בקשה לתיקון כתב ערעור
החלטה

לפני בקשה מטעם המערערים להוספת נימוק לערעורם. הוגשו סיכומים מטעם בעלי הדין וההליך קבוע לדיון ביום 3.12.07. הטיעון שמבוקש להוסיף הינו השלכת פסק הדין בעע"ם 5829/05 דארי נ' משרד הפנים (לא פורסם, 20.9.07) על העניין נשוא ערעור זה. המשיב מתנגד לבקשה.

לאחר עיון בחומר שלפני ובטענות בעלי הדין לעניין זה, נחה דעתי כי יש להיעתר לבקשה. נכון הדבר, כי ההליך מצוי בשלב מתקדם ומועד הדיון קרוב. עם זאת, הטיעון מתבסס על טענה שעלתה במסגרת עע"ם 5829/05 הנזכר, פסק-דין שניתן זה מקרוב. זאת ועוד, נראה על פניו כי מ דובר
בטיעון רלוונטי להליך זה (וזאת מבלי שיהא בכך משום הבעת עמדה באשר לסיכויי קבלתו). אוסיף ואציין, כי המשיב עצמו הסתמך על פסק הדין בעע"ם 5829/05 בסיכומיו בהליך זה וגם מטעם זה סבור אני כי יש מקום להיעתר לבקשה בנדון. לבסוף, אין לדידי בעובדה כי הטיעון שמבוקש להוסיף בהליך זה הושאר בצריך עיון במסגרת עע"ם 5829/05, שכן עצם העובדה כי הטענה לא הוכרעה אין בה כדי למנוע העלאתה בהליך דנן.

הבקשה לתיקון כתב הערעור מתקבלת אפוא. בשים לב למועד הדיון הקבוע, יוכלו המערערים להוסיף לסיכומי התשובה שלהם טיעון בנדון ואילו המשיב יוכל להתייחס לעניין זה בתגובה נוספת מטעמו שתוגש לא יאוחר מ-5 ימים לפני מועד הדיון. החלטתי זו תתויק בתיקי השופטים שישבו בדין. החלטה זו תישלח לצדדים, ללא דיחוי, באמצעות הפקסימיליה.
