המבקשת הגישה הצעה במכרז שערך המשיב בשנת 2008 ליצירת מאגר של נותני שירותי סיעוד לקשישים, למאות ועדות נפרדות של המשיב ברחבי הארץ. המבקשת זכתה להיכלל במאגר נותני השירותים ב-89 ועדות מתוך 94 ועדות שאליהן ביקשה להצטרף. הצעתה להצטרף לוועדת גוש חלב – נדחתה, לאחר שנמצא כי הצעתה איננה זוכה לניקוד סף מספק. לטענת המבקשת, הניקוד החסר הוא פרי סימון שגוי על-ידה של ותק הסניף שלה בגוש חלב – כבעל ותק של עד ששה חודשים, במקום כבעל ותק של החל מששה ועד לשנים-עשר חודשים, הוא הוותק הנכון לטענתה. טענה זו נדחתה על-ידי ועדת המכרזים, שמצאה כי אין מדובר ב"טעות סופר" בת-תיקון, כמשמעותה בתקנה 20(ג) ל תקנות חובת המכרזים, התשנ"ג-1993 . הליכים משפטיים שיזמה המבקשת לשינוי עמדה זו של ועדת המכרזים הסתיימו, לאחר גלגולים שונים שאין צורך לפרטם, בדחיית טענות המבקשת בפסק דינו בית המשפט לעניינים מינהליים בירושלים (כב' השופט י' נועם ), מתאריך 17.4.2011, אשר מצא כי אכן אין מדובר בטעות סופר בת-תיקון.

המבקשת הגישה בתאריך 25.5.2011 ערעור על פסק הדין האמור, ובגדרו – בקשה לעיכוב ביצוע פסק הדין. מן הבקשה עולה שבתאריך 2.5.2011 הודיע המשיב למבקשת כי נוכח פסק הדין, מושא הערעור, ניתנה לוועדת גוש חלב הוראה להעביר את הקשישים שבטיפול המבקשת – שלושה-עשר במספר – לנותני שירותים אחרים. בהמשך להודעה זו, בתאריך 11.5.2011, הודיע המשיב לשלושה נותני שירותים אחרים על העברתו אליהם של הטיפול בעשרה מן הקשישים, שהיו בטיפולה של המבקשת, החל מתאריך 1.6.2011. בתאריך 12.5.2011 פנתה המבקשת למשיב בבקשה לעכב את ביצועו של פסק הדין, ובחלוף ארבעה ימים נוספים – עתרה לבית המשפט המחוזי לעיכוב ביצוע פסק הדין. המשיב התנגד לבקשה. בית המשפט לעניינים מינהליים קבע שנוכח העובדה שהטיפול בקשישים לא יועבר קודם לתאריך 1.6.2011, וכיוון שבדעת המבקשת להגיש ערעור על פסק הדין, יעוכב הביצוע עד לאותו מועד, כך שערכאת הערעור תוכל להחליט בשאלת המשך עיכוב הביצוע. מכאן הבקשה שבפניי. יצוין שבתאריך 29.5.2011 ניתן על-ידי צו ארעי, האוסר על ביצועו של פסק הדין עד להחלטה אחרת שתינתן בתיק, לאחר שתימסר תגובת המשיב לבקשה.

לאחר שעיינתי בבקשה, בתגובת המשיב לה, ובפסק הדין, מצאתי כי דין הבקשה – להידחות.
ככל שהדברים נוגעים לסיכויי הערעור, הרי שמבלי לטעת מסמרות, ברי שבפני המבקשת עומדת משוכה גבוהה למדי בדרכה לשכנע את ערכאת הערעור להתערב בפסק דינו המפורט והמנומק של בית המשפט הנכבד קמא. ברם עיקר בענייננו הוא מאזן הנוחות, וזה איננו נוטה לטובת המבקשת, ודאי בהשתלב טעם זה בבעיית השיהוי, בה לוקה הבקשה. המבקשת מעניקה כיום טיפול ל-880 קשישים בוועדות השונות, מהם רק תריסר מטופלים בוועדת גוש חלב (לאחר פטירתו של אחד המטופלים בעת האחרונה). ביחס לעשרה מן המטופלים – נותני שירותים אחרים כבר נערכו לקליטתם, וזאת נוכח הודעת המשיב מתאריך 11.5.2011, ולאחר שהמבקשת השתהתה משך כמעט חודש טרם הגשת הבקשה לעיכוב ביצוע לבית המשפט לעניינים מינהליים, בתאריך 16.5.2011. יתרה מכך, אף אם נתייחס לתריסר המטופלים כמקשה אחת, הרי שקשה לראות את העברת הטיפול בהם לנותני שירותים אחרים כתוצאה מיישומו המיידי של פסק הדין – כנזק בלתי הפיך מבחינתה. זאת, הן בשים לאפשרות להשיב לה את הטיפול באותם קשישים מעטים, במקרה הצורך (והרי בחוזה למתן שירותים עסקינן), הן בהתחשב באפשרותה לעתור לפיצויים בגין נזקיה בתקופת הביניים, אם תזכה בערעורה.

נוכח כל האמור לעיל – הבקשה נדחית. הצו הארעי מתאריך 29.5.2011 – בטל. המבקשת תיערך להעברת הקשישים שבטיפולה לנותני שירותים אחרים מטעם המשיב, עד לתאריך 1.9.2011, בהתאם להנחיות שייתן לה המשיב בעניין זה. המבקשת תשא בשכר טרחת עורכי דינו של המשיב בסכום של 10,000 ש"ח.

בשולי הדברים אציין את העובדה שבתאריך 23.3.2011 פרסם המשיב "מכרז משלים" (בעקבות הדיון שהתקיים בבית משפט זה ב-עע"ם 7181/10), מכרז שבגדרו יכולים היו המבקשת ושכמותה לשוב ולהגיש הצעות להצטרף לועדת השונות. בהנחה שהמבקשת שבה וביקשה להימנות עם נותני השירותים בוועדת גוש חלב, ובהנחה נוספת – שהפעם הגישה הצעתה כשהיא ערוכה כראוי, אזי פתוחה הדרך בפני המשיב לבחון, לפי שיקול דעתו המלא, האם יש מקום לאפשר למבקשת להמשיך בכל זאת במתן השירותים לקשישים, או חלקם, בוועדה הנ"ל (חרף החלטתי זו, ושלא תחת צו עיכוב ביצוע). זאת, עד לקביעת תוצאות המכרז המשלים בוועדה הנ"ל. שיקול דעת זה מיועד לבחון בראש ובראשונה את מזעור הנזק הכרוך בהעברת המטופלים לנותני שירותים אחרים, לרבות הנזק לעובדי המבקשת, ולאו דווקא לנזק שייגרם ישירות למבקשת ככזו .
