בקשה לסעד זמני לפיו ימשיך המבקש לשרת בצה"ל עד להכרעה בערעור על
פסק דינו של בית המשפט
המחוזי בתל אביב-יפו בעת"מ 39391-11-10 (כב' השופט ק' ורדי ), בגדרו נדחתה עתירתו של המבקש לבטל את החלטת המשיב 1 (להלן: הרמטכ"ל ) לפיה ישוחרר המבקש משירות קבע.

המבקש משרת שירות קבע בצה"ל בדרגת תת אלוף, ובזמן הרלוונטי שימש כמפקד אוגדת הגליל. בעקבות תאונת דרכים בה הייתה מעורבת רעייתו של המבקש ובעקבות דיווח כוזב שמסר המבקש לאלוף הפיקוד, הוא המשיב 2 (להלן: האלוף אייזנקוט ), ולפיו הוא עצמו היה נוכח בתאונה, החליט הרמטכ"ל על ביטול מינויו לפיקוד על קורס מפי"ם-מגדי"ם.
משנסתיימה חקירת מצ"ח וסגן הפצ"ר הביע את דעתו בעניין, הועמד המבקש לדין משמעתי וביום 25.4.10 הורשע על ידי סגן הרמטכ"ל דאז, האלוף בני גנץ (הרמטכ"ל דהיום), בגין אי קיום הוראות המחייבות את הצבא והתנהגות שאינה הולמת לפי סעיפים 133 ו-105 לחוק השיפוט הצבאי, התשט"ו-1955 (להלן: חוק השיפוט הצבאי ).
ביום 29.4.10 נערך למבקש הליך פיקודי בפני הרמטכ"ל ובנוכחות חלקית של האלוף אייזנקוט. במעמד זה, לאחר שהמבקש דחה את הצעת הרמטכ"ל לפרוש מרצונו מצה"ל, הוחלט על שחרורו מצה"ל החל מיום 1.5.10.

על רקע זה, עתר המבקש ביום 21.11.10 ל בית המשפט לעניינים מנהליים וביקש להורות על ביטול החלטת הרמטכ"ל לשחררו מצה"ל, ולחלופין, להשיב את עניינו לשימוע חוזר בפני הרמטכ"ל הנוכחי, הוא המשיב 5. לבקשת המבקש, ניתן סעד זמני האוסר על שחרורו מצה"ל עד למתן פסק דין בעתירה. בסופו של יום, בית המשפט דחה את העתירה וקבע כי החלטת הרמטכ"ל היא סבירה ומידתית. בד בבד בוטל הסעד הזמני שניתן בתחילת ההליך.
ביום 22.2.11 הגיש המבקש ל בית משפט קמא בקשה לעיכוב ביצוע החלטתו ככל שהיא נוגעת לביטול הסעד הזמני, ו בית המשפט דחה את הבקשה.
ביום 28.2.11 הודיע ראש אגף כוח אדם בצה"ל, המשיב 4, למבקש, כי בשל סמיכות הזמנים בין החלטת בית המשפט לבין מועד השחרור הרלוונטי (28.2.11), הוחלט להעניק לו חודש נוסף על מנת שיוכל להתארגן לקראת שחרורו, ומועד השחרור החדש נקבע ליום 31.3.11.

על פסק הדין של בית המשפט לעניינים מנהליים הגיש המבקש ערעור ל בית משפט זה, ובמקביל הגיש בקשה לעיכוב ביצוע פסק הדין ולמתן סעד זמני המורה להחזירו לשירות בצה"ל עד להכרעה בערעור.
בבקשתו למתן סעד זמני טען המבקש, בין היתר, כי השארתו בצה"ל עד למתן פסק דין בערעורו חיונית על מנת שלא לרוקן מתוכן את ההליך. כמו כן, לרצף השירות יש חשיבות והשפעה על שיקול דעתם של המשיבים, אם תתקבל בקשתו להחזיר את עניינו לשימוע נוסף בפני המשיב 5.

דין הבקשה להידחות.
ככלל,
אין בהגשת ערעור כדי לעכב את ביצוע פסק הדין שעליו מערערים (ראו תקנה 42 לתקנות בתי משפט לעניינים מינהליים (סדרי דין), תשס"א-2000, וכן, לדוגמה, ע"א 7221/01 י.ג. רובינשטיין יצור וסחר נ' שובל שיווק מוצרים והפצתם , פ"ד נו (4) 178, 182 (2002) (להלן: עניין רובינשטיין );
ע"א 3604/02 אוקו נ' שמי , פ"ד נו(4) 505, 509 (2002)). החריג לכלל הוא עיכוב ביצוע או מתן סעד זמני.
כידוע, שני שיקולים עומדים לנגד עיניו של בית המשפט בבואו להכריע בבקשה למתן סעד זמני, והם סיכויי הערעור ומאזן הנוחות (ראו, לדוגמה, עע"ם 2803/06 מאיר ובניו בע"מ נ' הגיחון מפעלי מים וביוב בירושלים בע"מ (לא פורסם, 11.4.2006); עע"מ 9347/09 י.ד

אשר לסיכויי הערעור, ומבלי לקבוע מסמרות, איני סבור כי סיכויי המבקש בערעור הם בדרגה המצדיקה מתן סעד זמני. חלק נכבד מטענות המבקש הן במישור העובדתי, ואין דרכה של ערכאת ערעור להתערב בקביעת ממצאי עובדה ומהימנות. ההחלטה לשחרר את המבקש מצה"ל נתקבלה במסגרת הליך פיקודי בפני הרמטכ"ל דאז, לאחר שכבר נשפט בדין משמעתי והורשע על פי חוק השיפוט הצבאי בפני הרמטכ"ל בהווה, ולבסוף אף נבחנה בפני בית משפט
קמא. ההחלטה לשחרר את המבקש מצה"ל עברה אפוא מספר גלגולים, שיפוטיים ומעין-שיפוטיים, ולא בנקל יתערב בית משפט זה בהחלטה מעין זו. לכך יש להוסיף, כי ביסוד ההחלטה של הרמטכ"ל בדבר סיום שירותו של המבקש בצה"ל, עמדו ערכים של אמינות ודוגמה אישית, נושאים הנמצאים בליבת שיקול הדעת של הרמטכ"ל, ואין דרכו של בית המשפט להתערב בהחלטות כגון דא (השוו לאי התערבות בנושאים של מינויים ושיבוצים - בג"ץ 1284/99 פלוני נ' ראש המטה הכללי , פ"ד נג(2) 62, 69 מול האות ו (1999), וכן למדיניות אי התערבות בהחלטות מקצועיות-תכנוניות של הצבא - בג"ץ 734/83
שיין ואח' נ' שר הביטחון ואח' , פ"ד לח(3), 393, 398 (1984); בג"ץ 1996/95 טיסונה נ' שר הביטחון ואח'
(לא פורסם, 29.1.1996)).

אף מאזן הנוחות אינו נוטה לטובת המבקש. מאז ההחלטה לשחררו מצה"ל ביום 10.8.09, המבקש טרם שוחרר מצה"ל כאשר בחלק מהתקופה הוא מקבל משכורתו, למעשה, על חשבון הקופה הציבורית, על אף שאינו ממלא כל תפקיד פעיל בצה"ל.
דחיית הבקשה לא תגרום למבקש נזק של ממש, שכן אם יתקבל ערעורו יוכל לחזור ולהשלים את שירותו הצבאי ולא יהא קושי להשיב לו את זכויותיו הכספיות ולהעמידו במקום בו היה עומד אילולא שוחרר. אף איני מקבל את טענת המבקש כי קטיעת שירותו תשפיע על המשיב 5 אם עניינו יוחזר על ידי ערכאת הערעור לשיקול דעתו ולשימוע נוסף. חזקה על המשיב 5 כי אם יתקבל הערעור, ידע לשקול מחדש את עניינו של המבקש על פי הנדרש.

לאור האמור, אני דוחה את הבקשה.
