בקשה לפטור מעירבון
החלטה

בפניי בקשה לפטור מהפקדת עירבון בהליך שבכותרת שעניינו ערעור על פסק דינו של בית המשפט המחוזי בנצרת אשר נתן צו האוסר על המערערת והמשיבה 3 לעשות פעולות בניה בנכס.
העירבון הועמד על סך של 40,000 ש"ח על ידי המזכירה הראשית. בבקשתה טוענת המערערת כי היא גוף ציבורי ללא כוונת רווח הפועלת לקידום מטרות חברתיות וחינוכיות, ובין היתר מנהלת ישיבת הסדר ומדרשה לבנות, והיא מוסיפה כי אם לא יינתן לה פטור מחובת הפקדת העירבון תיפגע פעילותה וכן יפגע הציבור הנהנה משירותיה. כן טוענת המערערת כי סיכויי הערעור טובים; כי בית המשפט קמא לא חייב אותה בהוצאות; וכי בא כוחה מייצג אותה ללא תמורה.

דין הבקשה להידחות.
המערערת אינה טוענת בבקשתה כי אין באפשרותה להפקיד עירבון בהליך, וממילא לא הוכיחה טענה כזו. טענתה לפיה בהפקדת העירבון יהיה כדי לפגוע בפעילותה אין בה די בהקשר זה שכן משבחרה המערערת להשיג על פסק דינו של בית המשפט קמא חובה עליה, ככל בעל דין היוזם הליך ערעורי, להפקיד עירבון להבטחת הוצאות המשיבים
- אלא אם הוכיחה התקיימותם של התנאים למתן פטור מהפקדתו: חוסר יכולת כלכלית וסיכויים טובים להליך - ומכל מקום דומה כי גם טענתה לפגיעה בפעילותה לא הוכחה על ידה כדבעי. בהינתן האמור ומשהמבקשת עצמה אינה טוענת להתקיימותו של אחד מן התנאים למתן הפטור המבוקש, אין בידי להיעתר לבקשתה והיא נדחית, אפוא.
