלתותיו סגורות או שמא היה הרכב פתוח וחלק מגופו של המערער היה מצוי מחוץ לרכב.

בית-המשפט המחוזי הכריע במחלוקת העובדתית וקבע כי המערער נמצא בתוך רכב כשאחת מדלתותיו פתוחה – וכשמחצית מגופו מחוץ לרכב. בנסיבות אלה, כך קבע בית-המשפט, אין האירוע בו ניזוק מוגדר כתאונת דרכים כמשמעותה בחוק. בית-המשפט קבע כי ניתן לראות בעצירה שביצע המערער ברכב "כחלק אינטגרלי מהנסיעה" – בהיותה נסיעה לזמן קצר, וכי שימוש זה ברכב נעשה למטרות תחבורה. עם זאת, מצא כי לא נתקיים קשר סיבתי בין השימוש שעשה המערער ברכב לבין התוצאה המזיקה, שכן המדובר בקשר סיבתי עובדתי בלבד ואין התוצאה נופלת למסגרת הסיכון שהשימוש ברכב יוצר.
אף כי הפגיעה אירעה בעת שהתובע שהה ברכבו, הסיכון שגרם לפגיעה – כך נקבע בבית-המשפט המחוזי, אינו סיכון תעבורתי והרכב שימש אך זירה להתרחשות המזיקה.

כנגד פסק דינו של בית-המשפט קמא מלין המערער, הוא סבור כי לא היה מקום לקבוע כי הוא נמצא ברכב כשאחת מדלתותיו פתוחות וכי מחצית גופו נמצאה מחוץ לרכב על-ידי מי שבא לחלצו. לשיטתו, טעה בית המשפט המחוזי בקביעותיו העובדתיות, ומכל מקום, הוא סבור כי בעת אירוע הנזק עשה שימוש של נסיעה ברכב וכי נתקיים בעניין זה קשר סיבתי עובדתי ומשפטי בין השימוש שנעשה ברכב כאמור לבין התוצאה המזיקה.

דין הערעור להידחות.
ספק רב בעיניי אם ניתן לראות במערער כמי שעשה שימוש ברכב בעת שהיה מצוי בחניה, ובהיעדר טענה כי החניה הייתה במקום שאסור לחנות בו. מכל מקום, לא מצאנו עילה להתערב בקביעת בית-המשפט קמא כי המערער לא היה לכוד ברכב וכי לא נתקיים קשר סיבתי בין הימצאותו של המערער ברכב לבין הנזקים שהוסבו לו. נזקיו של המערער לא היו תולדה של הסיכון התחבורתי של השימוש ברכב. הרכב שימש, במקרה זה, אך כ"זירה" להתרחשות המזיקה, ובזירה זו הוא נמצא על-ידי אנשי העזרה הראשונה.
הערעור נדחה.
בהתחשב בנסיבותיו של המערער איננו עושים צו להוצאות.
