בהליך זה לא הוגשו סיכומי המערערת בהתאם לצו הסיכומים מיום 20.5.2013, ובהחלטה מיום 11.9.2013 אפשרתי למערערת ליתן טעם לכך.
בתיק, אשר הועלה לעיוני היום, לא תוייקה כל הודעה מטעם המערערת בהמשך להחלטתי הנזכרת אך עיון בתכנת ניהול התיקים העלה כי נעשה על ידה ניסיון להגיש הודעה מטעמה ביום 16.9.2013, וזו נדחתה מן המרשם (בשל חסר שנפל בה). ביקשתי לעיין בהודעה זו והיא הובאה בפניי, ועיון בה מעלה כי לטענת המערערת הגישה היא בקשה לדחיית מועד הדיון וכן שלחה בדואר עותק של סיכומים מטעמה, אך כתבי בי-דין אלו אינם מצויים בתיק.
לא ברור מדוע המסמכים אשר לטענת המבקשת הוגשו אינם מצויים בתיק בית המשפט וכיצד זה לא בדקה המערערת האם בקשותיה-הודעותיה טופלו ומה עלה בגורלן, ויש להיצר על כך שכן משהסתברו הדברים רק כעת אין מנוס מדחיית מועד הדיון, הקבוע ליום 2.10.2013.

הדיון הקבוע ליום 2.10.2013 יבוטל אפוא, ותחתיו ייקבע הערעור לשמיעה ליום 16.1.2014 בשעה 11:30.
במטרה לייעל את הליכי השמיעה ולחסוך בזמן שיפוטי מתבקשים באי-כוח הצדדים להגיש לבית המשפט, ולמסור זה לזה, עיקרי טיעון קצרים בכתב שיכללו פרוט הטענות, הפניות לאסמכתאות משפטיות וכן מובאות מן הפרוטוקול ומן המוצגים שבדעתם לסמוך עליהן.
עיקרי הטיעון יוגשו כך שיהיו קריאים וברורים. הרווח בין השורות בהדפסה יהיה רווח כפול לפחות. האותיות יהיו בגופן 12 והמרווח בין האותיות יהיה "רגיל", תוך השארת שוליים ברוחב של שני סנטימטרים לפחות מכל צד. מידות אלה מתייחסות לגופן David . אם בעלי הדין משתמשים בגופן אחר עליהם להתאים את מידותיו לדרישות אלה.
המערערת תגיש את עיקרי טיעוניה לא יאוחר מיום 20.11.2013 בהיקף של עד 6 עמודים.
