בקשה לפטור מאגרה וערבון
החלטה

הליך זה עניינו השגה על החלטת בית המשפט
המחוזי בחיפה להשית על המערערים הוצאות אישיות בשל השתלשלות עניינים הקשורה באי הגשת תגובה לכתב אישום. עם פתיחת ההליך – שנפתח כערעור אזרחי – נתבקשו המערערים לשלם אגרה כדין. כן חויבו בהפקדת עירבון בסך של 25,000 ₪.
לפני בקשה לפטור אותם מאגרה ומערבון. טעם הבקשה לפטור מאגרה
– החיוב בהוצאות אישיות מקורו בסמכות טבועה של בית המשפט
ומטעם זה אין לחייבם בה. אשר לערבון, נטען כי נוכח מהות ההליך נמצא בעבר מקום לפטור מערבון במקרים מעין אלו וכך יש לנהוג גם במקרה זה. המשיבה מתנגדת לבקשות.

לאחר עיון בחומר שלפני ובטענות בעלי הדין מסקנתי היא כי דין הבקשות להידחות. אין חולק כי ההשגה על הטלת הוצאות אישיות על עורך דין דינה להתברר כערעור אזרחי (ראו בג"ץ 2685/92 ניר נ' נשיא בית המשפט המחוזי בבאר שבע , פ"ד מז(2) 203, 205 (1992); ע"א 4845/95 ניר נ' מדינת ישראל , פ"ד מט(2) 639 (1995)). משאין הוראה בתקנות בתי המשפט (אגרות), תשס"ז-2007 הפוטרת הליך זה מאגרה, חייב הוא באגרה כדין ערעור אזרחי, וכך נפסק גם בעבר (ראו למשל ע"א 5375/06 ששון נ' מדינת ישראל (לא פורסם); ע"א 5075/02 ברדוגו נ' מדינת ישראל (לא פורסם, 4.12.2002). המערערים חייבים אפוא באגרה. הוא הדין לעניין החבות הבסיסית בערבון החלה גם בהליך מעין זה (ראו למשל ע"א 5090/07 עטרי נ' מדינת ישראל (לא פורסם, 18.7.2007)). משלא נטען לחוסר יכולת כלכלית, המסקנה היא אפוא כי המערערים חבים גם בערבון.

ודוק: ער אני לטענת המערערים לפיה הגם שכך נפסק בעבר, מן הדין והצדק לשנות פסיקה זו. את טענתם זו סמכות כאמור המערערים על סמכותו הטבועה של בית המשפט כבסיס לחיובם בהוצאות, כמו גם על מהות ההליך. לא מצאתי – כעולה מנימוקי שלעיל – לאמץ טענה זו של המערערים. אשר למקור הסמכות להטלת הוצאות אישיות, הרי שלעניין זה לא מצאתי קשר לשאלת החיוב באגרה הקבוע בתקנות האגרות עצמן. וגם כעניין של תכלית הדין, החיוב באגרה בעניינים מסוג זה משרת את התכליות העיקריות של עצם החיוב באגרת בית משפט , הכוללת את השתתפות בעל הדין יוזם ההליך בעלות ההליך המשפטי ומניעת הליכי סרק. מה לי לעניין אחרון זה, אם מקורו של חיוב זה או אחר הוא במקור סמכות בדין חרות, או אם מקורו בסמכות טבועה של בית המשפט שאינה שנויה במחלוקת. לבסוף, נכון הדבר כי חיוב עורך דין בהוצאות משפט הוא בעל מאפיין מיוחד, אולם אין המדובר בהליך פלילי הפטור מאגרה (והשוו תקנה 20(8) לתקנות), גם אם חיוב זה בא לעולם, כנגד עורך דין המייצג בעל דין
במסגרת הליך פלילי. הוא הדין לעניין החבות בעירבון.

הבקשות לפטור מאגרה וערבון נדחות אפוא. האגרה תשולם תוך 10 ימים מעת ההמצאה. תוך מועד זה יופקד גם עירבון מופחת בשיעור של 5,000 ₪. הפחתה זו מקורה בכך שאם נוכח שווי ההליך עצמו ואם נוכח מהותו, עמד שיעור הערבון שנקבע בהליך זה מלכתחילה על הצד הגבוה ודי בהפקדת הסכום עליו הוריתי לעיל. הפקדה זו תבוא לידי בית המשפט תוך המועד שנקבע לתשלום האגרה שאם לא כן ידחה ההליך בלא התראה נוספת.
