החלטה
בקשה למתן צו ביניים להימנע ממעצרה, השמתה במשמורת והרחקתה מישראל של המבקשת 1 (להלן: המבקשת ) עד לבירור הערעור על פסק דינו של בית המשפט לעניינים מינהליים בירושלים (כב' השופטת נ'
בן-אור ) מיום 11.9.2012 בעת"מ 6702-07-12, בגדרו נדחתה עתירת המבקשים, ונקבע כי על המבקשת לעזוב את הארץ בהתאם להחלטת הגורמים המוסמכים במשרד הפנים.

המבקשת, אזרחית גיאורגיה כבת 48, נכנסה לארץ דרך מצרים בחודש ספטמבר 2008 ללא אשרה, ולטענתה, החל מחודש דצמבר 2009, היא "ידועה בציבור" של המבקש 2, אזרח ותושב ישראל כבן 52 אשר עלה לארץ בשנת 1973 (להלן: המבקש ). לאחר שעזבה המבקשת את גיאורגיה ונכנסה דרך מצרים לישראל, קיבלה המבקשת רשיון שהייה בארץ כפליטה עד לבירור עניינה בוועדה המייעצת של משרד הפנים לענייני פליטים (להלן: הוועדה המייעצת ) . ביני וביני, הלך והתהדק הקשר בין המבקשת למבקש, ובמקביל להליך גירושין של המבקש מאשתו, עברה בתחילה המבקשת לגור עימו בבית אחותו, ובהמשך שכרו השנים דירה בירושלים.

ביום 31.12.2009 דחתה הועדה המייעצת את בקשת המבקשת להכרה כפליטה, לאחר שהתרשמה כי הגיעה לארץ בשל צורך כלכלי לשם מימון טיפול רפואי עבור בעלה ועבור בתה. כן נקבע בהחלטה, כי על המבקשת לעזוב את הארץ עד ליום 14.1.2010. כנגד החלטה זו עררה המשיבה בראשית חודש פברואר 2010, אולם בסופו של יום, בחרו המבקשים לנהל את ההליכים בעניין המבקשת באפיק שונה, וביטלו את הערר.

ביום 12.1.2010 (יומיים לפני המועד בו היה על המבקשת לעזוב את הארץ על פי החלטת הועדה המייעצת) פנו המבקשים ללשכת מנהל האוכלוסין וההגירה בירושלים, וביקשו להסדיר את מעמדה של המבקשת כבת זוגו של המבקש על פי הנוהל להסדרת מעמד בני זוג של אזרחים ישראלים. שימוע בנושא נערך ביום 9.2.2010, וביום 12.3.2010 נמסר למבקשים כי בקשתם נדחתה עקב ההתרשמות השלילית באשר לכנות הקשר ביניהם, וכי על המבקשת לעזוב את הארץ עד ליום 17.4.2010. על החלטה זו עררו המבקשים לרשות האוכלוסין וההגירה ביום 12.4.2010, וביום 24.6.2010 נדחה הערר נוכח היות המבקש נשוי ולאור סתירות שהתגלו בשימוע, ונקבע כי על המבקשת לעזוב את הארץ עד ליום 8.7.2010.

כנגד החלטה זו עתרו המבקשים ל בית המשפט לעניינים מנהליים בירושלים, בהטעימם כי המבקש כבר מצוי בהליך גירושין שמתעכב שלא באשמתו (עת"מ 22238-07-10 בפני השופט סובל ). דיון בעתירה התקיים ביום 13.4.2011, ובפסק הדין שניתן בתום הדיון, הופנו המבקשים למיצוי הליכים בדרך של השגה בפני ועדת ההשגה לזרים (להלן: ועדת ההשגה ).
ביום 28.4.2011 פנו המבקשים לועדת ההשגה, אולם זו דחתה את הבקשה בהחלטתה מיום 31.5.2012. כנגד החלטה זו עתרו המבקשים ל בית המשפט לעניינים מנהליים בירושלים (עת"מ 6702-07-12 ביום 3.7.2012, להלן: העתירה השניה ), שדחה את עתירתם בפסק דינה של השופטת בן-אור מיום 11.9.2012.
על פסק הדין בעתירה השניה נסב הערעור שהוגש על ידי המבקשים, במסגרתו עתרו בבקשה דכאן למתן צו ביניים כאמור לעיל.

המבקשים טענו, בין השאר, כי הסיבה להימלטות המבקשת מגיאורגיה היא סכסוך עם בעלה אשר הדרדר לאיומים באלימות כנגדה, ולא שיקולים כלכליים כפי שטענה בפני הוועדה המייעצת, על פי עצות שקיבלה מאחרים. לטענת המבקשים, לאחר שהגיעה המבקשת ארצה התחזק הקשר ביניהם, וכיום הם מקיימים "משק בית משותף ואורח חיים זוגי", ועל כן הדרישה מהמבקשת לעזוב את הארץ הינה "בלתי סבירה, שרירותית ואף עונשית", גם אם שהייתה בישראל אינה כדין. נטען, כי שגה בית משפט קמא בדונו בעתירה השניה בהתבססו על השימוע לבחינת הקשר אשר נערך למבקשים לפני כשלוש שנים, ובכך שהתעלם ממצב הדברים הנוכחי, ומבלי להתייחס לתשובות שנתנו המבקשים ל'סתירות' שעלו בשימוע. עוד מלינים המבקשים על כך שלא נלקחה בחשבון העובדה כי המבקש עשה כל שביכולתו להשלים את גירושיו מאשתו, ואף ניתן למבקש בבית הדין הרבני היתר לשאת אשה נוספת בשל סרבנותה לקבל גט.
לטענת המבקשים, נוכחותה של המבקשת בארץ חיונית לבחינה אמיתית של הקשר בין המבקשים בימים אלה, וכי בגדרה של בחינה זו יש לקיים שימוע נוסף. אם המבקשת תידרש לעזוב את הארץ לפני קיומו של שימוע, אזי תפּגע יכולת המבקשים להוכיח את מהות הקשר ביניהם וכנותו.

דין הבקשה להידחות.
הערעור נסב על עניינים עובדתיים מובהקים שנדונו והוכרעו ב בית המשפט קמא, וכידוע אין דרכה של ערכאה זו להתערב בהכרעות עובדתיות או בממצאי מהימנות של הערכאה הדיונית. באספקלריה זו, הרי שסיכויי הערעור נמוכים. למעלה מן הצורך אציין, כי הסתירות בדברי המבקשים ובגרסאותיה השונות של המבקשת בראיונות ובשימועים שנערכו להם, ואשר עליהן הצביעה השופטת בן-אור בפסק דינה (סעיף 12) הינן "מהותיות היורדות לשורש הענין", ומעוררות ספק משמעותי באשר לכנות הקשר בין המבקשים.
הנטל על המבקשים אף כבד במיוחד, הן נוכח אופי הבקשה שלפני (סעד זמני בערעור, וראו פסקה 9 לפסק דינו של השופט מלצר בעע"מ 3894/08
ב.ר.ב. תעשיות (אשפרה וייצור) בע"מ נ' מכבסת לבנון (לא פורסם, 16.10.2008)), והן בשל השיקול שהמבקשת-החוטאת לא תצא נשכרת מכניסתה שלא כדין לארץ (וראו סעיף 32 לפסק דינה של השופטת (כתוארה אז) ביניש בעע"מ 4614/05 מדינת ישראל נ' אורן (לא פורסם, 16.3.2006)).

אשר למאזן הנוחות, ברי כי הרחקתו של אדם מן הארץ אינה דבר של מה בכך. עם זאת, הנזק העלול להיגרם כתוצאה מדחיית הבקשה למניעת הליכי ההרחקה מן הארץ בשלב הערעור אינו בלתי הפיך, שכן ככל שיתקבל הערעור תוכל המבקשת לשוב ולהיכנס כדין לישראל, ולממש כדין את הקשר הזוגי שלה עם המבקש.
יש לזכור כי במקבילית כוחות עסקינן, ומבחני סיכויי הערעור ומאזן הנוחות הם מבחנים מצטברים, ועל כן, חרף הקושי הטמון בהרחקת אדם מן הארץ, אין בכך כדי לרפא את סיכויי הערעור הנמוכים (לבקשות שנדחו למתן סעד זמני לעיכוב הרחקה מהארץ ראו, בין היתר, עע"מ 6336/09 ריו נ' שר הפנים (לא פורסם, 23.8.2009); עע"מ 3568/11 דה רוסאריו תיאודור נ' משרד הפנים (לא פורסם, 19.5.2011) והאסמכתאות שם); עע"מ 2252/10 טמאנג נ' שר הפנים
