בקשה לפטור מאגרה
החלטה
לפניי בקשה לפטור מתשלום אגרה בהליך שבכותרת. ההליך מופנה כנגד פסק דינו של בית המשפט המחוזי בירושלים, אשר דחה תביעת רשלנות רפואית של המערער נגד המשיבים. על פי הנטען בבקשה, למערער מיעוט הכנסה ויכולת. המערער מוכר כנכה בשיעור של 100%. מקורות מחייתו היחידים הם גמלאות של המוסד לביטוח לאומי. עוד עולה מן הבקשה כי המערער מתגורר בדירה שהייתה שייכת להוריו, בה הוא מחזיק שליש מן הזכויות. למערער זכויות במחצית של דירה נוספת, בה מתגוררת גרושתו.
על פי תקנות בית משפט (אגרות), התשס"ז-2007, רשאי בית המשפט לפטור מבקש מתשלום אגרה אם "ראה בית המשפט שאין ביכולתו של המבקש לשלם את האגרה" (תקנה 14(ג)). על מבקש הפטור מוטל, איפוא, הנטל להוכיח כי אין ביכולתו לשלם את האגרה. המבקש לא עמד בנטל זה. מהבקשה ומהמסמכים המצורפים לה
לא עולה תמונה לפיה המערער נתון במצוקה כלכלית. הכנסתו הכוללת של המערער מגמלאות המוסד ל ביטוח לאומי מגיעה לכדי 6,800 ₪ בחודש. גם דפי חשבון הבנק שצורפו לבקשה אינם מלמדים על דלות כלכלית. יתרת הזכות בחשבונו עולה בחלק ניכר מהזמן על סכום האגרה בהליך שבכותרת. גם גובה התשלומים לחברת הסלולר וסכום המשיכות במזומן אינם תומכים בטענה בדבר חוסר יכולת כלכלית. בנוסף, המערער אינו מוסר פרטים בדבר אופן המימון של ייצוגו המשפטי. במצב דברים זה, ובשים לב לגובה האגרה בהליך שבכותרת, איני סבורה כי הוכחה תשתית המצדיקה פטור מאגרה. האגרה תשולם תוך 10 ימים מקבלת החלטה זו, ולא – יימחק ההליך מן הרישום, בלא צורך בכל הודעה נוספת.
