השופט א' רובינשטיין:
א.
המערערים, אחים, יחד עם אדם נוסף הנדון בתיק אחר, כולם קטינים בעת המעשה, (מערער 1 היה חודש לפני הבגירות ומערער 2 בן 16 ו-8 חודשים) הורשעו לפי הודאתם בכתב אישום מתוקן בארבעה אישומים: שני מעשי שוד בנסיבות מחמירות, שאחד מהם גם כלל לגבי מערער 1 הטרדה מינית והתנכלות; מעשה תקיפה לשם גניבה וגניבה; ופרשה נוספת של גניבות רכב. כל המעשים נעשו בתוך שני לילות סמוכים, במרחק יום ביניהם. המערערים נדונו ל-48 ו-32 חודשי מאסר בהתאמה ולמאסרים על תנאי שונים, וכן הוטל פיצוי למתלוננים.
ה.
באישום הראשון שדדו המערערים והאחר מכשירי טלפון נייד וכסף ממתלוננים קטינים להם הציעו "טרמפ" באישון בוקר, תוך שימוש באלימות (אלות), פציעת מתלונן ואיום בחפץ חד. מערער 1 נהג ללא רשיון רכב וביטוח. באישום השני שדדו המערערים והאחר מתלוננת טרמפיסטית באישון בוקר, תוך נטילת טלפון נייד, צמידים ושרשרת (שתלשו מצווארה), ומערער 1 גם ניסה לנשק את המתלוננת; מערער 2 הצמיד חפץ חד לצווארה. באישום השלישי קשרו המערערים והאחר לגנוב רכוש, תקפו מתלונן קטין בן 12 לשם גניבת הטלפון הנייד שלו וגם סטרו על פניו כשניסה לרדוף אחריהם. כל שלושת המקרים היו בלילה אחד (13.7.13). לפי האישום הרביעי ב-15.7.13 לפנות בוקר החלו המערערים והאחר בנסיון שימוש בלא רשות (גניבה בלשון פשוטה) ברכב אחד ונטישתו, אחר כך ברכב שני ונטישתו, ולבסוף נגנבו אופנוע בלוני גז ונעשה ניסיון לגנוב כבלי חשמל.
ג.
בית המשפט קמא עיין בתסקירי שירות המבחן לנוער ש גיל ו רקע משפחתי קשה של המערערים, וכך גם דברי מחלקת הרווחה המקומית ביישובם. נוכח חומרת המעשה והתרשמות השירות לא היתה המלצה טיפולית.

בית המשפט ציין כי הגם שמדובר בקטינים אשר המחוקק קבע להם סדרי דין מיוחדים, אין להם חסינות מפני מאסר במקרים כמו ענייננו, פרשת "יומיים של פורענות" תוך פגיעה בחלשים – קטינים ואשה, בתוך אלימות אכזרית. נוכח היעדר עבר פלילי והודיה וחרטה מזה, והשיקולים לחומרה מזה, גזר בית המשפט את הדין. הוא ראה הבדל בין מערער 1 ל-2, שכן מערער 2 חלקו קטן יותר ותסקירו היה טוב במידה מסוימת. הוזכרה גם סולחה עם חלק מן המתלוננים. הושת העונש כאמור.
ה.
בערעור ובפנינו נטען בעיקר לעניין הפער בין גזרי הדין, וכן הוזכרו העבר הנקי, ההודיה, נסיבות החיים הקשות ופסיקה מקלה יותר שהוגשה. עוד נאמר כי האירועים באו ללא תכנון ויש לראותה כאירוע משולב אחד.

עיינו בתסקירים משלימים של שירות המבחן לנוער, שיזרו על תיאור הרקע המשפחתי הקשה, וציינו כי מערער 1 מוגדר במאסרו כבעל סיכון גבוה לבריחה, וטרם הפנים את חומרת המעשים אך מסוגל יותר כיום להליך טיפולי, אלא שזה טרם החל. לגבי מערער 2 דובר על הסתגלות לתנאי הכליאה ועם זאת תפקוד כוחני במאסר ועבירות משמעת, וכן הודאה אך לקיחת אחריות חלקית בלבד. לא ניתנה המלצה לגבי שני המערערים. גם בפנינו ציינה נציגת השירות כי לא הוחל מסיבות שונות בתהליך טיפולי, אף שיש נכונות מצד המערערים, אם גם לא קבלת אחריות מצדם.
ז.
מטעם המדינה נטען כי גם אם היו המערערים קטינים (המערער 1 סמוך לבגרות), פעלו כבוגרים, לרבות החלפת לוחיות הרישוי ברכב; חומרת המעשים משמיעה כי העונש שניתן היה מתון יחסית, וצוין כי טרם שולם הפיצוי.
ח.
לאחר העיון לא ראינו מקום להתערבות בענישה במקרה דנא. אכן המדובר בקטינים, והמחוקק קבע לגביהם מערך שיקולים ייחודי (ע"פ 49/09 פלוני נ' מדינת ישראל (2009)) ולחברה אינטרס בשיקומם (ע"פ 3562/05 פלוני נ' מדינת ישראל (2005)), כפי שהזכירה הסניגוריה. ואולם, המערערים חטאו באורח קשה וחמור במספר פרשיות, שאמנם היו ברצף, אך מסע העבירות נעשה ברוע, והופנה הן כלפי קטינים הן כלפי אשה שהיו בדרך באישון בוקר, חוליות חלשות וטרף קל. כל אחת מן הפרשיות הצדיקה מאסר של ממש, ומכל מקום כך לגבי מעשי השוד, לא כל שכן בהצטברן יחד. העונש שהושת על המערער 1 אמנם חמור משמעותית משל מערער 2, אך לטעמנו, אם בכלל, הקל בית המשפט בעונשו של מערער 2. אי אפשר שלא ליתן ביטוי עונשי ראוי לנסיבות הקשות של המקרה, גם אם הושגה סולחה עם חלק מן המתלוננים. שירות המבחן אינו בא בהמלצות ונימוקיו עמו; ובפסיקה שהוגשה על-ידי הסניגוריה לא מצאנו מקרה דומה. על כן איננו רואים להיעתר לערעור. אנו מקוים כי לקח הפרשה יופנם על-ידי המערערים במבט לעתיד.
