בקשה לפטור מעירבון
החלטה
לפני בקשה לפטור מהפקדת עירבון בהליך שבכותרת.

הערעור מופנה כנגד פסק-דין של בית המשפט המחוזי, שדחה את בקשת המערערים להצהיר כי נכס של שתי נפקדות נמכר על-ידן – עוד בטרם שהפכו לנפקדות – לאחיהן, וכי לפיכך אין למשיב, האפוטרופוס לנכסי נפקדים, זכות בנכס. בית המשפט המחוזי חייב את המערערים בשכר הטרחה של המשיב בסך 10,000 ש"ח.

במסגרת הערעור שהוגש לבית משפט זה ביקשו המערערים לפטור אותם מהפקדת עירבון. ביסוד הבקשה טענתם כי מצבם הכלכלי קשה וכי סיכויי הערעור גבוהים ביותר. הבקשה שהוגשה כללה פירוט רק לגבי מצבם הכלכלי של חלק מהמערערים. בעקבות החלטתי מיום 14.10.2009 השלימו המערערים את בקשתם על-ידי צירוף מסמכים נוספים. עם זאת, גם היום האסמכתאות התומכות בבקשה הן חלקיות ביותר, ולגבי מקצת מהמערערים עדיין אין אסמכתאות כלל. מהטענות שהועלו ומהמסמכים שהוצגו עולה כי חלק מהמערערים מקבלים גמלאות וקצבאות שונות, ויש מבין המערערים שמצבם הכלכלי אינו שפיר ומסמכי חשבון הבנק שלהם מעידים על יתרות חובה. עם זאת, אין זה בהכרח המצב לגבי המערערים כולם, שחלקם עובדים ומשתכרים סכומים כמפורט בבקשה ובאסמכתאות שצורפו. יצוין כי חסרה בבקשה ובאסמכתאות תשתית לגבי נכסים שבידי המערערים, ובמיוחד אין בסיס לקבוע כי אין באפשרותם של המערערים – כשלושים במספר – לגייס במאמץ משותף ותוך הסתייעות במעגל הקרובים והידידים, עירבון שיבטיח את הוצאות הצד שכנגד.
במצב דברים זה, אף מבלי להידרש לסיכויי הערעור, לא שוכנעתי כי יש מקום לפטור מלא מעירבון בתיק זה. עם זאת, בהתחשב במסמכים שכן הוצגו, בתגובת המשיב שהביע הסכמתו להפחתה מסוימת של סכום העירבון, ובשיעור ההוצאות שנפסק בבית המשפט קמא, יעמוד העירבון בהליך שבכותרת על סך של 10,000 ₪ בלבד. העירבון יופקד בתוך 21 ימים מיום המצאת החלטה זו, אחרת – יידחה ההליך בלא צורך בהודעה נוספת.
