פסק-דין
השאלה במוקד הערעור הינה האם באירוע מושא הערעור מדובר בתאונת דרכים לפי חוק הפיצויים לנפגעי תאונות דרכים התשל"ה-1975 (להלן: חוק הפלת"ד ), או שעילתה בפקודת הנזיקין. מדובר בנהג מלגזה שביקש לשחרר פלטת ברזל מהמשטח עליו הייתה מקובעת בעזרת אחת משיני מזלג המלגזה.
בית המשפט המחוזי בחיפה (כבוד הנשיאה ב' גילאור) קיבל את עדות נהג המלגזה שהייתה עקבית ומהימנה, וקבע כי האירוע בו נפצע התובע שעמד בסמוך למלגזה אינו מהווה תאונת דרכים לפי חוק הפלת"ד, מאחר שבמהלכו הייתה המלגזה במצב עמידה ועסקה בפעולות טעינה. על פי קביעת בית המשפט, שאין חולקין לגביה, אין זה סביר שהנהג היה משנע משחזת מהסוג המדובר למרחק של 15 מטר על גבי שן אחת של המלגזה. עוד הוסיף כי התיאור של פעולת חילוץ המשחזת באמצעות שן אחת של המלגזה הוא נסיון מלאכותי להכשיר את השימוש במלגזה ואת נזק הגוף שנגרם כך שיכנס בגדר חוק הפלת"ד. בית המשפט הכריע בשאלה האם האירוע נכנס לגדר המונח תאונת דרכים, לאחר שיצא מתוך הנחה כי נדרש על פי החוק שנזק הגוף נגרם מרכב מנועי דו תכליתי שעיקר ייעודו לתחבורה. אשר לשאלת ניצול כוחו המכני של הרכב, הפנה בית המשפט לתנאי לפיו הדבר ייחשב כתאונת דרכים כל עוד לא שינה הרכב במועד האירוע את ייעודו הלא תעבורתי המקורי. בית המשפט קבע שגם אם יעודה של המלגזה הוא הנפת מטענים ושינועם ליעדים שונים הרי שבמועד האירוע לא הייתה המלגזה אמורה להניף את המשחזת או לשנעה למשאית התובע אלא לשחררה מקיבועה באמצעות שימוש בשן אחת כעין כלי חליצה, פעולה שלכל הדעות אינה עולה בקנה אחד עם אף אחד מייעודיה המקוריים של המלגזה.
לאחר ששמענו את טיעוני בא כוח המערערת, הצענו לבא כוח המערערת לחזור בו מהערעור אך הוא ביקש להמשיך ולטעון את ערעורו. משכך שמענו בהרחבה את טיעוני הצדדים כולם, בחנו את הטענות בכתב ובעל פה שהועלו בפנינו ולא מצאנו כי יש בפי המערערת טענה המצדיקה את התערבותנו בפסק דינו של בית המשפט המחוזי. משהגענו למסקנה שאין יסוד לדחות את הממצאים העובדתיים שקבע בית משפט קמא ולא את המסקנות המשפטיות, כשברקע הדברים ניבטת המגמה שלא להרחיב את המושג טעינה, שעשוי להכניס לחוק הפלת"ד סיכונים שאינם מהווים חלק מסיכוני השימוש ברכב עצמו, סבורים אנו כי ניתן לאמץ את קביעותיו ומסקנותיו המשפטיות של בית המשפט המחוזי על פי תקנה 460(ב) לתקנות סדר הדין האזרחי, התשמ"ד-1984, ומשכך הערעור נדחה. המערערת תישא בהוצאות ושכר טירחת עורך דין בסך 20,000 ₪, לכל אחד מהמשיבים.
