החזר אגרה
החלטה
אינני רואה להורות על החזר אגרה כמבוקש. האגרה משקפת את השתתפות הפרט המבקש לנהל הליך משפטי, בעלות ההליך ובשירות המתקבל ממערכת המשפט. תכלית ההוראה בדבר החזר האגרה היא ליצור תמריץ מסוים לסיום הליכים שלא בדרך של התדיינות בפני בית המשפט. במקרה דנן, פסק-הדין ניתן לאחר דיון באולם לפני הרכב של שלושה שופטים. בעקבות הערות השופטים, חזר בו המערער מהערעור, והמשיבה 1 הסכימה כי המערער יגיש בקשה להיתר בנייה שתידון לגופה על-ידי גופי התכנון. בנסיבות אלה, אין עילה להורות על החזר האגרה כמבוקש (ראו: תקנה 6(ב) בצירוף עם תקנה 15 לתקנות בתי המשפט (אגרות), התשס"ז-2007). אשר על כן, הבקשה להחזר האגרה נדחית.
