החלטה
לפני בקשה להפקדת ערובה במקום ערבון, בהתאם לתקנה 429 לתקנות סדר הדין האזרחי, התשמ"ד-1984. המערערת מבקשת להגיש כתב התחייבות עצמית החתום על ידי ראש העירייה ועל ידי גזבר העירייה. גם בבקשה מציינת המערערת כי היא מתחייבת לשאת בכל הוצאה לטובת המשיבות בה תחויב. משיבה 2 נתנה הסכמתה לבקשה. משיבה 1 מתנגדת לבקשה, בציינה כי היא מתקשה לקבל מרשויות מקומיות הוצאות משפט המגיעות לה, לרבות הוצאות המשפט שנפסקו לטובתה בפסק הדין נשוא הערעור.
לאחר עיון בעמדות הצדדים, באתי לכלל מסקנה כי אין בידי להיעתר לבקשה. המשיב להליך ערעורי זכאי לכך כי תופקד ערבות וודאית, זמינה ובטוחה להבטחת הוצאותיו. במקרים מסוימים, כאשר יוזמי ההליך הם גופים בעלי איתנות כלכלית מוכחת, המכבדים פסיקת הוצאות ללא יוצא מן הכלל, כגון בנקים וחברות ביטוח, הנוהג הוא להסתפק בהתחייבות עצמית מטעמם כחלופה להפקדת ערבון במזומן או ערבות בנקאית. נוהג זה מבוסס על כך שהשילוב של איתנות פיננסית וכיבוד פסיקת ההוצאות הינו שווה ערך להפקדת ערבון במזומן או ערבות בנקאית (ראו, רע"א 10343/05 עמידר – החברה הלאומית לשיכון בישראל בע"מ נ' משה (לא פורסם, 16.2.2006)). הבקשה שלפניי אינה כוללת תשתית כלשהי על בסיסה ניתן לקבוע כי גם בעניינה של המערערת ניתן להסתפק בהתחייבות עצמית. איני סבורה כי עצם מעמדה הסטטוטורי של המערערת פוטר אותה מלהוכיח חוסן פיננסי וכיבוד פסיקת הוצאות ללא יוצא מן הכלל. מצבה הכלכלי של המערערת אינו בבחינת ידיעה שיפוטית ולא הוצגה לפני תשתית עובדתית המבהירה את מצבה. הוא הדין באשר לכיבוד פסיקת הוצאות ללא יוצא מן הכלל. במצב דברים זה, אין להיעתר לבקשה. המערערת תפקיד את הערבון שנקבע תוך 21 ימים מעת המצאת החלטה זו, ולא – יידחה ההליך ללא צורך במתן הודעה נוספת.
