המבקש בהליך שבכותרת מבקש את פסילתי מלישב בדין בעניינו. המבקש הגיש לבית משפט זה ערעור פסלות שופט על החלטת בית המשפט המחוזי בחיפה (כב' השופט גינת). בקשתו לפטור מאגרה בערעור זה נתקבלה חלקית (החלטת כב' הרשמת ש' ליבוביץ מיום 9.11.06). על ההחלטה בעניין האגרה הגיש המבקש ערעור על החלטת כב' הרשמת. גם במסגרת ערעורו זה ביקש פטור מאגרה. בהחלטתי מיום 13.2.06 נדחתה הבקשה לפטור מאגרה בערעור על החלטת כב' הרשמת תוך חיוב המבקש בהוצאות בשל היות הבקשה בקשת סרק. בהמשך לכך, קבעתי ביום 15.2.07 כי נוכח אי תשלום האגרה בבש"א 10001/06 ימחק הליך זה (ערעור על החלטת הרשמת) ותשולם האגרה בע"א 9203/06 (שהוא ערעור הפסלות המקורי) בתוך עשרה ימים. בשלב זה ביקש המבקש, בבקשה בכתב, את פסילתי מלישב בדין בעניינו.

טעם הבקשה הנטען לפסילה הינו העובדה כי המבקש הגיש תביעה כנגדי בבית המשפט המחוזי בירושלים וזאת עקב טענת המבקש ל"נקמנות אישית" כלפיו. זאת, בהמשך גם להחלטתי בבשג"ץ 4748/06 שקד נ' קרן נשיא המדינה (לא פורסם) בה צוין כי המבקש נוקט בהליכי סרק רבים ויתכן והיה מקום לנקיטת צעדים כנגד המבקש בשל כך.

דין הבקשה לפסילתי להידחות. המבקש לא הצביע על כל חשש ממשי למשוא פנים המחייב פסילה מלישב בדין. בעצם העובדה כי ניתנה בעניינו של המבקש החלטתי בבשג"ץ 4748/06, אין משום נעילת דעתי לעניין הליכים חדשים שיוזם המבקש וכל מקרה נבחן לגופו. אין יסוד למסקנת המבקש העולה מבין השיטין
של טענותיו, לפיה הקביעה כי נקט בעבר בהליכי סרק מובילה ל"שרירות לב, נקמנות אישית ומשוא פנים" ואף ל"שנאת התובע". הסמכות לדחות בקשה לפטור מאגרה קבועה בדין (תקנה 13 לתקנות בית משפט (אגרות), תשמ"ח-1987) כמו גם הסמכות לחייב בעל דין בהוצאות לטובת המדינה בגין ניהול סרק של הליך (תקנה 514 לתקנות סדר הדין האזרחי, תשמ"ד-1984). אין בעובדה כי ניתנו בעבר החלטות על פי סמכותי דלעיל, כנגד המבקש, בכדי להצביע על נעילת דעתי בנדון וחשש ממשי למשוא פנים שכן מדובר בהחלטות דיוניות לגופן של בקשות שהגיש המבקש. לבסוף, אין בעובדה כי המבקש הגיש תובענה כנגדי לבית המשפט המחוזי בכדי לבסס עילת פסלות ואין בנתון זה כשלעצמו בכדי לבסס חשש ממשי למשוא פנים (ראו רע"ב 2025/02 שטויכין נ' שירות בתי הסוהר (לא פורסם)). כך הדבר בייחוד שעה שהתביעה האמורה מבוססת על החלטתי הנזכרת בבשג"ץ 4748/06.

התוצאה היא, כי דין הבקשה לפסילתי להידחות. התיק יובא לפני לתזכורת פנימית עד ליום 15.5.07.
