בקשה לפטור מעירבון
החלטה

לפניי בקשה לפטור מהפקדת העירבון בסך 20,000 ש"ח שקבעה המזכירה הראשית, ולחלופין להפחתת סכומו. המדובר בערעור על פסק-דינו של בית המשפט לעניינים מנהליים בחיפה, במסגרתו נדחתה עתירת המערער לביטול הליכי גבייה שננקטו נגדו מטעם המשיבה 1 (להלן: העירייה ) בגין חוב ארנונה.

בבקשה שלפניי טוען המערער לדלות כלכלית המונעת ממנו את הפקדת העירבון. העירייה מתנגדת לבקשת הפטור. בתגובתה נטען, בין היתר, כי חרף טענות המערער בדבר מצבו הכלכלי הקשה, עלה בידו לשלם את סכום האגרה עם הגשת הערעור, וכי הדבר מהווה חזקה כי יש בידו אמצעים כספיים לתשלום העירבון.

לאחר בחינת טענותיהם של בעלי הדין ועיון בחומר שבתיק, באתי למסקנה כי דין הבקשה לפטור מהפקדת עירבון להתקבל באופן חלקי בלבד.
בראשית הדברים יוער כי העובדה שהמערער שילם את האגרה בהליך שבכותרת אינה מחייבת, כשלעצמה, את דחיית הבקשה לפטור מעירבון. זאת בהתחשב בכך שסכום האגרה נמוך משמעותית משיעור העירבון שנקבע (ראו: ע"א 1855/10 ירדני נ' כהן (לא פורסם, 20.6.2010)). עוד יוער כי לא נעלמו מעיניי טענותיו של המערער לפיהן במשך קרוב לשנה (עד ינואר 2010) היה מובטל מעבודה, וכי הוא אינו משלם עבור ייצוגו בהליך שבכותרת עקב קרבת המשפחה שבינו לבין בא-כוחו. יחד עם זאת, החובה להפקיד עירבון בהליכי ערעור נובעת מהצורך להבטיח כי בעל הדין שכנגד יוכל לגבות את הוצאותיו, ככל שייפסקו לטובתו אם ההליך הערעורי יידחה. לפיכך, לשם קבלת פטור מהפקדת עירבון תוך חשיפת הצד שכנגד לסיכון שמא יתקשה לגבות את הוצאותיו, על מבקש הפטור להוכיח שני תנאים מצטברים: חוסר יכולת כלכלית להפקיד את העירבון, תוך הצגת תשתית ראייתית מלאה ועדכנית בעניין זה; וכן סיכויים טובים להליך.

בנסיבות המקרה דנן, לא שוכנעתי כי המערער עמד בנטל הנדרש לשם פטור מלא מהפקדת עירבון. ראשית , המערער נמנע מלציין את גובה הכנסתה של אשתו העובדת כאחות מוסמכת בבית-חולים, ואף נמנע מלצרף דפי חשבון בנק שלה. שנית , המערער אישר כי פתח עסק חדש לממכר קוקטייל פירות טבעיים, וטען כי עסקו צובר הוצאות. עם זאת, הטענה בדבר הפסדי העסק הועלתה בעלמא בלא גיבוי בנתונים ובמסמכים מאמתים. שלישית , המערער טען באופן סתמי כי אין באפשרותו להיעזר בקרוביו לצורך גיוס כספי העירבון. גם טענה זו נטענה בכלליות בלבד, ללא אסמכתאות מאמתות וללא פירוט אילו מאמצים נעשו בניסיון לגייס את הכספים ממעגל קרוביו ומכריו של המערער. לבסוף , אציין כי לכאורה סיכוייו של ההליך אינם נחזים להיות גבוהים במידה המטה את הכף לטובת קבלת הבקשה.

אשר על כן, הבקשה לפטור מלא מהפקדת עירבון נדחית. יחד עם זאת, בהתחשב בכך שבית-המשפט קמא לא ראה להשית הוצאות על המערער; בשים לב לכך שמלבד העירייה, יתר המשיבים בתיק לא הגיבו לבקשת הפטור ולפיכך יש להבטיח את הוצאותיה של העירייה בלבד; וכן בהתחשב בפערי הכוח בין הצדדים ; אני רואה להפחית את העירבון לסכום של 10,000 ₪. העירבון יופקד תוך 21 יום מעת המצאת החלטה זו. בהעדר הפקדה במועד, יירשם ההליך לדחייה, בלא צורך בהתראה נוספת. אין צו להוצאות.
