בקשה לפטור מהפקדת עירבון
החלטה

המערערים עותרים לפטור מהפקדת עירבון בהליך שבכותרת שכן לטענתם אין להם אפשרות כלכלית להפקיד עירבון בשיעור שנקבע על ידי המזכירה הראשית - סך של 20,000 ש"ח. המערערים ציינו כי מצבם הכלכלי קשה, והם הפנו בהקשר זה לעניינו של ההליך - ערעור על פסק דין בו נדחתה תביעתם לפיצוי בגין פגיעה ב-22 מבני משפחתם אשר נהרגו במהלך מבצע "עופרת יצוקה".
המשיבה מתנגדת לבקשה בציינה כי בבית המשפט קמא הפקידו המערערים ערובה בסך של 30,000 ש"ח, ומשבית המשפט קמא לא חייבם בהוצאות הושבה הערובה בסכום זה לידיהם. מכאן, כך טוענת המשיבה, כי יש בידי המערערים להפקיד את העירבון שנקבע בהליך זה.

בתשובה שהגישו המערערים בהתאם להחלטתי טוענים הם כי הסכום שהופקד בבית המשפט קמא הופקד על ידי גורם שלישי - ישראלי, אשר אינו מוכן להפקיד סכום זה בשנית. לחילופין ביקשו המערערים להאריך את המועד להפקדת העירבון.

לאחר שעיינתי בחומר שבפניי הגעתי לכלל מסקנה כי דין הבקשה לפטור מהפקדת עירבון להידחות.
טענת המערערים לפיה חרף העובדה שביום 27.11.2012 הורה בית המשפט קמא על השבת הערובה שהופקדה בגדר ההליך לידי המערערים, וזו אכן הושבה לידיהם בפועל, אין בידיהם לשוב ולהפקיד עירבון בהליך שבכאן נטענה ללא פירוט הולם (כגון לעניין זהותו של אותו צד שלישי אשר לטענתם אינו מוכן להפקיד עבורם ערובה בשנית) וכן נטענה בעלמא וללא כל אסמכתא התומכת בה.
עוד יצוין כי גם לבקשתם המקורית לפטור מהפקדת עירבון לא צירפו המערערים אסמכתאות כנדרש (כגון דפי חשבון בנק); הבקשה נתמכה בתצהיר של אחד מן המערערים בלבד; ולמעט התייחסות (שלא נתמכה באסמכתאות) לעניין מצבו הכספי של אחיו של אותו מצהיר לא התייחסו המערערים לאפשרות העומדת להם להיעזר בסביבתם הקרובה לצורך גיוס כספי העירבון. כן לא הבהירו המערערים כיצד הם נושאים בעלויות ייצוגם המשפטי. לכך יש להוסיף כי לא ניתן להתעלם בענייננו מן העובדה שבית המשפט קמא בחר לנקוט בצעד החריג של חיוב תובע בהפקדת ערובה (ראו: תקנה 519 לתקנות סדר הדין האזרחי, תשמ"ד-1984; אורי גורן סוגיות בסדר דין אזרחי 750 (מהדורה עשירית, 2009)), עובדה שנראה כי יש בה ללמד על כך שקיימת במקרה דנן חשיבות ביתר שאת להפקדת עירבון להבטחת הוצאות המשיבה.
בנסיבות אלו ומשהעירבון הועמד לכתחילה על ידי המזכירה הראשית על הרף הנמוך, איני מוצאת לנכון לפטור את המערערים מהפקדת עירבון או להפחית את שיעורו.
אשר על כן יפקידו המערערים עירבון בשיעור שנקבע בתוך 15 ימים מעת המצאת החלטה זו, ולא - יירשם ההליך לדחייה ללא הודעה נוספת.
