הכלל בדבר הראיות שניתן להציג לבית המשפט שלערעור, בגדרי תיק המוצגים, קבוע בדין (ראו תקנה 437(א) לתקנות סדר הדין האזרחי, התשמ"ד-1984; להלן: התקנות ), והפסיקה חזרה והבהירה סוגיה זו בהחלטות רבות (ראו למשל ב"ש 153/86 צביח נ' מדינת ישראל , פ"ד מ(2) 345 (1986)). הכלל המרכזי הוא כי לגבי מסמכים הבאים להוכיח עניין שבעובדה (להבדיל מאסמכתאות משפטיות שנועדו לתמוך בטענה נורמטיבית), רשאי בעל-דין לצרפם לתיק המוצגים רק אם אלה התקבלו כדין כראיה בערכאה הדיונית, או לחילופין התקבלו כראיה על-פי החלטה המתירה הגשת ראיות נוספות בערעור. ודוק: על-פי תקנה 457 לתקנות, בעל-דין בערעור אינו רשאי להציג ראיות נוספות שלא הוגשו והתקבלו על-ידי הערכאה הדיונית, אלא אם הדבר הותר במפורש על-ידי ערכאת הערעור. עוד יצוין כי כל עוד לא הוחלט להתיר את הגשת הראיה, אין בעל-הדין רשאי להתייחס אליה בכתבי טענותיו.
המערער בתגובתו אינו חולק על כך שהמסמכים הנדונים לא הוצגו לפני בית המשפט קמא. הוא טוען כי מדובר ב"בקשה קנטרנית" שנועדה לסרבל את ההליך, וכי הראיות שבהן עסקינן מצויות באינטרנט וגלויות לעין כל. אלא שטענות אלה של המערער אין בהן, כלל-וכלל, כדי להכשיר את צירוף המסמכים מבלי שנתקבלו כדין בערכאה המבררת ומבלי שבית המשפט שלערעור התיר את צירופן לפי בקשה מתאימה. בעל-דין אינו רשאי להגיש ראיות בערעור על דעת עצמו וכראות עיניו, גם אם מדובר במסמכים שהופקו מאתרי אינטרנט כאלה ואחרים.
בשולי הדברים אציין - במענה לטענה נוספת שהשמיע המערער - כי התצהיר התומך בבקשה (הוגש ביום 25.5.2011 לפי החלטתי מיום 23.5.2011), חתום על-ידי מר איתן זילביגר, מנכ"ל המשיבה. בבקשה לסילוק ראיות עצמה, כפי שהוגשה לבית המשפט , נאמר כי התצהיר המלווה אותה ניתן על-ידי איתן זילביגר (סעיף 20 לבקשה). אין אפוא חוסר הלימה בעניין זה. מכל מקום, משלא חלק המערער על הטענה כי מדובר במסמכים שלא הוצגו לפני הערכאה קמא ולא נתקבלו כדין כראיות, התוצאה המתחייבת היא כאמור לעיל.
אשר על כן, אני מורה כדלקמן:
א.
המערער יגיש מחדש את ערעורו ואת סיכומיו, וכן את תיק המוצגים, לאחר שישמיט מהם את ההתייחסות לראיות האמורות ואת הראיות עצמן. זאת יעשה עד ליום 12.6.2011.
ב.
המזכירות תשיב לידי המערער את הערעור, את הסיכומים ואת תיק המוצגים המצויים עתה בתיק.
ג.
ככל שיחפוץ בכך המערער, יוכל להגיש עד המועד שנקבע לעיל בקשה לצירוף ראיות, מנומקת וערוכה כדין.
ד.
המועד להגשת סיכומי המשיבה בתיק מוארך עד ליום 28.6.2011.
ה.
המערער יישא בשכר טרחת עורך-הדין של המשיבה בגין הבקשה שלפניי בסך של 2,000 ₪.
ו.
החלטה זו תתויק בתיקי השופטים שישבו בדין.
