החלטה

הערעור שבכותרת הופנה נגד החלטה של בית המשפט המחוזי בתל-אביב-יפו (כב' השופטת ר' רונן) מיום 1.1.2008, בה התקבלה בקשת המשיבים 1 ו-2 (להלן – המשיבים) לסלק על הסף תביעה מטעם המערער, בה התבקש בית המשפט להצהיר כי זכויות החכירה במגרש בישוב קדימה שייכות למערער. הבקשה לסילוק על הסף התקבלה ככל שמ דובר
בהצהרה על זכויות המערער בנכס ובסעדים הנגזרים מהצהרה זו, על יסוד הקביעה כי עילת התביעה התיישנה.

ביום 15.7.2008 הגיש המערער בקשה לדחות את המועד להגשת סיכומי טענות בערעור עד לאחר מתן החלטה בבית המשפט המחוזי בבש"א 13269/08, בה התבקש ביטולה של ההחלטה בדבר סילוק התביעה על הסף, לאור ראיה חדשה שהגיעה לידי המערער. בעקבות זאת הוריתי (ביום 13.8.2008) כי המערער יגיש הודעה מעדכנת עם סיום הדיון בבש"א 13269/08.

ביום 27.11.2008 הגיש המערער הודעה מעדכנת, לפיה החליט בית המשפט המחוזי (ביום 25.11.2008) לבטל את ההחלטה הקודמת. ביטול ההחלטה התבסס על מסמך שהגיע לידי המערער בעקבות הליך של גילוי מסמכים. נפסק כי המ דובר במסמך מהותי, אשר יש בו כדי לשנות את ההחלטה שניתנה בסוגיית ההתיישנות. עם ביטול ההחלטה מיום 1.1.2008 חויבו המשיבים בהוצאות המערער בסך 10,000 ₪. בהמשך ביקש המערער לבטל את הערעור תוך פסיקת הוצאות לטובתו והשבת האגרה והערבון.

המשיבים, מצידם, מבקשים לדחות את בקשת המערער לפסיקת הוצאות. הם מציינים כי טענות הצדדים בבית המשפט המחוזי בנוגע לראייה החדשה טרם התבררו סופית, ובהתאם להחלטת כב' השופטת ר' רונן מיום 11.1.2009, הטענות יתבררו במסגרת הדיון בתובענה לגופה ובאותו שלב גם ייבחן עניין ההוצאות. לטענת המשיבים, מכיוון שעדיין לא הוכרע סופית על ידי בית המשפט המחוזי האם המערער ידע או לא ידע על הראיה החדשה קודם למתן החלטה בבש"א 13269/08 ולהגשת הערעור, אין מקום לחייבם בהוצאות הערעור, ככל שהן קיימות. המשיבים מוסיפים ומציינים כי הערעור נמחק בשלב מוקדם, בו לא הוגשו סיכומים מטעם בעלי הדין ולא התקיים דיון ואף המערער עצמו לא פירט אילו הוצאות נגרמו לו בקשר להליך הערעור.

לאחר עיון בבקשת המערער, בעמדת המשיבה ובתגובת המערער לתגובה זו, כמו גם בחומר המצוי בתיק, באתי לכלל מסקנה כי יש מקום לחייב את המשיבים בתשלום הוצאות למערער בגין הגשת הערעור שבכותרת. ככלל, כאשר יוזם ההליך מקבל את הסעד המבוקש בעקבות הגשת ההליך, באופן המייתר את המשך בירור ההליך, יש מקום לשקול חיובו של המשיב בהוצאותיו של יוזם ההליך (השוו, בג"צ 842/93 אל נסאסרה נ' שר הבינוי והשיכון , פ"ד מח(4) 217 (1994)). אין חולק כי במקרה דנן, המערער בא על סיפוקו עם ביטול ההחלטה של בית המשפט המחוזי, כנגדה הופנה הערעור, ומשכך התייתר המשך הדיון בערעור. אמנם, בבית המשפט המחוזי נפסקו הוצאות לטובת המערער עם קבלת הבקשה לביטול ההחלטה בדבר סילוק התביעה על הסף. אך הוצאות אלה נועדו לכיסוי ההוצאות הכרוכות בהגשת הבקשה לביטול ההחלטה. הן לא נועדו, כך נראה, לכיסוי ההוצאות הכרוכות בהגשת הערעור לבית משפט זה. עם זאת, בקביעת שיעור ההוצאות יש להתחשב בכך שהערעור נמחק בטרם הגיש המערער סיכומי טענות ובטרם התקיימה השלמת טיעון על-פה. נוכח האמור ובשים לב לכלל נסיבות העניין, ומשלא פירט המערער את הוצאותיו, ישלמו משיבים 1 ו-2 למערער הוצאות בסכום של 2,500 ₪. האגרה תושב בניכוי הסכום הקבוע בפריט 33 לתוספת לתקנות בתי משפט (אגרות), התשס"ז-2007. הערבון יושב לידי המערער, בכפוף לבדיקת המזכירות כי אין לכך מניעה בדין.
